ORDINANCE NO. 4;9/ AN ORDINANCE placing a parcel of real property in the City of Yakima on the Irrigation MainiEnance Roll of Local Improvement District No. 793. WHEREAS, on November 1, 1954, in Ordinance No. B-1615, the 411 City of Yakima created Local Improvement District No. 793 for the purpose of constructing and installing headworks and a system of mains, water pipes and service connections for furnishing water under pump pressure for irrigation purposes to all property within said District No. 793, and WHEREAS, the following described real property situated in the City of Yakima, YakimaCounty, State of Washington, to-wit: Lot 5, Menjanker Subdivision, as recorded in Volume "0" of Plats, page 2, records of Yakima County, Washington, except the north 21 feet thereof; also known as 924 South 22nd Avenue; is located adjacent and contiguous to said Local Improvement • trict No. 793, and WHEREAS, the owners of said real property desire to be fur- nished irrigation water through the facilities constructed under said Local Improvement District No. 793 and have paid their propor- tional share of the cost of said improvement as provided in said Ordinance No. B-1615, in the same manner and amount as the same would have been assessed had it been included in said district as initially originated and created, and WHEREAS, it is necessary and desirable that the owners of said real property pay the annual irrigation maintenance assessment proportional to the amounts paid by the owners of other properties within said District No. 793, now, therefore, 110 BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. That the following parcel of real property situated in the City of Yakima, Yakima County, Washington, to-wit: Lot 5, Menjanker Subdivision, as recorded in Volume "0" of Plats, page 2, records of Yakima County, Washington, except the north 21 feet thereof; is hereby included on the Irrigation Maintenance Roll of Local Improvement District No. 793 and the Director of Finance of the 4,_ City of Yakima is hereby authorized and directed to make irrigation maintenance assessments against said parcel in proportion to the charges assessed other parcels of property within said Local Improvement District. Section 2. The Director of Finance of the City of Yakima is hereby authorized and directed to notify the owners of said parcel of land of the inclusion of the same within said Irrigation Main- tenance Roll. Section 3. This ordinance shall be in full force and effect thirty days after its final passage, approval and publication, as provided by law and by the City Charter. STEEN & DAISY SVEEN husband & wife , are the owners of the following described property situated in the City of Yakima, Yakima County, Washington, to-wit: Lot 5, Menjanker Subdivision, as recorded in Volume "0" of Plats, page 2, records of Yakima County, Washington, e=14.*ip6.666=ffrth1 famt=±bn=1.4 (Address: 924 South 22nd Avenue) which lot is adjacent to and contiguous to Local Improvement District No. 793; and the undersigned is desirous of having irrigation water service extended to the property above described; fl NOW, THEREFORE, the undersigned, HAROLD M. SVEEN & DAISY SVEEN husband & wife do hereby covenant and agree that said above described property shall be assessed its proportional share and costs of said improvement as provided in Ordinance No. B-1615 in the same manner and amounts as the same would have been assessed had it been included in the district as originally initiated and created, due allowance being made for depreciation, which assessment is $223.32. This assessment is to be paid to the City Treasurer on or before the acceptance of this Agreement by the City. Furthermore, before this 0 Agreement is accepted by the City, the undersigned shall transfer to the City the water rights appurtenance to the above described property. Washington, to -wit: Lot 14, Menjanker Subdivision, as recorded in Volume "0" of Plats, page 2, records of Yakima County, Washington, except the north 21 feet thereof; (Address: 922 South 22nd Avenue) which lot is adjacent to and contiguous to Local Improvement District No. 793; and the undersigned is desirous of having irrigation water service extended to the property above described; NOW, THEREFORE, the undersigned, HENRY tt.
