AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated at 3802 Tieton
Drive in the city of Yakima, Washington, from R -1, Single
Family Zone, to Planned Development Zone.
WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 26th day of June, 1972, upon
the recommendation of the Planning Commission that real property
situated at 3802 Tieton Drive within the City of Yakima, Washington,
the legal description of which is set out hereinbelow, be rezoned from
R -1, Single Family Zone, to Planned Development Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the
reasons that such rezoning is in accord with good planning and with
the General Plan of the City of Yakima; that the majority of property
owners in the vicinity do not oppose the change in classification;
that the needs of the City and couuuunity do require such change and
. that the highest and best use of said property is for Planned Develop-
ment Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the
City of Yakima that the following described real property situated at
3802 Tieton Drive in the City of Yakima, Washington, and more parti-
cularly described as follows, to wit:
The north 169.44 feet of the east half of the northwest quarter
of the northwest quarter of the northeast quarter of Section 27,
Township 13 North, Range 18, E.W.M., EXCEPT the west 220 feet
thereof; EXCEPT the north 30 feet thereof for Tieton Drive and
EXCEPT the east 20 feet for South 38th Avenue;
be rezoned from R -1, Single Family Zone, to Planned Development Zone,
• be, and the same is hereby, approved and said real property is hereby
rezoned to a Planned Development Zone, all in accordance with, and to
conform to, the final development plan and program therefor approved
by the Yakima Planning Commission, a copy of which is attached hereto
and by reference made a part hereof.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and dircted to
Ask file with the Yakima County Auditor a certified copy of this ordinance.

Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.

The property is at 3802 Tieton Drive and owned by Floyd F. Hampson, Jr. and
Mary Lou Hampson.

b. The written program for developmaat is as follows:
1. The proposed use of the property is to be as an orthodontic
office with the present two story house moved or torn down,
The new office building will be an attractive one story clinic
made of brick and wood with a shake roof and will blend in
well with any attracive residential area. Li_nce it is a
professional office the ; ccncept will be conservative
and any signing or lighting will be kept to a minimum only
as needed.
The proposed office is in the middle of the Franklin, Nob Hill,
Eisenhower and Calson school d which makes it con-
siderzibly easier for the children to obtain treatzdent as well
as those who live in the areas to the west of Yakima.
2. The ownership is solely by F. Frank and Nary Lou Hampson,
3. The operation and occupation of the dental office is solely
by F. Frank Hampson,
4. The waste disposal is by city garbage pick up and city sewage
and is normal to a dental office.
5. Lighting is by Pacific Power and Light Co.
6. Ilater supply is by ITob Hill Water Co.
7. Public transportation is by city bus which passes in front
of the office on Tieton Drive in a westward direction.
8. There are many surrounding community facilities - Franklin
Park with its swilming pool and tennis courts are to the east;
Fisher Park Golf Course is a block to the south and the
Eisenhower outdoor facilities are a block to the west with
proposed swimming pool and tennis courts being added soon.

9. The lot is (,)0 feet by 140 feet wAch males a total Qf 12,600
square feet. The proosed office will be approxfuqately 1200
square feet or 1/10 the total area.
The area of parking will be 2,000 square feet or 1/6 the
total area.
The area of the courtyard adjacent to the south of the office
will be ap7;rox 1200 scluare feet or 1/10 the, total area.
Me crounds and building maintenance will be sustained by the
owner.
10. The e:dsting house on the property will be moved or torn down
within the next two years and the dental office built soon
after.
A five foot sidewalk and a three to five foot planting strip,
located between the sidewalk and curb, is to be constructed along
111 South_38th Avenue and Tieton Drive. The planting strip is to be
planted with a variety of trees as recommended by the City Street
Tree Committee.
