ORDINANCE NO. ____/6/2/
AN ORDINANCE relating to city personnel; fixing the salary for
the Mayor; specifying fringe benefits for certain
city employees; specifying the amount of contribu-
tion by the City to employee group insurance premiums;
providing for salary adjustments on the promotion,
reclassification, demotion, special assignment or
111 call back to duty of certain employees; authorizing
and regulating reimbursement for travel expenses;
authorizing and regulating leaves of absence for
vacation leave, sick leave and leave without pay;
amending Sections 2.04.030, 2.20.060, 2.20.086 (a),
2.20.088 (a), (b) and (e), 2.20.093, 2.40.020(A),
2.40.030, 2.40.060 and 2.40.100, and repealing Sec-
tions 2.44.010, 2.44.020 and 2.44.030, all of the
City of Yakima Municipal Code; and declaring an
emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 2.04.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.04.030 City Contributions. A. Life Insurance Plan.
Effective January 1, 1974, the City shall provide a fully
paid three thousand dollar life insurance policy for each
patrolman, policewoman and sergeant in the Police Department
and a fully paid two thousand dollar life insurance policy
for each other employee covered by the group life insurance
411 plan adopted by Section 2.04.010 of this chapter.
B. Hospital and Medical Insurance Plan. Effective
January 1, 1974, the City shall contribute the amount of
three dollars per month for each member of the Police and
Fire Departments who is covered by the LEFF pension act and
who has enrolled his dependents to be covered by the group
hospital and medical plan adopted by Section 2.04.010 of
this chapter; the City shall contribute thirteen dollars
and fifty cents for each member of management and other per-
sonnel in the Fire Department not covered by the LEFF pension
plan act enrolled in such plan; and the City shall contribute
sixteen dollars and ninety-two cents for each other employee
enrolled in such plan."
Section 2. Section 2.20.060 of the City of Yakima Municipal
Code is hereby amended to read as follows:
" 2.20.060 Iransferpromotion, reclassification, demotion
or reinstatement of employees. When an employee is transferred,
promoted, reclassified, demoted or reinstated, his rate of pay
411 for the new position shall be determined as follows:
(a) Transfer: An employee transferred to another
• position in the same class will continue to receive the
same rate of pay until he is promoted or demoted.

(b) Promotion/Reclassification: An employee
promoted or reclassified to a position in a class having
a higher pay range shall receive a salary increase as
follows:
1. If his rate of pay in the lower class is below the
minimum salary of the higher class, his rate of
pay shall be increased to the minimum rate or the
second step for the higher class, whichever pro-
110 vides at least a five percent increase.
2. If his rate of pay in the lower class falls within
the range of pay for the higher class, the employee
shall be advanced to the step in the higher range
which provides at least a five percent increase.
3. In the case of promotion, within range increases
shall be granted in accordance with Section 2.20.040
(b).
4. In the case of reclassification, the employee
shall be eligible for a within range increase
on his normal anniversary date. For employees
who have been at the maximum of the salary range
for more than one year, the date of reclassification
shall become his anniversary date for future within
range increases.
(c) Demotion: An employee demoted from a position
in one class to another having a lower pay range shall
receive a salary decrease of not less than five percent.
1. If the rate of pay of the employee in the higher
class is above the maximum salary for the lower
class, his rate of pay will be decreased to the
maximum rate of the lower class, unless the decrease
shall be less than five percent, in which case
his pay shall be reduced to the next lower pay step
in the pay range.
2. If the rate of pay of the employee in the higher
class is within the pay range of the lower class,
his rate of pay will be decreased by five percent."
Section 3. Section 2.20,086 (a) of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.20.086 Reimbursed Expenditures--Amounts. All officers
and employees shall, in addition to their prescribed rates of
pay, be reimbursed for the following listed expenditures:
(a) Transportation. The actual fare shall be paid, if
410 by common carrier. If private auto is preferred by the employee
and is authorized, reimbursement for official travel will
be made at six cents per mile. If a city vehicle is unavailable,
or its use is otherwise impractical, reimbursement at the rate

