AN ORDINANCE providing for the improvement of certain property by the .
construction of a pipe sewer with the necessary wye
branches and manholes in the vicinity of South 1st
Street and Russell Lane; establishing a Local Improve -
. ment District, providing for the method of payment
thereof, and creating a special fund.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following property situate in Yakima County,
Washington, shall be improved by constructing.a pipe sewer with the
necessary wye branches and manholes:
Beginning at the intersection of the centerline of South 1st
Street and the south right of way line extended of Russell Lane;
thence westerly along said right of way line to a point 340.1
feet east of the west line of the southeast quarter of the
northeast quarter of Section 31, Township 13 North, Range 19,
E.W.M. to the true point of beginning; thence southerly and
parallel with the west line of said subdivision 312.3 feet;
thence westerly parallel with the south line of said subdivision
to an intersection with the easterly right of way line of the
Burlington Northern Railroad; thence northwesterly along said
railroad right of way to an intersection with a line that is
• 859 feet southerly of the north line of the northwest quarter
of the northeast quarter of Section 31, Township 13 North,
Range 19, E.W.M., when measured at right angles; thence westerly
at right angles to said railroad right of way 130.5 feet; thence
northwesterly parallel with said right of way to a point
approximately 430 feet southerly from the north line of the
northwest quarter of the northeast quarter of Section 31, Town-
ship 13 North, Range 19, E.W.M.; thence northwesterly parallel
with and 9 feet northeasterly at right angles from the centerline
of the spur track as now constructed to a point of intersection
with a line parallel with and 55 feet easterly measured at right
angles from centerline of the main track of the Burlington
Northern Railway Company; thence northwesterly along said paral-
lel line to its intersection with the north line of the north-
east quarter of Section 31, Township 13 North, Range 19, E.W.M.;
thence easterly along said north line to its intersection with
the west line extended of Lot 18, St. Paul Acre Lots, according
to the plat thereof recorded in Volume "A" of plats, page 15,
records of Yakima County, Washington; thence northerly along
Lots 18 extended,. 18, 17, 16 and the south 137.5 feet of Lot 15
of said plat; thence easterly and parallel with the north line
of Lot 15, 225.83 feet; thence southerly and parallel with the
• west line of said Lot 15 and 16, 154.53 feet; thence easterly
and parallel with the north line and north line extended of said
Lot 16 to its intersection with the centerline of South 1st
Street; thence southeasterly along said centerline to its inter-
section with the north line of the northeast quarter of Section
31, Township 13 North, Range 19, E.W.M.; thence westerly along
said north line to the northwest corner of the northeast quarter
of the northeast quarter of Section 31, Township 13 North, Range
19, E.W.M.; thence southerly along the west line of said subdivi-
sion to its intersection with the centerline of King Street;
thence easterly along said centerline 200 feet; thence southerly
and parallel with the west line of the northeast quarter of the
northeast quarter of Section 31, Township 13 North, Range 19,
E.W.M., to the south line of said subdivision; thence easterly
along said subdivision line 272.0 feet; thence southerly and
parallel with the west line of the southeast quarter of the
northeast quarter of Section 31, Township 13 North, Range 19,
E.W.M., to its intersection with the south right of way line of
Russell Lane, thence westerly along said right of way line to
the true point of beginning.
• Section 2. There is hereby created a Local Improvement District,
to be called "Local Improvement District No. 986," which said district
shall include all of the above described property.
Section 3. The assessments shall be made according to special
benefits derived from the improvements without regard to the zone and
termini method.
Section 4. All costs and expenses in connection with the con-
struction of said improvements, including the cost and expense of
engineering, inspection, advertising, publication of notices, and all
other expenses incident thereto, shall be levied and assessed upon
all of the property embraced within said Local Improvement District,
• in the manner and as provided by the laws of the State of Washington
and the ordinances of the City of Yakima, and said City shall not be
liable in any manner for any portion of said costs and expenses of
said improvement.
Section S. All of the aforesaid construction work shall be in
accordance with the plans and specifications, profiles, maps and
detailed drawings which have been prepared by the City Engineer,
filed with the City Clerk, and which are hereby approved and adopted.
Section 6. All of the work necessary to be done in connection
with the making of said improvement shall be done and made by contract
upon competitive bids, and the City shall have the power to reject
III eny and all bids.
Section 7. There is hereby created a special fund, to be called
"Local Improvement Fund, District No. 986", into which shall be placed
all SUM3 paid on account of the aforesaid special assessments,

including all interest and penalties thereon, and in the event of the
sale of local improvement bonds by the City, all premium and interest
on said bonds issued for said improvement.
Section 8, Bonds bearing interest at a rate not to exceed 8%
• per annum, payable on or before 12 years from the date of issuance,
shall be issued in payment of the costs and expense of said improve-
ment, which bonds shall be redeemed by the collection of .special
assessments to be levied and assessed upon the property within said
district, payable in ten equal annual installments with interest at
a rate not to exceed 82% per annum, interest payable annually under
the mode of payment "payment by bonds ", as defined by the statutes of
the State of Washington and the ordinances of the City of Yakima; pro-
vided that, this improvement may be financed by the issuance of
promissory notes, under the authority of R.C.W. 35.45.150 and Section
8.12.100 of the City of Yakima Municipal Code.
• Section 9. This ordinance is one relating to local improvements
or assessments therefor, and shall become effective immediately upon
its passage, approval and publication as provided by law and by the
City Charter.
