AN ORDINANCE authorizing and directing The City Attorney of the City
of Yakima to institute and prosecute legal proceedings
for the condemnation and acquisition of real property
for the enlargement and improvement of a public park
known as Miller Park; providing for the condemnation
and taking of such real property and declaring the con-
demnation and taking thereof to be necessary for a public
use required by the public interests; and directing that
compensation for such taking be paid from the Park and
Recreation Capital Fund - -331 and declaring an emergency.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The City Attorney of the City of Yakima is hereby
authorized and directed to institute and prosecute an action in the
Superior Court of the State of Washington, in and for Yakima County,
for the condemnation and acquisition of the hereinafter described real
property for the purpose of enlarging and improving a public park known
as Miller Park, said real property being situated in the City of Yakima,
Yakima County, Washington, and being legally described as follows:
The south 40 feet of Lot 16, Block 64, Town of North Yakima,
0 now Yakima, Washington, recorded in Volume A of Plats, page 10,
and re- recorded in Volume E of Plats, page 1, records of Yakima
County, Washington.
Section 2. The , acquisition of said real property for the purpose
herein mentioned is required for the interests of the public and of
the City of Yakima, and the uses and purposes herein mentioned do con-
stitute a public use of said property, and that said real property is
necessary for the use and purposes mentioned herein.
Section 3. The compensation for said real property to be taken
shall be payable from the Park and Recreation Capital Fund - -331 of tI'ie
City of Yakima.
Section 4. In conducting said condemnation proceedings, the City
Attorney is hereby authorized to stipulate to any matters for the pur-
pose of minimizing damages.
Section 5. This ordinance is one to provide for the immediate
preservation of the public peace, property, health, safety and welfare
of the people of the City of Yakima and an emergency is hereby
declared to exist and this ordinance shall be in full force and effect
immediately upon its passage, approval and publication as provided by
410 law and by the City Charter.
