APRIL 17, 1978
The City Council met in session on this date at 7:30 PM in the Conference
Room, City Hall. Council members present were Mayor Betty L. Edmondson,
Henry Beauchamp, Don'Hinman and Jack Sparling. Council members Nadine
Walker and Gordon Wonder absent and excused.
Council members discussed the selection of voting delegates and alternates
for the AWC. Convention, to be held here on June 14, 15, and 16th, 1978.
Mayor - Edmondson stated that Nadine Walker is serving on the' Nominations
Committee and Don Hinman is serving on-the Resolutions Committee. It
was then MOVED by Beauchamp, seconded by Sparling that Council member's
Don Hinman Nadine- Walker- and Mayor Edmondson 'be designated as voting-' '
delegates for the AWC Convention: carried, Beauchamp, Edmondson, Hinman
and Sparling voting aye by voice vote. Walker and Wonder absent. It
was MOVED by Hinman, seconded by Beauchamp that Council• members' Henry
Beauchamp, Jack Sparling and Gordon Wonder be the alternatedelegates to
the AWC Convention: carried; Beauchamp; Edmondson, Hinman and Sparling
voting aye by voice vote. Walker and Wonder absent.
Council members next discussed the appointments to the Yakima Center
Advisory Commission, Mayor Edmondson 'stating that a letter has been
received from Greta Atwood, requesting to be considered for appointment
to the Center Advisory Commission. Also received, was a letter signed
by the Yakima Valley Visitors and Convention Bureau and the Chamber of
Commerce suggesting twelve persons who they have contacted about serving
on this Commission and who have indicated that if appointed they would
serve. After discussion, it was the general consensus of the Council
that the appointments to the Yakima Center Advisory Commission will be
on next Monday's agenda.
At 8:00 PM, the Council members moved into. the Council Chambers for the
balance of the meeting, Mayor Edmondson presiding, Council members
Beauchamp, Hinman, Sparling and Wonder, and City Manager Eastman and
Assistant City Attorney Vanek present on roll call. Council member
Walker absent. It was MOVED by Beauchamp, seconded by Hinman that
Council member Nadine Walker be excused from this meeting: carried,
Beauchamp, Edmondson, Hinman, Sparling and Wonder voting aye by voice
vote. Walker absent.
The Invocation was given by Council member Beauchamp.
Mayor Edmondson then referred to the items placed on the Consent Agenda
questioning whether there were any additions or deletions from either
Council members or citizens present. The City Clerk then read the
Consent Agenda. It was MOVED by Wonder, seconded by Hinman that the
Consent Agenda, as read, be passed: carried, Beauchamp, Edmondson,
Hinman, Sparling and Wonder voting aye on roll call. Walker absent.

*It was MOVED by Wonder, seconded by Hinman that the minutes of April 3,
1978, having been dulylcertified accurate by two Councilmen and no one
present wishing to have said minutes read publicly, be approved: carried,
Beauchamp, Edmondson, Hinman, Sparling and Wonder voting on roll call.
Walker absent.
This being the time fixed for the hearing on Petition No. 918, filed by
Thunderbird Motor Inn, requesting annexation of property, Councilman
Wonder questioned if they had met the conditions recommended by the
Planning Commission. Larry Wright, Principal Planner, explained that
the Thunderbird Motor Inn has three requests filed with the City; one
for annexation which is being heard now; one for rezoning property
presently within the City limits; and one requesting street vacation;
the latter two having been set for hearings next week. Mr. Wright did
state that the Thunderbird has agreed to the conditions set forth,
however, those conditions do not effect the annexation. He stated that
they are requesting that this property be annexed as a B -3 zoning.

There being no citizens' present to speak to this matter, it was MOVED by
Beauchamp, seconded by Wonder that Ordinance No. 2170, annexing said
property be passed: carried, Beauchamp, Edmondson, Hinman, Sparling and
Wonder voting aye on roll call. Walker absent.
ORDINANCE NO. 2170, AN ORDINANCE annexing property to the City of Yakima
and zoning said property.
