WHEREAS, a petition has been filed with the City Council of the City y of Yakima requesting the vacation of the ' hereinaf ter described q g alley, and WHEREAS, a hearing by the City Council was duly held on said peti- ton, and as a result of such hearing the City Council finds it to be in the best interests of the City of Yakima that said petition be granted and that said alley be vacated, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA : - Section 1. That the following described alley in the City of Yakima, Washington, to -wit: The alley extending north and south through the block bounded on the North by Lincoln Avenue, on the South by B Street, on the West by North 5th Avenue and on the East by North 4th Avenue, being the alley in Block 268, of Ker's Second Addition, and Syndicate subdivision to the Town of North Yakima, according to the official plats thereof filed in Vol. A, Page 32, and Volume A, Page 25, respectively, of Plats, records of Yakima County, Washington, be, and the same is hereby, vacated. Section 2. The City of Yakima hereby reserves all necessary easements and rights-of-way for the installation and maintenance of any and all water mains, sewers or utilities of any and all kinds which may now exist in said alley or which it may hereafter desire to construct thereon, and no buildings shall be constructed on any por- tion of said vacated alley without the prior approval of the City. Section 3. This ordinance shall be in full force and effect 30 days after its passage, approval and publication as provided by law and by the City Charter.
