The City Council met in session on this date at 7:00 P.M. in the Council
Chambers of City Hall, Yakima, Washington; Mayor Betty L. Edmondson pre-
siding, Council members Henry Beauchamp, Lynn Buchanan, Lynn Carmichael,
Shirley Doty and Don Hinman, and City Manager Zais and City Attorney
Andrews present on roll call.
The Invocation was given by Councilman Buchanan.
Mayor Edmondson referred to the items placed on the Consent Agenda
questioning whether there were any additions or deletions from either
Council members or citizens present. Council member Doty requested that
Item No. 32 be removed from the Consent Agenda. John Klingele, 1312
West Walnut, requested that Items No. 27 and 28, be added to the Consent
Agenda. It was the general consensus of the Council that the deletion
of Item No. 32 and the addition of Items No. 27 and 28, as requested, be
made. The Deputy City Clerk then read the Consent Agenda items, includ-
ing resolutions and ordinances by title. It was MOVED by Hinman, se-
conded by Carmichael, that the Consent Agenda, as read, be passed:

January 30, 1980 and the `February 5, 1980 meetings, having been duly
certified accurate by two Council members and no one present wishing to

This_being the.time)fixed for the hearing on the rezone request filed by
Gene P. Mayer for property located at 809 North Front Street, Mr. Pool,
owner of property at 815 North Front Street, questioned what the reason
is for the rezone. Larry Wright, Principal Planner, reported that that
property is the last residential property in that area. He stated that
off - street parking is needed in the same zone for the business. The
public portion of the hearing being closed, it was MOVED by Beauchamp,
seconded by Doty to'accept the Planning Commission's recommendation and
rezone the property .from R -3 •to -1: carried, Beauchamp, Buchanan,
Carmichael, Doty, Edmondson and Hinman voting aye vote.
Mayor Edmondson proclaimed the week of March 23 through 29 as "Phil
Mahre and Steve Mahre Week ". She also urged- the citizens to complete
the census forms completely and accurately.
Council member Doty expressed concern about the volume of material
coming to her in her packet, and made some suggestions for - reducing it.
Council member Buchanan suggested that it might be additional work for
the staff to decide what to duplicate. Mayor Edmondson suggested that
staff could put continued items in Council member's files in their

Mayor Edmondson announced that a certificate has been presented to the
Council from.-the Christmas'Fes Committee. She also distributed
certificates to the Police. Department.and Department from
the Christmas Festival Committee.
Council member_,Carmichael, Chairman of the Committee for Ap-
pointments to the Parks Recreation Commission, reported that appli-
cations were from Nick Hughes, Rod Sanchez, Robert Laird, Paul
Schafer, Stan Jr., and-Don McGuinness.: She reported that there
were two vacancies on the Commission and the Committee recommends that
Stan Lochrie, Jr., and Don McGuinness be appointed. ;It .was. MOVED by

Committee and make the appointments of Stan Lochrie, Jr., and, Don Mc-

Council member Doty, Chairman of the Council Committee for- Appointments
to the Human Relations Commission, reported that applications were
received from Rod Sanchez, Tony Trujillo, Bernal Baca, Dr. Stevenson,