of ten cents per mile will be made. The reimbursable expense
for travel by private car shall not exceed the fare for
travel by first class railroad or air coach, if such travel;
by private car, is authorized for a point outside the State
of Washington."
Section 4. Subsections 2.20.088 (a) , (b) , and (e) of the
City of Yakima Municipal Code are hereby amended to read as follows:
"2.20.088 Uniform Allowance-- S•ecial Assignment Pa .
(a) Police detectives and patrolmen assigned to the detec-
tive division of the Police Department, when not issued or
required to wear a uniform in the performance of their assigned
duties, shall be paid a monthly clothing allowance of eighteen
dollars in lieu of an issued uniform.
(b) When a salaried employee works in a higher classifi-
cation for a period of one day or longer, performs substantially
all of the duties of such higher classification and is not
actually receiving supervised training for such position,
the employee shall be paid at the lowest step in the higher
class which reflects a pay increase of at least five percent.
The provisions of this section shall not apply to management
personnel.
When an hourly employee works in a higher classification
for a period of one hour or longer, performs substantially
all of the duties of such higher classification and is not
actually receiving supervised training for such position, the
employee shall be paid at the lowest step in the higher class

which reflects a pay increase of at least five percent.
(e) When any commissioned member of the police depart-
ment is assigned by the Chief of the department to a position
in a higher classification for a period of four hours or more,
such member shall be paid at the lowest rate of the higher
classification which provides any salary increase for the officer
for the actual time so assigned. The amount of payment for
a such special assignment shall be computed in accordance with
any applicable provision of Section 2.40.100 of this code.
The payment for any such special assignment duty shall be
subject to the availability of department funds for such
purpose."
Section 5. Section 2.20.093 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.20.093 Salary of Mayor. Effective January 1, 1974,
the salary of the Mayor shall be $550 per month."
Section 6. Subsection 2.40.020(A)of the City of Yakima
Municipal Code is hereby amended to read as follows:
"2.40.020 Vacation Leave. (A) Rate of Accrual of Vaca-
time Leave.
(1) Commencing July 1, 1971, each eligible employee
shall earn vacation leave at the rate of six and seven -
tenths hours vacation for each full calendar month of
service.

(2) Commencing July 1, 1971, each eligible employee
with five or more years of continuous service shall earn
vacation leave at the rate of eight hours vacation' for
each full calendar month of service.
(3) Commencing July 1, 1971, each eligible employee
with ten or more years of continuous service shall earn
vacation leave at the rate of ten hours vacation for
each full calendar month of service.
(4) Commencing January 1, 1974, each eligible
employee with fifteen or more years of continuous ser-
vice shall earn vacation leave at the rate of twelve
hours vacation for each full calendar month of service;
provided, the provisions of this paragraph (4) shall
not apply to commissioned officers in the Police Depart-
ment below the rank of captain."
Section 7. Section 2.40.030 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.40.030 Sick Leave.
A. Accrual. Sick leave with pay shall accrue at
the rate of one working day of leave for each full calen-
dar month of the eligible employee's continuous service
with the City. Unused sick leave in any year shall be
accumulative for succeeding years to a maximum of one
!II hundred twenty (120) working day.
B. Permissible Use of Sick Leave. An employee
eligible for sick leave with pay shall be granted such
leave for the following reasons:
(1) Personal illness or physical incapacity result-
ing from causes beyond employee's control.
(2) Quarantine of employee due to exposure to a
contagious disease.
(3) On the job injuries. Any employee receiving
sick leave with pay, who is eligible for time loss pay-
ments under the Workman's Compensation Law shall, for
the duration of such payment, receive only that portion
of the employee's regular salary which, together with
said payments, will equal the employee's regular salary.
In order not to work an undue hardship on the employee
caused by the time lag involved in time loss payments,
the employee shall be paid full salary and on receipt
of time loss payments shall endorse such payments to
II! the City. Said employee shall be charged with sick leave
only for that portion of the employee's regular salary
for which the City is not reimbursed by the Workman's
Compensation payments endorsed to the City.

