HomeMy WebLinkAbout11/28/1977 Business Meeting � � �� �m� � NOVEMBER 28, 1977 The City Council met in session on this date at 1:30 PM at the Yakima Valley Regional Library. Council members present were Mayor Betty L. Edmondson, Jean Allard, Ralph Hu|brook' W. K. "Pete" Moore, Dr. Bill Simmons and Gordon Wonder. Council member Walker absent. Mayor Edmondson, referred to a November 15, 1977, letter received from Jeanne Welch, from the State Historic Preservation Office, reporting that that office has received our revised contract. Ms. Welch stated that the contract was so modified that it does not accurately represent the State Grant Program and is unacceptable. She stated that the grant remains available under the original conditions, specifically the City must agree to maintain the property in its restored condition for a period of 30 years, and all grant work must be concluded prior to June 30, 1979. Discussion followed with several Council members still expressing concern about having to commit future Councils to this agreement. It was the general consensus of the Council to have staff negotiate with the State Historical Preservation Office for a contract with acceptable language and also to ask what is the 30 year maintenance they want, and have this information by the 5th of December: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Wonder voting aye by voice vote. Walker absent. Council members discussed the letter dated November 28, 1977, from the Visitors & Convention Bureau offering to run the operation of the Yakima Trolleys. City Manager Eastman requested time to review this letter with Fred Andrews, City Attorney, and come back next week with his recommendation. Councilman Moore stated he believed that this is an excellent approach. He stated he is not against the trolleys, but opposed to having the citizens of Yakima saddled with the operation of the trolleys. It was the general consensus to postpone discussion on this matter for one week. City Manager Eastman stated that the 1975 State Audit has been receivod. He stated that the auditors are available to meet with Council in groups of three or less. Mayor Edmondson inquired if Council would like to have staff response to any of these items, and it was the general consensus of the Council to get a report from staff on the 1976 State Audit. In discussion of the 1978 Budget, City Manager Eastman reviewed the 1978 anticipated revenues and the 1977 actual expenditures. Asked how the gas tax variable issue would affect the budget, Art Zerbach, Director of Finance and Budget, stated that the funds which normally would have been received from the gas tax, were not included in the budget. Therefore, if the gas tax variable is retained, the street fund will gain approximately $12 and the arterial street fund will gain approximately $50,000 for a total net gain of $75 to $80 Walt Chappel, City Treasurer, briefly reviewed the estimated revenues for various city departments. Mayor Edmondson reminded Council members that there w| | | be a study session to discuss the '78 Budget on Thursday, December 1, 1977 at 2/00 PM to be held at the Yakima Valley Regional Library. It was MOVED by Holbrook, seconded by Moore to excuse Council member Nadine Walker from this meeting: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Wonder voting aye by voice vote. Walker absent. The Invocation was given by City Manager Eastman. Mayor Edmondson referred to the items placed oh the Consent Agenda questioning whether there were any additions or deletions from either Council members or citizens present. Mayor Edmondson requested that item #4 be removed from the Consent Agenda because the minutes had not been received. Councilman Wonder requested that item #8 be removed. It was the consensus of the Council that the deletions, as requested, be made. The City Clerk then read the Consent Agenda items, including Resolutions by title. It was MOVED by Simmons, seconded by Holbrook that the Consent Agenda, as read, be passed: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Wonder voting aye on roll call. Walker absent. This being the time fixed for the hearing on the rezone request filed by Craig Schultz for property located at So. 1st Avenue and Nob Hill Boulevard, Councilman Allard requested to be excused from discussion on this matter for the appearance of fairness. Walker absent. Betty Wheery, owner of property at 1024 Landon, and M. C. Goodell, 102 West Nob Hill Boulevard, spoke against the rezone of this property. Carl Riemcke, realtor, spoke in favor of the rezone, urging Council to approve the rezone. It was MOVED by Moore, seconded by Wonder that Ordinance No. 2130, rezoning property at So. 1st Avenue and Nob Hill Boulevard, as requested by Craig Schultz, be passed: carried, Edmondson, Ho|brook, Moore, Simmons and Wonder voting aye on roll call. Walker absent. Allard not voting due to conflict of interest. ORDINANCE NO. 2130, AN ORDINANCE rezoning property situated at the northeast corner of So. 1st Street and West Nob Hill Boulevard in the City of Yakima, Washington, from R-2, Two Family Zone, to Planned Development Zone. This being the time fixed for the hearing on establishing a municipal fire alarm