Mike Parsons, Nick Hughes and Bonnie Phillips. She reported that the
Committee recommends the appointments of Bernal Baca for the term ex-
piring 5/31/82, and Bonnie Phillips for the term expiring 5/31/80. It
was MOVED by Carmichael, seconded by Hinman to accept the recommendation
of the Council Committee and appoint Bernel Baca to fill the vacancy
expiring 5/31/82 and Bonnie Phillips to fill the vacancy expiring
5/31/80, the Human Relations Commission: carried, Beauchamp, Bu-
chanan, Carmichael, Doty, Edmondson and Hinman voting aye by voice vote.
Mayor Edmondson, Chairman of the Council Committee for Appointments to
the Library Board reported that applications were received from Darlene
Lust, Virginia Gilbert, and Thomas Grahn. She reported that the Council
Committee recommends the appointment of Darlene Lust. It was MOVED by
Hinman, seconded by Buchanan to accept the recommendation of the Council
Committee and appoint Darlene Lust to the Yakima Valley Regional Library
Board: carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson and
Hinman voting aye by voice vote.
Mayor Edmondson reported that a letter of resignation has been received
from Jim Tonkin, resigning from the Airport Advisory Commission. She
suggested that Council might like to send a letter of regret and also
request appointment to the Commission by Yakima County. It was MOVED by
Hinman, seconded by Beauchamp to follow the Mayor's suggestions: car-
ried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson and Hinman voting
aye by voice vote.
Council members considered the Outside Utility Request filed by Mr. and
Mrs. Roche and Mr. and Mrs. Siegel for property in the vicinity of North
40th Avenue between Fruitvale Boulevard and River Road. Ed Swanson, 709
South 59th Avenue, stated he owns property to the west of that property
and spoke in favor of the Outside Utility Request. John Klingele, 1312
West Walnut, questioned if this item was referred to the Parks and
Recreation Commission. He also questioned if the business would allow
parking on their premises after business hours. Larry Wright, Principal
Planner, stated that the property is not adjacent to the Park. He
stated that the recommendation of the Planning Commission regarded the
traffic problems and improvements that were going to be required from
the developer prior to his being able to develop this type of use. Mr.
Wright outlined the proposed shopping center, stating that this proposal
is just a concept of what would be developed. The Planning Commission
has requested that they be involved in a final review of the proposal.
Jim Siegel, developer, displayed a site plan and described the proposed
shopping center. He stated that staff analyzed the proposal and found
the area to be compatible for a shopping center if the traffic can be
handled. The County did not require any additional work for traffic,
however, the City is requesting additional access. He requested that
the request be approved subject to all the conditions and if we can't
make any of these conditions, then we don't have approval. He requested
that the final plan be brought to staff for approval, rather than the
Planning Commission. He also requested that the requirement for side-
walks be waived. He stated that there aren't any sidewalks in the area
now and he would be willing to install them once sidewalks are in the
area. He stated that if that requirement is waived, it will help them
be able to afford the other requirements initially. Mr. Wright stated

that the Planning Commission was concerned with the drive-in facility.
He stated that the Planning Commission expressed a desire for an infor-
mal hearing, without getting into full review. Mayor Edmondson pointed
out that the Planning Commission made a definite motion that they be
provided with a detailed site plan before the connection is allowed.
Mr. Wright stated that even if staff makes a review of the site plan,
they would still have the Planning Commission see it. He stated that he
would not want the responsibility of approving any major changes from
the preliminary site plan. Following discussion, it was MOVED by Beau-
champ, seconded by Hinman to grant the go ahead for the development of
this project provided the developer conforms to the appropriate City
codes and conditions which have been described here tonight and imposed
and that the sidewalk issue be delayed until a time that the City so
requests and the staff will do the final site plan review: carried,

by voice vote.

Mayor Edmondson reported that she has received a letter from Les McNary,
Yakima Center, stating that he is in concurrence that the left hand turn
at 9th Street and Yakima Avenue is needed. It was MOVED by Beauchamp,
seconded by Hinman to approve this recommendation with the condition of
parking provisions, and proceed with the project. Jetsen Cheshire,
owner- of property on the south side of Yakima Avenue stated that the
left hand turn Will not solve the traffic problem at that intersection

and recommended a traffic light be installed. Ted Roy, representing
Mr. Durbin and Mr. Coty, property owners in that area, objected to the
loss of the parking on the south side of Yakima Avenue. He stated that
the north side could be widened to the west to gain the property for the
left hand turn lane. He stated his clients do not feel it is fair to
give up their parking after they have already given up their two-way
traffic pattern on their street. He stated that the sidewalk in front
of the Holiday Inn doesn't go anywhere and could be utilized. Dennis
Covell, City Engineer, stated that from 9th Street towards the freeway,
the access is controlled by the State. The State will not agree to
provide a left hand channelization lane. He stated that a lot of the
businesses have parking in the rear or parking capability. He recom-
mended going with the left hand turn lane to see how it would work. It
was MOVED by Hinman, seconded by Carmichael that we table this until
staff comes back, and ask staff to come back with a report considering
Mr. Roy's request considering taking space from the north side of the