Mayor Edmondson presented a letter of commendation to Steve Scott,
Yakima City Firefighter for action above and beyond that required when
he was fighting a fire at Pacific Fruit and Produce on March 10, 1978.
Mayor Edmondson reported that Firefighter Scott re- entered a burning
building to save a life of another Firefighter, Kim Jolley, carried him
to safety and administered mouth -to -mouth resuscitation.
Larry Robinson, representing the Apartment Owners Association, stated
that they are in agreement with Councilman Sparling's suggestion of
citizen committees being formed to consider legislation before it
reaches the enactment stage, and suggested various groups Council might
consider to serve on these committees. He further stated that in making
up these committees the members of the committees should be nominated by
the groups involved. He reported that the Apartment Owners Association
would like to see this plan implemented promptly.
Carol Darby, Director of Community Development, reporting on the River
Road Sanitary Sewer L.I.D. NO. 1011, stated that 66% of the current
assessed valuation . have signed outside utility ag- reements and. 9% of
estimated future assessed valuation have signed outside utility agree-
ments. According to the Auditor's Office it may be eighteen months to
two years before present construction is put on the Auditor's books.,
Councilman Hinman expressed concern about the possibility of a property
valuation being increased for those who have not signed an outside
utility, therefore, making the percentage below the 75 %. Ms. Darby
stated that staff investigated building permits in that area, and the
problem is unlikely. City Manager Eastman, after discussion, stated
that staff recommends that Council modify their percentage rule for
signed outside utilities for this project. He stated that if Council
approves the modification, staff will proceed with the awarding of the
bids for the contract. If it is not, the owners will be notified that
there is no project. After further discussion, it was MOVED, by Hinman,
seconded by Wonder to accept staff recommendations of a modification of
a 75% rule to include estimated future assessed valuation that has
already been constructed or is under construction: carried, Beauchamp,
Edmondson, Hinman, Sparling and Wonder voting aye on roll call. Walker
absent.
*Having received a staff report, it was MOVED by Wonder, seconded by
Hinman that the Outside Utility Agreement requested by Gene Mayer /Edwin
Partch for sewer and water service for property located at the northeast
corner of Castlevale Road and No 34th Avenue for a mobile home park and
seven duplexes, be approved: carried, Beauchamp, Edmondson, Hinman,
Sparling and Wonder voting aye on roll call. Walker absent.
*Having received a staff report, it was MOVED by Wonder, seconded by
Hinman that the Outside Utility Agreement requested by A.C. Berger for
sewer and water service for property located at the Northeast corner of
Castlevale Road and North 34th Avenue for a mobile home park, be approved:
carried, Beauchamp, Edmondson, Hinman, SparLift- and Wonder voting aye on
roll call. Walker absent.
Fire Chief Carroll briefly reviewed last week's discussion on the Uniform
Fire Code, 1976 edition, stating that the intent is to update the Uniform
Fire Code from 1973 to 1976 edition. He also stated that his staff
recommends adoption of Ordinances relating to an Alarm Signal Code,
National Electrical Code, 1978 edition, and fire hydrant installations.
Councilman Wonder requested that information on the new Codes be given
to Council in a study session. Bob Lewis, representing the Yakima
Valley Construction Federation, stated that they support the adoption of
the 1976 Edition, Uniform Fire Code, as written except for the Fire

Works clause. He also stated that they believe that the 101 emergency
lighting should not be considered at a later date as they feel it has
been discussed enough. They are in favor of the Electrical Code and if
Council is going to make some changes in the hydrant ordinance, they
recommend that the entire ordinance be reviewed. He stated that they
disagree with the alarm ordinance because it changes the Uniform Fire
Code. They believed that the administrative procedures should be to
have the Building Department have control over projects up to the time
the Certificate of Occupancy is issued and then give the Fire Department
jurisdiction. Clarence Marshall submitted a letter to Mayor Edmondson,
and spoke against the proposed Alarm Signal Code. It was MOVED by
Beauchamp, seconded by Hinman that Ordinance No. 2171, adopting the
Uniform Fire Code, 1976 Edition, be passed: carried, Beauchamp, Edmondson,
Hinman, Sparling and Wonder voting aye on roll call. Walker absent.
