AN ORDINANCE relating to traffic control; declaring it to be a mis-
demeanor to drive a vehicle in an inattentive manner on
a public highway so as to block or obstruct traffic; add -
ing Sections 9.50.053 and 9.50.110 as new sections of the
City of Yakima Municipal Code; repealing Section 9.37.010
of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Section 9.50.053 is hereby adopted as a new section
of the City of Yakima Municipal Code, which new section shall read as
follows:
"9.50.053 Inattention.
(a) Any person who drives any vehicle on a highway .
within the City of Yakima in an inattentive manner is guilty
of inattention, which is a misdemeanor. For the purpose of
this section, 'inattentive manner' means such a manner so as
to fail to maintain a careful lookout in the direction of
travel or to otherwise drive without due vigilance for per-
sons or property in or near the path of such vehicle.
(b) The offense of operating a vehicle in an inatten-
tive manner shall be considered to be a lesser offense than,
but included in, the offense of operating a vehicle in a
negligent manner, and any person charged with operating a
• vehicle in a negligent manner may be convicted of the lesser
offense of operating a vehicle in an inattentive manner."
Section 2. Section 9.50.110 is hereby adopted as a new section
cf the City of Yakima Municipal Code, which new section shall read as
follows:
"9.50,.110 Blocking Traffic. No person shall stop or leave
any vehicle, either attended or unattended, in any public high -
way in ouch a manner so as to unreasonably block or obstruct
vehicles lawfully traveling on such public highway."
Section 3. Section 9.37.010 of the City of Yakima Municipal Code
is hereby repealed in its entirety.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
• law and by the City Charter.