(4) The death of a member of the immediate family
of an employee or-,.employee's spouse. For purposes of
this subparagraph, the term 'immediate family' means
any husband, wife, parent, grandparent, child, grand-
child, brother or sister. No leave of absence in excess
of three days for a family death shall be taken by an
employee unless additional leave is recommended by
the employee's department head and approved by the
appointing authority.

(5) Serious injury or illness to members of
employee's immediate family living with and dependent
upon the employee, constituting an emergency or crisis.
Any sick leave granted for this purpose must be recom-
mended by the department head and approved by the appoint-
ing authority.
(6) Sick leave shall not be used for pregnancy,
maternity confinement nor prenatal care. Sick leave
shall be allowed for disabilities caused by complica-
tions arising out of childbirth upon presentation by
the employee of a doctor's statement verifying such
disability.
(7) Sick leave shall not be allowed for any period
of time that the employee is gainfully employed by another
employer.
C. Re.uirements for all •aid sick leave. (1)
Every employee must report to the representative desig-
nated by his department head the reason for the absence
411 as far in advance of the starting of his scheduled work
day as possible, but in no event shall this report be
made later than the first day of absence.
(2) An employee must keep his department head
info rmed of his condition if absence is of more than
thre working days in duration.
(3) For each absence an employee must submit upon
the approved form an explanation of the reason for such
absence. A statement by the attending physician may
be required if an absence caused by illness or injury
extends beyond three working days, or for each absence,
if requested by the department head.
(4) Employees must permit home visits or medical
examinations at the expense and convenience of the city.
D. Enforcement of Sick Leave Provisions.
(1) Any
failure to comply with the provisions of paragraph C
above shall be grounds for denial of sick leave with
pay for the Period of absence.
(2) Misrepresentation of any material facts P y s in
connection with paid sick leave by any employee shall
constitute grounds for suspension or discharge.
(3) It shall be the responsibility of the depart-
ment head or his designated representative to:

(a) Review all applications for sick leave
and approve those which are bona fide and comply
with the provisions of this section and forward
same to the personnel department. The Director
of Personnel shall not certify the payment of sick
leave until the approved applications have been
received, except that employees still absent at the
end of a pay period may be certified for payment
of sick leave by the Director of Personnel upon
recommendation of the department head as indicated
by his signing the time sheet and subject to the
receipt of an approved application for sick leave
pay immediately upon the employee's return to
work.
(b) Investigate any suspected abuse of sick leave.
(c) Withhold approval of sick leave pay in the
event of unauthorized use.
(d) Initiate disciplinary action if, as a
result of investigation, it is determined that an
employee has been guilty of willful misrepresenta-
tion in a request for sick leave pay.
E. Sick Leave Exchange. Any permanent employee
may exchange accrued sick leave for pay at the option
of the employee, subject to the following conditions
and provisions:
111 (1) A request for such an exchange shall be made
to the finance office. All requests shall be in writing
and shall be signed by the employee making the request.
(2) Requests will be accepted only during the
first five working days of January, March, June and
September, with payment to be made within forty calendar
days of the date the request is received by the office
of the finance officer.
(3) No request will be granted for less than eight
hours pay. Exchange of sick leave for pay will be per -
! mitted at the following rates:
(a) Employees may exchange each thirty -two
hours of sick leave for eight hours of pay.
(b) Upon retirement or death, the employee's
accrued sick leave will be exchanged at a rate
of eight hours of pay for each twenty -four hours
accrued (or a percentage thereof) for the first
576 hours accrued, and eight hours pay for each
thirty -two hours accrued for the balance of the
accrual, and will appear on the employee's final
pay check automatically.
(4) No exchange will be granted to an employee
who has been terminated for cause or who terminates
voluntarily unless a request is made in accordance with
(1) and (2) above.

