ORDINANCE NO. / AN ORDINANCE relating to local government administration; designating the organization'of management groups, departments and offices and specifying their responsibilities; amending sections 1. 18. 020, 1. 18. 030, 1. 18. 040, 1. 18. 050 and 1. 18. 060; enacting sections 1. 18. 017, 1. 18. 041 and 1. 18. 061 410 as new sections; and repealing sections 1.18.052, 1.18, 053, 1. 18. 054, 1. 18. 055, 1. 18. 056, 1. 18. 065, 1. 18. 067, 1. 18.070, 1.18.072, 1.18.080, 1.18.090, 1.18.091, 1.18.092, 1.18.100, 1.18.110, 1.18.111, 1.18.120, 1.18.130, 1.18.132, 1.18.134, 1.18.135, 1.18.136, 1.18.140, 1.18.142, 1.18.145, 1.18.150, 1.18.155 and 1.18.196, all of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 1.18.020 of the City of Yakima Municipal Code is here- by amended to read as follows: "1.18.020 Administrative Organization--General Provisions. A, The organization and management of the City administration shall be by depart- ments and offices grouped into four major categories: Community Develop- ment; Public Services; Public Works; and Management and Budget. Officers and Department Heads, including the Directors of each Group, shall be responsible to the City Manager for the supervision and control of their respective offices and departments. The function of the Director of each Group is to coordinate the activities of the Officers and Department Heads in his Group, and, when called upon on behalf of the City Manager, )10 direct and control their activities. All Officers, Department and Division Heads identified in this Chapter, together with the Directors and City Manager, comprise the Management Group. B. Administration shall be divided into four Management Groups as follows: 10 Community Development: Responsible for comprehensive physical, social„ economic, human and environmental plans and programs designed to encourage and direct proper urban growth. 2. Public Services: Services commonly seen and used by citizens, namely, police, fire, transit, airport, cemetery, refuse col- lection, parks and recreation. 3, Public Works: Responsible for the design, construction, and maintenance of streets, traffic control systems, water and sewer systems, and the water and sewage treatment plants. 40 Management and Budget: Provides administrative planning, programming and budgeting for all departments and offices; • responsible for efficiency and effectiveness within all depart- ments and offices in use of manpower and money; central services for all departments. " Section 2. Section 1.18.030 of the City of Yakima Municipal Code is hereby amended to read as follows: "1.18.030 Community Development Group. Under the general super- vision and coordination of the Director of Community Development the following Offices shall perform the responsibilities and duties generally described as follows: 1. Office of Environmental Planning. Under the supervision of the Principal Planner, this office shall: (a) Conduct studies and research rel.tive to the development and redevelopment of the City of Yakima and its environs; (b) Conduct studies and research relative to the amendment of and additions to the general plan for the City, and rela- tive to zoning, rezoning and subdivision of property; (c) Administer policies and procedures relative to annexations to the City, and relative to the extension of City utilities to serve property outside the City; (d) Provide all staff assistance and counsel, secretarial and clerical services required by the City Planning Commission; (e) Perform such other duties as may be directed by the City Manager. 2. Office of Housing and Neighborhood Conservation. Under the supervision of the Chief of Housing and Neighborhood Conserva- 11111 tion, this office shall: (a) Conduct studies and research and administer programs relative to housing, neighborhood rehabilitation and environ- . ment, and community development and redevelopment; (b) Provide staff assistance and counsel required by various housing and neighborhood conservation-related committees and groups. (c) Perform such other duties as may be directed by the City Manager. 3. Office of Code Administration. Under the supervision of the Chief Building Inspector, this office shall: (a) Enforce all laws, rules and regulations relative to zoning, housing, building and construction codes; (b) Provide staff assistance and counsel to the Board of Adjust- ment, Building Code Board of Appeals, Board of Plumbing Examiners, Mechanical Code Examining Board and the Housing Advisory and Appeals Board. (c) Perform such other duties as may be directed by the City Manager. -2- Section 3. Section 1.18.