AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at 301 South llth Avenue in the City of Yakima, Washington, from i -1, i odic fied Business Zone, to Planned Development Zone. WHEREAS; pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 23rd day of July, 1973, upon the recommendation of the Planning Commission that real property at 301 South 11th Avenue within the City of Yakima, Washington, the legal des- cription of which is set out hereinbelow, be rezoned from B -1, Modified Business Zone, to a Planned Development Zone, and . WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property owners in the vicinity do not oppose the change in classification; that the needs of the City and community do require such change and that the highest and best use of said property is for Planned Development Zone, new, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated at 301 South llth Avenue in the City of Yakima, Washington, and more par ticularly described as 'follows, to wit: Lot 16, Block 394, Capitol Addition to North Yakima, now Yakima, and .Bedkers Addition to Yakima as recorded in the official plats thereof in the office of the Auditor of Yakima County, Washington; be rezoned from B -1, Modified Business Zone, to a Planned Development Zone, be, and the same is hereby, approved and said real property is hereby rezoned to a Planned Development Zone, all in accordance with, and to conform to, the final development plan and program therefor approved by the Yakima Planning Commission, a copy of which is attached hereto and by reference made a part hereof. t Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The City Clerk is hereby authorized and directed to III file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as provided by law and by the City Charter. The Applicant, Bank of Yakima, P. 0. Box 1352, Yakima, Washington 98907, is the owner of property situated at 301 South llth Avenue, Yakima, Washington 98902. The exact legal description of said property being: Lot 16, Blk, 394. Capital Addition to North Yakima, now Yakima, and Bedkers Addition to Yakima, according to the official plat thereof recorded in the office of the Auditor of Yakima County, Washington. II. The Bank of Yakima requests that the above noted property be reclassified from B-1, Modified Business Zone, to PD, Planned Development Zone. III. Why does applicant believe the location of the use in question on the particular property is essential or desirable for the public convenience or welfare and will not be detrimental to the immediate neighborhood? Immediate neighborhood in three directions, other than East, is cur- . • rently all used for business or commercial use. We wish to bring an additional business service into this area for the convenience of the . . many professional and medical, and small businesses, as well as individuals working,or living in the immediate area. IV. Describe how the proposed use and improvements are to be designed and arranged to fit into the development of adjacent property and the neighborhood. We propose to establish a small commercial banking facility which will blend in perfectly in physical appearance. Although we will provide adequate parking and drive-in window facilities, we antici- pate that a major portion of our customers will be walk-in from the surrounding compact medical and commercial area. We anticipate retaining the existing evergreen specimens on the site, plus adding new plantings. V. Reclassification of the above noted property is requested for the following purposes: We propose to conduct a limited service type of commercial banking. Please refer to plot plan presented herewith. VI. The Bank of Yakima is furnishing the following to the Planning Commission: 1. Plat map showing boundaries and dimensions of property. (Within a 200-300 foot circle) 2. APPROVAL OF BANK OF YAKIMA PLANNED DEVELOPMENT AT llth Avenue & Spruce subject to following provisions: 1. The most northwesterly parking space is removed and the area landscaped. 2. Alley parking is redesigned to allow a total distance of 43' between front of cars and eastern edge of alley. 3. Street trees are provided. 4. Any necessary curb or sidewalk improvements are made subject to approval by the Director of Public Works. 5. Landscaping and irrigation plans are submitted to and approved by the Department of Community Development prior to issuance of any permits. 6. Sign size, design, height, and location is approved by the Department of Community Development prior to issuance of any permits.
