ORDINANCE NO. /53 AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated at the northwest corner of 40th Avenue and Nob Hill Boulevard in the City of Yakima, Washington, from R-3, Multiple Family Zone, to B-1, Modified Business Zone. WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 23rd day of July, 1973, upon the recommendation of the Planning Commission that real property situated at the northwest corner of 40th Avenue and Nob Hill Boulevard within the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R-3, Mlatiple Family Zone, to B-1, WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property 0 owners in the vicinity do not oppose the change in classification; that the needs of the City and community do require such change and that the highest and best use of said property is for Local Business Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA : Section 1. The recommendation of the Planning Commission of the City of Yakima that the following described real property situated at the northwest corner of 40th Avenue and Nob Hill Boulevard in the City of Yakima, Washington, and more particularly described as follows, to wit: Parcel 1: Beginning at the southeast corner of Lot 54, Mount Vista Addition, as recorded in Volume "R" of Plats, 110 page 1, records of Yakima County, Washington; thence east 30 feet; thence south 70 feet to the true point of beginning; thence south 110 feet; thence west at right angles 176.25 feet; thence north at right angles 110 feet; thence east 176.25 feet to the point of be- ginning. Parcel 2: Beginning at the southwest corner of the east/half of the east half of the southeast quarter of the north west quarter of Section 27, Township 13 North, Rate 18, E.W.M., being the east line of 41st Avenue routh; thence north 460.7 feet; to a point 3 feet west of the A t . southwest corner of Lot 35, Mount Vista Addition, as recorded in Volume "R" of Plats, page 1, records of Yakima County, Washington, and south 0 ° 06' east 70 feet from said southwest . corner; thence: north • 89° 19 east 149.25 feet; thence north 8 ° 0' east 70.81 feet; thence east 166.4 feet; thence south 530.7 feet to the south line of said subdivision; thence west 325.5 feet to the point of beginning, EXCEPT right-of-way for Nob Hill Boulevard, 26 feet wide; EXCEPT right-of-way for .Yakima Valley Transportation Company; EXCEPT beginning at the southwest corner of Lot 54, said Mount Vista Addition; thence north 89 ° 19' east along the south line of said lot, _a distance of 166.4 feet; thence south 180 feet; thence west at right angles 176.25 feet; thence north at right angles 110 feet; thence north 8 ° 0' east 70.81 feet to the point of . beginning; EXCEPT beginning at the southeast corner of Lot 35, said Mount Vista Addition; thence south 8 west - 70. 81 feet to point of beginning; thence south paral- lel to the east line of 40th Avenue South 110 feet; thence west at right angles 149.25 feet, more or less, to the east line of 41st Avenue South; thence north at right angles 110 feet, thence north 89 ° 19' east 149.25 • feet to the point of beginning; and EXCEPT the east 30 feet for street; be rezoned from R -3, Multiple Family Zone, to B -1, Modified Business Zone, be, and the same is hereby, approved and said real property is hereby rezoned to Modified Business Zone. Section 2. The above change in zoning shall be included and - depicted on the next regularly amended Use District Map prepared by and for the City. Section 3. The. City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4. This ordinance shall be in full force and effect • thirty days after its passage, approval and publication as provided by law and by the City Charter.