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "Section 1.18.040 Public Services Group. Under the general super- vision and coordination of the Director of Public Services, the following departments shall perform the responsibilities and duties generally des- cribed as follows: 1. Police Department. A. Under the direction of the Chief of Police, this Department shall: • (a) Provide for the protection of persons and property and pre- vent crimes; (b) Detect and apprehend offenders and suspected persons; (c) Enforce all ordinances and statutes relating to law enforce- ment and traffic control; (d) Preserve peace and order in the City; (e) Perform such other duties as may be required by law or the City Manager. B. This Department shall consist of three primary divisions, supervised by Divisional Commanders, and responsible to the Chief of Police, as follows: (a) The patrol division shall be responsible for: uniform field personnel and operational patrol functions; and traffic • control. (b) The Detective division shall be responsible for: The in- vestigative function of the Police Department; Bureau of records; and the Youth Bureau. (c) The Administrative Services division shall be responsible for: administrative services, communications and com- plaints; operation of the jail„ and training functions. 2. Fire Department. A. Under the direction of the Fire Chief, this department shall: (a) Provide for the protection of' persons and property and the elimination of fire hazards; (b) Enforce all ordinances and laws pertaining to fire safety; (c) Perform such other duties as may be required by law and the City Manager. B. The Department shall consist of three divisions, supervised by battalion chiefs and the Fire Marshal who are responsible to the Fire Chief, as follows: (a) The Fire Supression Division, unde!r the direction of the -3- Battalion Chief on duty, shall: respond to all alarms and prevent and extinguish fires; protect lives and property against loss from fire; maintain all property and equip- ment charged to the Fire Department; and perform such other duties as may be assigned by the Chief. . (b) The Fire Prevention Bureau, under the supervision of the Fire Marshal, shall be responsible for:. fire code prepara- tion; enforcement of fire and life safety codes and ordin- ances; investigation of fires; promotion of fire prevention, including litter control, and life safety practices; public education on fire safety. (c) The Administrative Services Division, under the supervision of a Battalion Chief, shall be responsible for administrative services; training, education and safety of Departmental personnel; repair and maintenance of communications, fire alarm and related systems; and the operation of the fire alarm headquarters. 3. Department of Parks and Recreation. Under the direction of a Director of Parks and Recreation, this Department shall con- struct, maintain and operate public facilities for use and enjoy- ment by the public administered by two divisions: (a) The Parks Division, under the direction of the Parks Super- intendent, shall maintain the City Parks and other public places as directed by law or by the City Manager. (b) The Recreation Division, under the direction of the Recrea- tion Superintendent, shall plan and implement recreation 411 programs for the general welfare of the people of the City and perform such other duties as may be required by law or Y q Y by the City Manager. 4. Transit Department. Under the direction of the Transit Manager, this Department shall: (a) Operate and maintain a public bus transportation system. (b) Perform such other duties as may be required by law or by the City Manager. 5. Airport Department. Under the direction of the Airport Manager this Department shall: (a) Maintain and operate the Yakima Air Terminal Building, run- ways and grounds; (b) Provide for the protection and security of air passengers and of property within the confines of the Yakima Air Terminal . (c) Perform such other services as may be required by law and 41 1 the City Manager. 6. Cemetery Department. Under the direction of - the Cemetery Superintendent, this Department shall: -4- (a) Maintain and operate Tahoma Cemetery; (b) Keep a correct record of all interments, showing the name, age, nativity, residence, whether married or single, and time of interment, of all persons buried in the Cemetery, and of the lot, block and section in which each person is in- terred; (c) Collect and pay to the City Treasurer all money due the City from the sale of blocks or parts thereof or labor performed for lot owners in or about the Cemetery; (d) Perform such other services as may be required by law or by the City Manager. 7. Refuse Department. The Refuse Department under the supervision of the Refuse Superintendent shall: (a) Collect and dispose of refuse for residential sections of the City; (b) Perform such other services as may be required by law or by the City Manager." Section 4. Section 1.18.050 of the City of Yakima Municipal Code is here- by amended to read as follows: "1. 18. 