HomeMy WebLinkAbout1975-1799 ANNEXING & ZONING PROPERTY TO YAKIMA. ORDINANCE NO. ,/21 AN ORDINANCE annexing property to the City of Yakima and zoning said property. WHEREAS, pursuant to procedures prescribed by state law, a special election was held on May 20, 1975, on the matter of the annexation to the City of Yakima of certain unincorporated area, the legal description of which is set out on EXHIBIT "A" hereto, at which election there was also submitted the question of whether such property, if annexed, would be assessed and taxed at the same rate and on the same basis as property within the City to pay outstanding indebtedness of the City, and WHEREAS certified return of votes cast at such election, and a recount of such votes, indicate that the proposition concerning the annexation of such property did pass, but that the proposition concern- ing the assumption of indebtedness failed; and, the City Council finds and determines it to be in the best interests of the City that the property described on EXHIBIT "A" hereto be annexed to the City of Yakima without a requirement that such property assume outstanding indebtedness of the City, and WHEREAS, Section 12.08.070 of the City of Yakima Municipal Code provides that area annexed to the City be classified as R-1, One-Family Zone, in the absence of proceedings to otherwise classify such property; and no such proceedings having occurred with regard to the property which is annexed by this ordinance, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The real property situated in Yakima County, Washing- ton, contiguous to the City of Yakima and legally described on EXHIBIT 0 "A" attached hereto and by this reference made a part hereof, is hereby annexed to the City of Yakima, Washington. Section 2. The owners of the property annexed to the City by this ordinance shall not be required to assume existing indebtedness of the City. Section 3. The property annexed to the City by this ordinance is hereby zoned R-1, One-Family Zone. Section 4. The next regularly amended Use District Map prepared by and for the City of Yakima shall show said property as zoned and III classified as R-1, One-Family Zone. Section 5. The City Clerk is hereby authorized and directed to file a certified copy of this ordinance with the County Auditor of Yakima County and with the Board of County Commissioners of Yakima County, Washington. Section 6. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter.
