HomeMy WebLinkAbout1974-1640 LOCAL ORDINANCE NO. /0 7 AN ORDINANCE relating to local improvement districts; providing for approval of local improvement district project plans, for supervision of work, and for determining construc- tion costs to be borne by the City; amending Section 8.12.045 of the City of Yakima Municipal Code; and • repealing City of Yakima Resolution No. C-1051. WHEREAS, by City of Yakima Resolution No. C -1051, adopted April 6, 1953, the Yakima City Commission declared that local improve- ment district assessments for installing water lines shall be limited to the cost of installing lines of 6inches diameter or smaller, regardless of the actual size of the lines installed, and WHEREAS, current fire underwriter's standards require water lines in excess of 6 inches in diameter be installed in most areas, and the Water -Sewer Fund of the City lacks sufficient reserves to subsidize the installation of larger water lines now found to be necessary or desirable for most projects; and the City Council 411 finds that Section 8.12.045 of the City of Yakima Municipal Code should be amended to so provide and that Resolution No. C -1051 should therefore be repealed, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 8.12.045 of the City of Yakima Municipal Code is hereby amended to read as follows: - "8.12.045 Approval ofplans -- Supervision of work-- Contri- bution by city. The city council shall in the ordinance provid- ing for any local improvement, approve the plans and specifica- tions for such improvement and place such plans and specifica- tions on file in the office of the city clerk subject to public inspection. The city engineer shall supervise and manage the work of all local improvements. Every ordinance ordering any improvement herein provided for shall declare what, if any, portion or proportionate amount of such cost and expense shall be borne by the city of Yakima out of any of its general funds and shall direct that the remainder of such costs and expense be assessed against the property witlin said district in the manner provided by law; provided, in the event the local improvement district project involves the installation of water lines, the assessment shall include the actual cost, as computed by the city engineer, of the installation of a water line not to exceed 8 inches in diameter in residential districts and not to exceed 12 inches in diameter in commer- cial and industrial districts. In the event larger sized lines are actually installed, the additional expense for such larger lines shall be borne by the City." • Section 2. City of Yakima Resolution No. C-1051, adopted April 6, 1953, is hereby repealed. • Section 3. This ordinance shall be in full force and effect thirty days after its passage, approval and publication as pro- vided by law and by the City Charter.