050 Public Works Group. Under the general supervision and coordination of the Director of Public Works, the following Offices and Departments shall perform the responsibilities and duties generally des- ID cribed as follows: 1, Street Department. Under the direction of the Street Superinten- dent, this Department shall: (a) Maintain, repair, clean City streets, alleys, bridges and catch basins; and remove snow from the City streets; • (b) Maintain and repair sidewalks; (c) Maintain street right-of-way such as removing weeds, pick- ing up leaves, pruning or removal of unwanted trees; (d) Perform such other services as may be required by law or the City Manager. • 2. Office of Engineering. Under the direction of the City Engineer, this Office shall: (a) Provide for the preparation of all estimates, plans and speci- fications for all types of public construction projects; • (b) Provide surveying and inspection services and maintain suitable files and records of all official maps, plats, sur- veys and construction projects; -5- (c) Prepare legal descriptions and arrange for the acquisition of all street rights-of-way by dedication, purchase or condemnation; (d) Negotiate with property owners and prepare cost estimates and assessment rolls for all local improvement district projects; (e) Administer construction contracts and authorize progress 11111 payments on public improvement projects; (f) Coordinate with other departments and provide survey and cost data needed in planning projects and applying for state and federal grants; (g) Perform such other services as may be required by law or by the City Manager . 3. Office of Traffic Engineering. Under the supervision of the Traffic Engineer, this Office shall: (a) Make traffic studies and recommendations; prepare and review geometric designs of City streets and intersections. (b) Investigate complaints and prepare reports on requests for parking, speed control, signing, striping, signal and light- ing installations; (c) Supervise installation of parking meters, signing and strip- ing of City streets, installation and regulation of traffic signals, and the installation of street lights. • (d) Supervise abatement of vision hazards, placement of trees, utility poles, and landscaping in the public right-of-way; (e) Perform such other services as may be required by law or by the City Manager. 4. Water Department. Under the supervision of the Water Super- intendent, this Department shall: (a) Maintain and operate all domestic water lines, pumps, dis- tribution systems, water meters, service lines and appurten- ances; and water treatment plant; (b) Review plans of all new water lines and extensions of lines which are to be connected to the City water system. (c) Install and maintain fire hydrants; (d) Maintain maps and records of water system; (e) Operate, maintain and improve the irrigation water system, 11111 including all lines, pumps, reservoirs, canals and ditches; (f) Perform such other services as may be required by law or by the City Manager. -6- 5. Sewer Department. Under the supervision of the Sewer Super- intendent, this Department shall: (a) Maintain and operate all sewer lines, pumps, collection systems and appurtenances of the domestic sewer system; (b) Maintain storm drains; • (c) Maintain and operate the Sewage Treatment Plant and industrial waste treatment system; (d) Perform such other services as may be required by law or by the City Manager. 6. Garage. Under the supervision of the Fleet Superintendent, the Garage shall: (a) Service, maintain and repair City vehicles and equipment; (b) Maintain vehicle maintenance and operation cost records, administer the Equipment Replacement Fund and recommend rental rates; (c) Prepare specifications for new and replacement vehicles and equipment; (d) Perform such other services as may be required by law or by the City Manager. " Section 5. Section 1.18.060 of the City of Yakima Municipal Code is here- * by amended to read as follows: "1.18.060 Management and Budget Group. Under the general super- vision and coordination of the Director of Management and Budget, the following Offices shall perform the responsibilities and duties generally described as follows: 1. Office of General Accounting. Under the direction of the Finance Officer, this Office shall: (a) Compile the annual budget and prepare estimates therefor; (b) Maintain a general accounting system for the City government and exercise budgetary control over all expenditures by offices and departments; (c) Perform internal audits of all City financial affairs; (d) Prepare a monthly report of the fiscal activities of all funds for the preceding month and such other reports as may be required by the City Manager; (e) Enforce the provisions of the City's traffic ordinances pertain- ing to nonmoving traffic violations, concurrently with the Police Department. Metermen employed in this Office are hereby vested with authority to enforce such ordinances by -7- placing notices on illegally parked vehicles, as prescribed by applicable ordinances, and by signing formal complaints for the issuance of warrants by the court for violations of such ordinances; (f) Service, maintain and repair parking meters; (g) Maintain control and a running inventory of all fixed assets of the City; (h) Perform such other services as may be required by law or by the City Manager. 