AN ORDINANCE establishing a pedestrian mall on 2nd Street between
Walnut and "B" Streets; adopting a plan therefor and
providing for the limiting and regulating of vehicular
traffic therein; and declaring an emergency.
411 WHEREAS, R.C.W. Chapter 35.71 vests authority in the City to
establish and regulate any street right-of-way as a pedestrian
mall and to prohibit, in whole or in part, vehicular traffic on
such mall, such authority to be exercised by ordinance enacted
pursuant to a resolution of the City Council declaring its inten-
tion to establish such a mall and calling a public hearing on the
matter, and
WHEREAS, on October 15, 1973, the Yakima City Council did
adopt Resolution No. D-3024 declaring the intention of the City
• Council to establish such a pedestrian mall on 2nd Street between
Walnut and "B" Streets and fixing November 5, 1973, as the date
410 for a public hearing on the matter, all pursuant to and in accordance
with applicable laws, and
WHEREAS, pursuant to such Resolution No. D-3024, and after due
notice in accordance with applicable laws, the City Council held a
public hearing on November 5, 1973, to consider and determine whether
such a pedestrian mall should be established; and as a result of
such public hearing, the City Council finds and determines that the
public interest, safety and convenience will be best served by the
establishment of such a mall, that vehicular traffic will not be
unduly inconvenienced thereby, that property abutting on and in
the vicinity of the moll will benefit from its establishment, that
411 the plan for establishment of such a mall is consistent with the
• intent of the General Plan of the City of Yakima as heretofore
adopted, and that such a mall should be established, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. That part of 2nd .Street between Walnut and "B"
• Streets in the City of Yakima is hereby established as a pedestrian
mall and is hereby regulated for use as a pedestrian mall in
accordance with the plan for such mall as depicted on the drawing
filed herewith in the office of the Yakima City Clerk, which
drawing is identified with the caption "2nd Street Pedestrian and
Parking Mall Plan" and dated October 15, 1973, and is by reference
made a part hereof and adopted as the plan for such mall.
Section 2. The operation and parking o.f vehicular traffic
within the pedestrian mall established by this ordinance shall be
limited and regulated as indicated by the drawing and plan for such
mall as adopted by Section 1 of this ordinance and as provided by
Ordinance No. 1581 enacted contemporaneously with the passage o.f
this ordinance establishing such mall.
Section 3. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and wel-
fare of .the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and
effect immediately upon its passage, approval and publication as
provided by law and by the City Charter.