(5) In the event of layoff, exchange requests
are the responsibility of the employee and will be granted
at the rate of eight hours pay for each thirty -two hours
exchanged (or a percentage thereof).
(6) In December of each year, any accruals beyond
the one hundred and twenty day limitation will be auto -
matically exchanged based upon the formula of eight hours
pay for each thirty -two hours accrued or a percentage
thereof for smaller accruals. Such pay will appear on
the employee's final pay check for the year."
Section 8. Section 2.40.060 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.40.060 Leave Without Pay. A. All leave without pay
must be requested and approved by the department head prior
to the beginning date of such leave
B. Leave without pay for more than fifteen working days
must be approved in advance by the appointing authority.
Leave without pay may be granted to an employee
who has accrued vacation recorded. This subparagraph shall
not be construed as forbidding the use of leave without pay
as a disciplinary measure.
C. Leave without pay shall be provided female employees
for childbirth provided that such leave requests conform with
A. and B. of this section. In addition, a written recom-
mendation by the employee's doctor shall be provided which
states the final date which the employee may work."
Section 9. Section 2.40.100 of the City of Yakima Municipal
Code is hereby amended to read as follows:
"2.40.100 Overtime Pa and Com•ensator Time.
A. Overtime Pay.
(1) Overtime payment will be allowed for an employee
below the rank of division head, police captain and bat-
; talion chief, when ordered to work, at the rate of time
and one -half except as follows:
1. When police officers are required to appear in munici-
pal court during their off duty hours they shall be
paid at a straight time rate for such time. A mini-
mum of two hours per day for court appearance shall
be allowed. The officers shall have the option to
take time off, at a straight time rate, in lieu of
payment, and to accumulate such time off to a maximum
of twenty -four hours for any one officer.
2. Overtime payment may be allowed for division heads,
police captains and battalion chiefs at the rate of
time and one -half when required to work because of
an emergency or unusual circumstances if approved by
the City Manager.

3. Department directors, when required to work over-
time in a non - supervisory capacity because of an
emergency determined by the City Manager, may be
paid overtime at a straight time rate.
(2) Pay for Fire Department personnel when called
from off shift in order to maintain minimum fire sup-
pression strength as determined by the City Council shall
be computed by dividing each employee's basic monthly
110 salary by ten to arrive at a twenty -four hour shift
rate and the hourly rate shall be computed by dividing
the shift rate by twenty-four. When personnel are
called from off shift by the Fire Chief because of a
fire the hourly rate shall be computed by dividing the
basic monthly salary by 173. A minimum of 2 hours pay
shall be allowed for any callbacks from off shift.
(3) Pay for employees, other than Fire Department
personnel, who are paid at a monthly rate shall be com-
puted by dividing the basic monthly salary by 173.
(4) Fractions of an hour served on overtime duty
shall be rounded to the next full hour for the purpose
of computing the amount of overtime.
(5) All overtime payments shall be contingent on
the availability of departmental funds.
B. Compensatory Time.
(1) Compensatory time off shall be allowed at the
rate of time and one -half when funds are not available
and for personnel below the rank of department director
in cases where overtime pay is not authorized by this
chapter.
(2) Allowable compensatory time worked shall be
reported on the monthly time sheets as prescribed by
the Director of Finance.
(3) Compensatory time off must be requested,
approved and reported in the same manner as prescribed
for vacation leave.
(4) Compensatory time off may be accrued to a
maximum of three working days. Any compensatory time
accrued in excess of three working days will be for -
feited unless the City Manager approves the accrual
of additional compensatory time because of an emergency
or other unusual circumstances.
C. Travel and Training Time. Time spent by an employee,
beyond the normal working day, for training classes or travel
shall not be considered overtime work."
Section 10. Sections 2.44.010, 2.44.020 and 2.44.030 of the
City of Yakima Municipal Code are hereby repealed in their entirety.

Section 11. This ordinance is one to provide for the
immediate preservation of the public peace, property, health,
safety and welfare of the people of the City of Yakima and an
emergency is hereby declared to exist and this ordinance shall
410 be in full force and effect immediately upon its passage, approval
and publication as provided by law and by the City Charter.