2. Office of Utility Accounting. Under the direction of the Super- visor of Utility Accounts, this Office shall: (a) Receive all customer applications for utility services; (b) Collect and maintain data for billing and collection of all customer utility accounts; • (c) Maintain a uniform utility accounting system for the water and sewer utilities as required by state law; (d) Perform such other services as may be required by law or by the City Manager. 3. Office of Treasury. Under the direction of the City Treasurer, this Office shall: (a) Be responsible for the receipt, custody and disbursement of all City funds, all local improvement district funds, and other trust funds, keeping accurate accounts of all collections and disbursements for each fund; (b) Be the custodian of all City investments and bank collateral, investing idle funds as may be prudent and lawful; (c) Prepare and submit all financial statements and reports re- , quired by law; (d) Prescribe the times at and manner in which monies received by the several offices and departments of the City shall be paid into the treasury or deposited in a bank; (e) Make deposits of City funds in banks in the manner prescribed by law; (f) Purchase and sell bonds for benefit of local improvement dis- trict funds and the local improvement district guaranty fund; (g) Sign all checks of the City and designate in writing a repre- sentative to sign such checks in the event of the Treasurer's absence or inability to act; (h) Maintain an office for the purpose of receiving all money paid as bail by nonmoving traffic violation citations; (1) Perform such other services as may be required by law or by the City Manager. -8- 4. Office of Data Processing. Under the direction of the Systems Analyst, this Office shall: (a) Analyze and make recommendations for automation of systems within the various offices and departments; (b) Design, program, and maintain systems for approved appli- cations; (c) Maintain a working relationship with Yakima County's Data Processing Department in the operation of the City-County Joint Computer Center. (d) Perform such other services as may be required by the City Manager. 5. Office of Purchasing. Under the Direction of the Purchasing Agent, this Office shall: (a) Purchase all supplies, materials and services for the City, except the service of specialists, upon properly executed requisitions; (b) Store all supplies and materials not delivered to the various departments; (c) Supervise the care and maintenance of City Hall; (d) Supervise the disposal of surplus property; (e) Maintain and manage an insurance program covering City • buildings and equipment; (f) Perform such other services as may be required by law or by the City Manager. 6. Office of Personnel. Under the direction of the Personnel Officer, this Office shall: (a) Prepare and maintain a classification and pay plan based on the duties, authority and responsibility of positions in the municipal service; (b) Administer procedures for the appointment, promotion, dis- , cipline, and separation of employees, including recruitment, testing, counseling, and selection services for all departments and offices; (c) Establish and maintain a personnel record system for all em- ployees in the municipal service; (d) Administer all rules and regulations pertaining to Civil Service, and provide staff assistance to the Civil Service Commissions; • (e) Perform such other services as may be required by law or by the City Manager. -9- 7. Office of Records. Under the direction of the City Clerk, this Office shall: (a) Receive, on behalf of the City Council, all petitions, claims, filings for office and similar official communications. (b) Maintain a journal of Council proceedings, record all ordi- nances and resolutions, post notices and make publications • as requested by law. (c) Maintain all Council records, books, papers, bonds and other valuable documents of the City unless otherwise provided for by other applicable law; (d) Supervise City elections as the law may require; (e) Administer the City licensing laws; (f) Supervise animal control officers in enforcement of laws and ordinances relating to dogs and other animals; (g) Administer central telephone services, reproduction services, and Word Processing Center; (h) Perform such other duties as may be required by law or by the City Manager. 