AN ORDINANCE accepting the recommendation of the Planning Commission and re-
zoning certain property situated at 1624 South 24th Avenue in the
City of Yakima, Washington, from R-4, Suburban Residence
Zone, to Planned Development Zone.
WHEREAS, pursuant to due and legal notice, the City Council of the City of
• Yakima held a hearing On the 24th day of September, 1973, upon the recommenda-
tion of the Planning CornmissiOn that real property at 1624 South 24th Avenue within

the City of Yakima, Wa.shingtori, the legal descriptidh of which is set out hereinbe-
,
low, be rezoned from R-4, Suburban Residence Zone, to a Planned Development
Zone, and
WHEREAS, the City Council finds that such recommendation of the Planning
Commission for such rezoning should be approved for the reasons that such rezon-
ing is in accord with good planning and with the General Plan of the City of Yakima;
that the majority of property owners in the vicinity do not oppose the change in
classification; that the needs of the City and community do require such change and
that the highest and best use of said property is for Planned Development Zone,

BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the City of
Yakima that the following described real property situated at 1624 South 24th Avenue
in the City of Yakima, Washington, and more particularly described as follows, to
wit:
The North 220 feet of the South 510 feet of the Easterly 594 feet (lying
westerly of the right of way line of 24th Avenue) of the following described
tract:
That portion of the Northeast quarter of the Northwest quarter of Sec-
tion 35, Township 13 North, Range 18, E. W. M., described as follows:
Beginning at the Northeast corner of said subdivision; thence South along
the East line of said subdivision 600 feet to the North right of way line
of a lateral from the Natchez and Cowichye Ditch (as said lateral was
• located and existed on November 25, 1905) and the true point of begin-
ning of the herein described tract; thence South along the East line of
said subdivision 710 feet more or less to the Southeast corner of said
subdivision; thence West along the South line of said subdivision to the
Southeast corner of the West half of the West half of the Northeast
quarter of the Northwest quarter of said Section 35; thence North along
the East line of said West half of the West half of the Northeast quarter
of the Northwest quarter of said Section 35 to a point 573.5 feet South
of the North line of said subdivision; thence East 389. 5 feet more or
less to the Easterly or Northerly right of way line of a lateral from
the Natchez and Cowichye Ditch; thence Southeasterly along the North-
erly right of way line of said lateral 612.5 feet more or less to the
true point of beginning.

EXCEPT right of way for road along the East side thereof. Warranties
of seller are limited to that part of the above described property which .
is included within seller's north and west usage fences. :

be, and the same is hereby, approved and said real property is hereby rezoned to
a Planned Development Zone, all in accordance with, and to conform to, the final
development plan and program therefor approved by the Yakima Planning Commis-
sion, a copy of which is .attached hereto and by reference made a part hereof.
Section 2. The above change in zoning shall be included and depicted on the
next regularly amended Use District Map prepared by and for the City.
Section 3. The City Clerk is hereby authorized and directed to file with the
Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall be in full force and effect thirty days after
its passage, approval and publication as provided by law and by the City Charter.