Regarding the report from the Director of Parks and Recreation on the
off-season maintenance of parks, it was MOVED by Hinman, seconded by
Beauchamp to accept the report that was filed in the Council packet and
have no further discussion: carried, Beauchamp, Buchanan, Carmichael,
Doty, Edmondson and Hinman voting aye by voice vote.
Referring to the report regarding 1979 Year End Expenditures/Revenues,
Final Fund Balances, Art Zerbach, Director of Finance and Budget, re-
viewed the exhibits. He recommended that $30,000 of the $47,006 unan-
ticipated balance in the Street Fund be used in the purchase of snow
removal equipment rather than use FRS funds as previously authorized.
He recommended that the balance remain in the Street Fund because it is
going to take $17,000 to keep the Sealcoat Program on its 7 year cycle.
He also recommended that $31,674 should be transferred from the unan-
ticipated balance within the General Fund to the Parks and Recreation
Fund, to cover shortages of funds not collected for Sales Tax. He
reported that the total reserve is a little over 4% of our general
expenditures. He recommended that some of this money be reserved in
case revenues do not come in as estimated. It was MOVED by Buchanan,
seconded by Carmichael to approve the report and recommendations as
presented by staff re General Government Fund Balance: carried, Beau-
champ, Buchanan, Carmichael, Doty, Edmondson and Hinman voting aye by
voice vote.
Council members discussed the funding alternatives regarding the award
of the YPPA arbitration. Councilman Buchanan stated he would like to
postpone the filling of the two Police positions for right now. Mike
Welton, representing the Police Patrolmen's Association, urged Council
to use Contingency Funds to pay for this and not delay in hiring any new
Police Officers or eliminate one position. He spoke about the shortages
of Officers and the need for overtime to cover when an Officer is sick
or off work for other reasons. It was MOVED by Hinman, seconded by
Carmichael to make the special appropriation so the two additional
Police Officers can be hired right away and the money be allocated from
the Contingency Fund to make up the difference on the award: carried,

viding for the method of payment thereof, and creating a special fund,"
passed by the City Council on April 2, 1979.

ORDINANCE NO. 2386, AN ORDINANCE fixing the time of delinquency of
installments and assessments levied for the payment of the cost of the
improvements in Local Improvement District No. 1023, and providing for
the. issuance of Local Improvement District Installment Notes for the
payment of the unpaid portion thereof.
Mayor Edmondson stated that there was a hearing on the final assessment
roll of L.I.D. No. 1028, and Council closed the, hearing but continued
the item for•additional information. She also reported that Mr•. Rosen -
kranz•has been out of the.country, and -would like to speak to this issue.
She stated that Council has received copies of the letter Mr. Rosenkranz
delivered to the City Clerk's Office. Dennis Covell, City Engineer,
stated that there were some unanswered questions. about the L.I.D. One
was asked questioning if there is adequate right -of -way to build a
sidewalk on the west side of the street. Mr. Covell reported that there
is, however, there will have to be modifications made to accommodate one
section by moving out a telephone pedestal and reshaping of the corner.
The second question was why the street was stopped about 10 feet short
of the Rosenkranz property. He reported. that the north end, the road
was extended within two feet of the right of way to accommodate existing
driveways and if that was not necessary that side would have been cut
off at 10 feet also. He stated that because of the money market he
understands •that, the Glascam project had slowed down. Mr. Rosenkranz,
106 North 45th Avenue, stated that he would like to see that sidewalk
installed to keep the people out of his orchard. He ,objected to being
assessed on all of this property, stating that he should only be asses-
sed on the 24 that abutts on the north side and 24 foot that abutts
on the street on the south side.. .Mr.. Covell stated that Mr. Rosenkranz
enjoys .double access•to his property.. Chris Perks, Office Engineer,
gave some history on the district, stating that, Mr. Rosenkranz's pro-
perty is not different from other property owners in the City that have
short frontage,on cul -de -sacs and•pays the same assessment as the other
properties. It was MOVED by Beauchamp, 'seconded by Carmichael that
Ordinance No. .2387, confirming the .final assessment roll for L.I.D. No.
1028; 46th Avenue Paving District, be passed: carried, Beauchamp,

ORDINANCE NO. 2387, AN ORDINANCE confirming the assessment roll covering
Local Improvement District No. 1028, as created. and established by
Ordinance No. 2293, of the ordinances of the City of Yakima.
An Ordinance amending the 1980 Budget and. appropriating various - amounts
of money for unpaid purchase orders encumbered in 1979, having been read
by title only previously, it was-MOVED by Hinman, seconded,by Doty that
Ordinance No. 2388, amending the 1980 budget and appropriating various
amounts of money for unpaid purchase. orders encumbered in 1979, be
passed. Art Zerbach, Director of Finance and Budget, responded to a

question asked previously, stating that the item marked "cancelled"
should have read "storm windows". He stated that the appropriation for
these items terminate at the end of the appropriate year and could not
pay them until the bills have been received. The question was called

