AN ORDINANCE relating to public services. and -facilities; adopting regulations for installation of. services and specify- ing domestic water and sewer service charges; amending Sections 7.68.040, 7.68.250, 7.68.255, 7.68.265, 7.68.282 and 7.60.020, and repealing Sections. 7.68.030, 7.68.045, 7.68.267 and Subsection 7.68,252 (c), all of the City of,Yakima Municipal Code; and declaring an emergency. 0 BE IT . ORDAINED BY THE CITY OF YAKIN,A : Section 1. Section 7.68.040 of the City of Yakima Municipal Code is hereby amended t� read as follows: , "7.68.040 Installation of Services. A. A-'separate meter and. service connection shall be installed to serve each one family dwelling unit, as defined • in Title 12, Zoning, of the City of Yakima Municipal Code, supplied with domestic water service; provided, multiple dwellings (including duplexes and apartment houses), mobile home parks, co -ops, condominiums, and similar dwelling unit . complexes, under single or common ownership or management, • may be served by either a single meter and service connec- tion or multiple meters and service connections at the option of the owner or manager thereof, regardless of whether the dwelling units therein are individual consumers for the 411 purpose of computing water service charges as provided by• Section 7.68.265 of. this chapter. - B. (1) In the event of the sale or other transfer of title of any family dwelling unit constituting a portion of a multiple dwelling, mobile home park, co -op, 'condominium, or'other similar dwelling unit complex so that such sold or otherwise transferred dwelling unit is separately owned, a separate_ meter and service connection shall be installed to serve each such separately owned dwelling . unit; provided, this . subsection B shall not apply to the sale of dwelling . units within condominiums by unit number according to applicable laws. (2) In the event a separate meter and service connec- tion its required by this section, the City may discontinue water service to the premises which is required t� be, separately served until such separate meter and service connection is installed. C. After,the applicant has .complied with all the pres- cribed requirements relating to the-application for service III connections and has paid all charges, the City shall cause the property described to be connected with_ the municipal water system. Wherever practicable,the service connection shall be made in the street in front of the property to be served. Each service shall consist of a tap and connection with the main pipe, a length of service pipe extending from the main to a curb cock and water meter situated outside of the traveled roadway adjacent to the property to be served, together with the necessary covers for meters and curb cock. Di The City shall have the right to install a s!_pglc , service pipe from the main to the property line, of sufri- cient size to supply two or more separate properties, and with individual curb,cocks and meters for the separate properties." Section - • 2 Section 7.68.250 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.68.250 Water ServiceCharies. The one-month period is defined as any period of time from one day up to and including one month and fourteen days, and the two-month period is defined 411 as any period of time from one month and fifteen days to two months and fourteen days. Minimum ready-to-serve and consumption charges for water supplied outside the City shall be computed by multiplying the applicable rate above by 1.5." Section 3. Section 7.68.265 of the City of Yakima Municipal Code is hereby amended to read as follows: 41 1 "7,68.265 Char:es for More Than One Premise Sue.lied Throligh One Meter. Where more than one individual consumer is supplied with water through one meter, the individual who applies for ser- vice shall be responsible for all charges and the bill shall be ,computed as though there were a separate metered service for each individual consumer and each used an equal quantity of water con- , sumed,'proVided, that only one ready-to-serve charge shall be . made for each such single-meter installation. There shall be no deductions for vacant premises. For purposes of this section, each one family dwelling unit and each-dwelling unit in a .two family dwelling or in a. multiple dwelling, as all those terms are defined in Title 12, Zoning, of the City of Yakima Municipal Code, shall constitute one individual consumer. Further, for purposes of this section, each separate mobile'home site within a mobile home court, park or other mobile home complex shall con- stitute one individual consumer; provided, an automobile trailer, court as defined in, Title 12, Zoning, of the City of Yakima Muni- cipal. Code, rather than each separate trailer site therein, shall constitute an individual consumer for purposes of this section." Section 5. Section 7.68.282 of the City of Yakima Municipal Code. All is hereby amended to read as follows: "7.68.282 Fire Service Charges. Any fire hydrant installed and maintained by the city outside the city limits will be billed as a fire service, which charge shall be terminated at such time as the responsible consumer's property is annexed to the city." Section 6. Section 7.60.020 of the City of Yakima Municipal Code is hereby amended to read as follows: "7.60.020 Sewer Service There is hereby charged to all premises served by city domestic water a sewer service charge which is hereby fixed at seventy-five percent of the water charge for domestic water furnished to the premises; pro- vided, in no event shall the sewer service charge be less than two dollars per month for premises inside the city limits, nor less than three dollars per month for premises outside the city limits." Section 7. Sections 7.68.030, 7.68.045 and7.68.267 and Subsec- tion 7.68.252 (c), all of the City of Yakima Municipal Code, are hereby repealed in their entirety. Section 8. The rates for water and sewer service charges speci- fied by this ordinance, together with the regulations and other pro- visions hereof, shall be effective on and after Section 9• This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