service, Mayor Edmondson reported that she had received objections on this from Tom Hargis, Yakima Valley Apartment Uwner/s Association, and the Larson Company. Fire Chief Ed Carroll gave a brief history of the proposed ordinance. He stated that he had held several meetings with various organizations. He stated it is his belief that this early detection system will work to the benefit of the commercial industry by reducing losses by fire. The approximate cost of installing this system in a building is as follows: |2 a square foot for open construction, |O a square foot for semi-open construction, and 2O¢ a square foot for partition construction. The connection and inspection fee is $|OO. Chief Carroll gave several examples of fires that had smouldered a long time In which an early detection system would have saved money and possibly the building. He stated that he does not have a program that is totally cost effective, however, the insurance rates would be lower. He stated that the area affected would be Fire Zones | and 2, for commercial buildings with 7500 sq. ff, or more. Asked why they use the early detection system rather than require a sprinkler system, Chief Carroll stated that the sprinkler system is more costly -- o $|.00 to $1.25 a sq. ft. Councilman Wonder expressed concern regarding the section in the proposed ordinance re City involvement in the installation of a system and the monthly inspection. Chief Carroll stated that for insurance purposes, the system must be inspected monthly. Those speaking in opposition of establishing the fire alarm system were Joe Roberson, 1602 Lower Ahtanum Road; Jeff Enwr|Qhf, Preferred Property Management Division, representing Yakima Valley Apartment Association; Dick Smith, Attorney, representing Yakima Valley Apartment Association; Bob Lewis, 5306 Bitterroot Way, representing Yakima Valley Confederation; Richard Doudna, 3210 Home Drive, Architect; Jim Kaufman, representing Weeks, Buren, Thorner, and Dietzen, Attorneys; Gordon Spencer, 212 No. 3|sf Avenue, Secretary of the Board, |DOF Lodge; Neil Dickinsen, Fred S. James Insurance; Cecil Warriner, President, Yakima Valley Apartment Association; Larry Robinson, 501 So. 6th Avenue; Hank Weeher, Yakima Federal Savings and Loan; Ted Me||offe, Jr., 6408 West Lincoln; Elwood Miller, 2903 West Yakima Avenue; and Bill Buckley, Pacific Fruit and Produce. Some of the reasons for objections were: (1) savings on insurance not enough to justify expense; (2) object to Section 10.03.128 - Administrative Rules and Regulations; (3) the City should wait for outcome of state legislature; (4) disagree with mandatory oomp|iance; and using this for a revenue raising program. Bob Mansfield, Mansfield's TV and Alarms, spoke in favor of the concept of the fire alarm system. It was the general consensus of the Council to excuse Councilman Simmons from the balance of the meeting. Councilman Simmons absent after 5:30 PM. Chief Carroll stated that the Ordinance would effect about 5 or 6 apartment buildings. He also stated that in order for the ordinance to be amended, it would have to be done by Council. He stated that he would be remiss 645 ' NOVEMBER 28, 1977 - in suggesting a program that would not pay its way, and therefore, he felt the compliance of the system shou|d'be mandatory. After discussion, it was MOVED by Allard, seconded by Holbrook to table the ordinance until a study session after the first of the year can be scheduled to develop a strategy to get community representation to develop a new ordinance: carried, Allard, Edmondson, Holbrook, Moore and Wonder voting aye on roll call. Simmons and Walker absent. It was MOVED by Simmons, seconded by Holbrook that Resolution No. D- 3810, nufhbr|zing execution of an amendment to the collective bargaining agreement with the Yakima Police Patrolman's Association, be passed: carried, Allard, Edmondson, Holbrook, Moore, Simmons and Wonder voting aye on roll call. Walker absent. . . RESOLUTION NO, D-3810 A RESOLUTION authorizing the City Manager and City Clerk of the City of* Yakima to execute an "amendment to YPP8 Collective Bargaining Agreement". . IN/ Ruth Siler, 113 No. 4th Street, addressed the Council requesting them to reconsider her damage claim, which was denied. She stated her car was stolen from the Lor n Building Garage, and the loaner she got was also stolen the very net night. She stated that she believed that the City was negligent. ' John K|inge|e, a citizen inquired if the City has an ordinance pertaining to snow removal on sidewalks. On receiving an affirmative answer, he then questioned why the snow was not removed from the sidewalks around City Hall last Wednesday. City Manager Eastman stated that the City has a contract with a janitorial service, and that they were counseled on this ` matter. . - ' Councilman Wonder stated' he didn't understand how payment could be , approved on the boman|f concrete in the CBD, since it is cracking. City Monbgar Eastman reported that "Council On The Air" is scheduled for December 19 1977 at KYVE-TV. , City Manager Eastman reported that the bail schedule for parking violations is now $5.00 for the 411; offense, $15.00 for the 5th offense, and $25,00 for any subsequent offenses.