ORDINANCE NO. 2388, AN ORDINANCE amending the 1980 budget for the City
of Yakima; and appropriating various amounts of money to various ac-
counts all as appropriations for the 1980 City of Yakima budget.

the 1980 budget appropriating and. transferring money to provide payment
of- arbitration expenses, having been read by title only at this meeting,

changing the name of the Bicentennial Pavilion Construction Fund; and

roll call.
ORDINANCE NO. 2389, AN ORDINANCE relating to funds and accounts; chang-
ing the name of the Bicentennial Pavilion Construction Fund to the
Capital Improvement Fund for Convention Center and Performing Arts
Center Facilities; designating sources of funds therefore, regulating
expenditures therefrom; creating the Capitol Theatre Operating Fund;
designating sources of revenue therefore, and regulating the expendi-
tures therefrom; and amending Sections 3.93.040, 3.98.010, 3.98.020, and
3.98.030, and enacting Section 3.98.040 as anew section, all of the
City of Yakima Municipal Code.

designating purposes for expenditures from the Tourist Promotion Fund,
be passed: carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson
and Hinman voting aye on roll call.
ORDINANCE NO. 2390, AN ORDINANCE relating to funds and accounts; desig-
nating purposes for expenditures from the Tourist Promotion Fund; and
amending Section 3.94.020 of the City of Yakima Municipal Code.
An ordinance amending the 1980 budget, appropriating and transferring
money related to the Capitol Theatre funds, having been read by title
only at this meeting, was laid on the table for two weeks or until
Tuesday, April 8, 1980.

accepting the recommendation of the Planning Commission and rezoning

ORDINANCE NO. 2391, AN ORDINANCE accepting the recommendation of the
Planning Commission and rezoning property in the vicinity of South 18th
Avenue and Greenway in the City of Yakima, Washington, from R-2 Two-Fam-
ily Zone to Planned Development Zone.

accepting the recommendation of the Planning Commission and rezoning
property at 902 South 36th Avenue, as requested by Ron Knight, be

ORDINANCE NO. 2392,, AN ORDINANCE accepting the recommendation of the
Planning Commission and rezoning property at 902 South 36th Avenue in
the City of Yakima, Washington, from R -2 Two- Family Zone, to Planned
Development Zone.
Referring to the proposed ordinance adopting a schedule of filing fees
for various City zoning and other land use and development functions,
Council member Doty expressed concern that the City should retain as
many options as they can. She stated that the negotiations have not
progressed regarding the Fairview -Sumac Sewer Project, and perhaps the
City may need something to bring into negotiations. Councilman Hinman
suggested that if a lot of residents sign up at once, the City may be
able to lower their connection charge. Councilman Hinman expressed
concern about having a $50.00 fee charged over a 10 year period. It was
MOVED by Buchanan, seconded by Beauchamp that the Ordinance . adopting a
schedule of filing fees for various City zoning and other land use
development functions, be passed. Following discussion, it was MOVED by
Beauchamp, seconded by Doty to table this ordinance until we get a
further feeling on when we ought to pass it, based on the feelings of
the residents: carried, Beauchamp, Carmichael, Doty, and Hinman voting
aye by voice vote. Buchanan and Edmondson voting nay. Councilman
Hinman requested staff to contact the County for a status report.
Mayor Edmondson ,reported that an answer has been received from Hughes
Airwest in response to the objections of the City and Chamber of Com-
merce regarding the termination of air service, indicating they do not
agree with us and giving us 60 days notice of suspension of service,
effective May 1, 1980.
Items of information supplied to Council were: letter to Dr. Bernadina
Denning, re City of Yakima's 1979 Annual Hiring and Promotion Report;
news release re 1980 Spring Clean -Up, April 1 through April 30, 1980;
brochure on Spring 1980 Policy- Development Workshop Series; letter of
resignation from James E. Tonkin from Yakima Airport Advisory Committee,
3/18/80; letter from President of Yakima Greater Chamber of Commerce in
response to Hughes Airwest Corporation 60 day notice to suspend service,
3/13/80; memo from Chief LaRue re Juvenile Crime /Training, 3/17/80;
Monthly Report for Chief of Police of February, 1980; minutes of the
March 19, 1980, Yakima Center Advisory Commission.
There being no further business to come before the Council, it was MOVED
by Buchanan, seconded by Hinman that this meeting be adjourned at the
hour of 10:15 P.M.: carried, Beauchamp, Buchanan, Carmichael, Doty,
Edmondson and Hinman voting aye by voice vote.