ORDINANCE NO. 2171, AN ORDINANCE relating to Fire Codes; adopting by
reference the Uniform Fire Code, 1976 Edition, copyright 1976 by the
International Conference of Building Officials and the Western Fire
Chiefs Association, and making deletions therefrom and events thereto;
and amending Section 10.05.010, 10.05.020, 10.05.025, and repealing
sections 10.06.065, all of the City of Yakima Municipal Code.
Council members next discussed the proposed rate increase for taxicab
fares. Al Kauzlarich, Yellow Cab Company, referring to the Taxicab Zone
Map, stated that Zone 6 does not encompass all of the City limits. He
suggested that Council authorize a 7th Zone rate. Council members
discussed this possibility and also the possibility of deleting the line
on 64th Avenue, which would then make Zone 6 from 56th Avenue to City
limits. Councilman Wonder stated that the proposed rate is too high and
suggested an amendment, which is:
For one passenger for the first 1/7 mile, or fraction thereof $1.00
Thereafter for each additional 1/7 mile, or fraction thereof _ .10
For each one minute of waiting time after the first three
minutes.. .15
And amend the Zone Map to include a Zone 7 which would be an
additional 8 blocks to the west of Zone 6, at a rate of 2.10
Councilman Wonder gave examples of a fare that would be charged, using
the present rate, his proposed amendment, and the proposed rate.
Discussion followed with George Kapellas, Diamond Cab Company, supporting
the proposed increase, but stating that the Zone rates are sufficient.
It was then MOVED by Wonder to amend the Ordinance to include his proposal,
as outlined. The motion died for lack of a second. Councilman Sparling
suggested that this be postponed for further study. It was then MOVED
by Beauchamp to amend the Ordinance so that the rate for each one
minute of waiting time after the first three minutes would be 15. The
motion died for lack of a second. It was MOVED by Wonder, seconded by
Sparling to table the Ordinance until next week so that staff can bring
an accurate comparison of rates in the other cities: Sparling and
Wonder voting aye on roll call. Beauchamp, Edmondson and Hinman voting
nay. Walker absent. Motion failed for want of a majority vote. It was
MOVED by Beauchamp, seconded by Hinman that Ordinance No. 2172 regulating
taxi cab fare rates be passed: carried Beauchamp, Edmondson and Hinman
voting aye on roll call. Sparling and Wonder voting nay. Walker
absent. It was MOVED by Hinman, seconded by Sparling that the West
line on Zone 6 be deleted to correct the taxicab Zone Rate Map: carried
Beauchamp, Edmondson, Hinman, Sparling and Wonder voting aye by voice
vote. Walker absent.
ORDINANCE NO. 2172, AN ORDINANCE relating to licenses and business
regulations regulating taxicab fare rates; establishing taxicab zone
rates and adopting a taxicab zone rate map; and amending Section 5.78.100
and Subsection 5.78.110 (b) of the Municipal Code.
Mayor Edmondson stated that a letter has been received from Yakima
Metropolitan Area Transportation Study (YMATS) requesting Council to
appoint two representatives for the City of Yakima to serve on a Citizens
Advisory Committee. Mayor Edmondson reported that she had spoken to
Janet Snodgrass about serving on this Committee and she indicated that
if appointed, she would be willing to serve. It was then MOVED by

Wonder, seconded by Beauchamp that Janet Snodgrass be appointed as
Council's representative on the YMATS Citizens Advisory Committee:
carried, Beauchamp, Edmondson, Hinman, Sparling and Wonder voting aye
by voice vote. Walker absent. Councilman Wonder suggested that some of
the people that were interested in serving on the Council could be
contacted to see if they would be willing to serve on this Committee,
and it was the general consensus that this be done.
There being no further business to come before the Council, it was MOVED
by Sparling, seconded by Hinman that this meeting be adjourned at the hour
of 10:50 PM: carried, Beaucham, - 'cmondson, Hinman, Sparing and