8. Office of Safety and Training. Under the direction of the Safety and Training Officer, thi. Office shall: (a) Develop and administer a safety program for all employees to reduce accidents; (b) Develop and administer a training program for all employees to improve individual and organizational capabilities; (c) Perform such other duties as may be required by law or by the City Manager. " Section 6. Section 10 18.017 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: • "1. 18. 017 Legal Department. The Legal Department, under the super- vision of the City Attorney, shall: (a) Advise and assist in the preparation of and prepare in final form and certify as to legality, all ordinances, orders and regulations; (b) Prepare and pass on the legality and correctness and form of all contracts, bonds, and other legal instruments to which the City is a party; 411i (c) Advise the Council, the City Manager, all Department Heads and other administrative officials and all Boards and Com- missions regarding legal matters; (d) Be responsible for all prosecutions under ordinance of the City; (e) Represent the City as Attorney in all legal proceedings in which the City is a party; (f) Recommend settlement or compromise of claims or suits at law or equity to which the City may be a party involving prop- erty rights or money claims; -10- _ . (g) Preserve in its office copies of all opinions rendered by the Department; (h) Perform such other legal duties as may be required by the Charter, ordinance, the Council, or the City Manager. The City Attorney or an Assistant City Attorney designated by him, shall attend all meetings of the City Council, and, upon invitation, AA any meeting of any committee or advisory board of the Council. " IP Section 7. Section 1.18.041 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: "1. 18. 041 Airport Security Guards--Members as Peace Officers-- Powers and Duties: A. In order that the Airport Department may pro- vide for the protection and security of air passengers and property pur- suant to Section 1.18.040 5. (b) of this Chapter, the position of Airport Security Guard is hereby created. Airport Security Guards shall be under the direction of the Yakima Airport Manager. B. Airport security guards, duly sworn in the same manner as are peace officers, shall have the power and duty to inspect emplaning passengers at the Yakima Air Terminal building as required by applicable laws, rules and regulations, and shall enforce laws and ordinances pertaining to safety of persons and the security of property within the confines of the Yakima Airport. For that purpose, airport security guards are hereby vested with authority to carry out the duties specified by this section, including the authority to arrest with or without a warrant, in the same manner pro- vided for other peace officers, for violations of laws and ordinances related • to the safety of persons and the security of property at the Yakima Air Terminal. " Section 8. Section 1.18.061 is hereby enacted as a new section of the City of Yakima Municipal Code to read as follows: "1.18.061 Animal Control Officer --Duties and Authority. A. In order that the City Clerk may supervise Animal Control Officers in the en- forcement of laws and ordinances relating to dogs and other animals pur- suant to Section 1.18.060 7. (f) of this Chapter, the position of Animal Control Officer is hereby created. Animal Control Officers shall be under the direction of the City Clerk and shall receive technical supervision from the Chief of Police. 13. The Animal Control Officer shall enforce all ordinances pertaining to the regulation, control and licensing of dogs and other animals in the City, concurrently with the Police Department. For that purpose, he is hereby vested with authority to impound animals when required or authorized to do so by applicable City ordinances, to issue notices to persons who he has reason to believe have violated such ordinances, to sign formal complaints 4 for the issuance of warrants by the court for violations of such ordinances, to , cooperate with the Health Officer exercising jurisdiction in the City regard- ing investigation of dog bites and the quarantine of dogs for rabies examina- tions, and with authority to otherwise perform his duties imposed by this section and other ordinances of the City. " -11- Section 9. Sections 1. 18. 052, 1. 18. 053, 1, 18. 054, 1. 18. 055, 1. 18. 056, 1. 18. 065, 1. 18, 067, 1. 18. 070, 1. 18. 072, 1. 18. 080, 1. 18. 090, 1. 18. 091, 1,18.092, 1.18.100, 1.18.110, 1.18.111, 1.18.120, 1.18.130, 1.18.132, 1.18.134, 1.18.135, 1.18.136, 1.18.140, 1.18.142, 1.18.145, 1.18.150, 1.18.155 and 1.18.196 of the City of Yakima Municipal Code are hereby repealed. Section 10. This ordinance is one to provide for the immediate preserva- tion of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publi- cation as provided by law and by the City Charter.
