HomeMy WebLinkAbout01/29/1980 Business Meeting JANUARY 29, 1980 435 The City Council met in session on this date,at 2:00 P.M. in the Robert- son Roam at the Capitol Theatre, 19 South 3rd Street, Yakima, Washing- ton. Council members present were Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan, Lynn Carmichael, Shirley Doty, Don Hinman and Frank Roberts. Tom Tomlinson', Executive Manager of the Capitol Theatre, conducted a tour of the Theatre. Former Council members Nadine Lee and Gordon Wonder, being unable to at- tend this session, it was the general consensus of the Council to con- tinue the resolutions of commendation to another session. It was MOVED-by Buchanan, seconded by Carmichael that the minutes of November 27, 1979, and December 4, 1979 meetings, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly, be approved: carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson, Hinman and Roberts voting aye by voice vote. Frank Bradley, Capitol Theatre corporation, introduced Walter Lewis, Treasurer, Tom Tomlinson, Executive Manager and Steve Mosier, President Elect. He stated that the Capitol Theatre Corporation was formed in 1974 to advise the City Council on how to use the Capitol Theatre. He stated it is their intent to be a self-sustaining organization. Tom 1 Tomlinson reviewed the material that was provided the Council in their packets. He stated the report deals with expenses of operating the •building and he sees no real areas in terms of cost saving on the ex- pense side. iHe also stated that they are developing an increased long- range public relations program. Walt Lewis reviewed the balance sheet as-of December 31, 1979, which shows a net worth- of $21,000 and a defi- cit for the current year of $19,725. Mr. Tomlinson reviewed the state- ment of income. He stated the income is accounted under four sources, patron or sponsor income; service income/rental; box office; and conces- sion area. He referred to several charts, one of which. compared the Capitol Theatre with other theatre auditoriums. He stated that they hope the expanded public relations program will increase the use of the building. Mr. Lewis stated that they have actively pursued events to maximize the use of the building. He stated that he, is requesting the City Council and County Commissioners to make a grant of $35,000 to the CapitoliTheatre Corporation;. requesting the City grant $20,000 and the County $15,000. Mr. Mosier stated that $35,000 is needed in the first quarter as there is no operating cash available. Following further discussion about the operation of the Theatre, it was MOVED by Roberts, seconded by Carmichael to follow the recommendation that Council ask staff to dig into the budget and come up with some response to this request and let staff determine where the money can come from. Mayor Edmondson stated she would like staff to research if Room Tax monies can be used for this as a primary source and also look at other sources. City Manager Zais stated that this action will require an amendment to the agreement with the Capitol Theatre Corporation as the CTC is respon- sible for all costs of administration. The question was called for the vote on the motion: carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson, Hinman and Roberts voting aye by voice vote. Fred Andrews, City Attorney, reviewed the City Charter with the Council and referred to a pamphlet distributed by AWC called "Keeping Out of Trouble". He reviewed the limits the Council has on lobbying activi- ties; public disclosure laws; open public meeting laws, reviewed the reasons Council may go into Executive Session; appearance of fairness, conflict of interest, and incompatibility of office, citing several instances where the court has overruled City legislation because of violation of appearance of fairness. He stated that Council has to be careful with (1) prejudgment; (2) partiality for a person involved; and (3) precuniary interest. He stated that the appearance of fairness and conflict of interest applies only to quasi-judicial hearings, i.e. rezones and personnel matters. It was the general consensus of the Council to continue the review of administrative/operational functions of the Finance Department for one week. • 436 JANUARY 29, 1980 Mayor Edmondson stated that the Human Relations Commission has made a proposal for the method of appointing members to fill vacancies on their Commission. Councilman Buchanan stated that Council has a procedure for making these appointments and it should be the same for all commissions and boards. City Manager Zais suggested that the Human Relations Com- mission be informed that Council has a procedure for appointments in mind and wishes to keep it consistent for every board and Commission. It was the general consensus of the Council to follow the suggestion of City Manager and put the discussion of the method of appointments on the agenda for next week. Councilman Roberts requested a report of some kind on the activities of the Fire Department on their activities under their new setup, stating he would like to know how they are getting along. He also requested information on how many houses the City owns and who lives in them. It was the general consensus of the Council to get a report on the City owned houses. Councilman Beauchamp questioned the method used for snow removal, stat- ing that Lincoln Avenue just west of 40th was not done properly in his opinion. City Manager Zais stated that a normal year of maintenance was anticipated, and so far it has been abnormal. Councilman Roberts stated that Del Kary, Street and Refuse Manager, has stated he was going to do a study on that. It was MOVED by Buchanan, seconded by Beauchamp to move into Executive Session for the purpose of discussing negotiations and the prospective sale of City property: carried, Beauchamp, Buchanan, Carmichael, Doty, Edmondson, Hinman and Roberts voting aye by voice vote. Items of information supplied to Council were: Yakima Center Advisory Commission minutes of January 16, 1980; monthly report of Chief of Police for December, 1979; Parks and Recreation Commission meeting agenda for January 29, 1980; Association of Washington Cities Legisla- tive Bulletin No. 2, 1/18/80; AWC - Washington Local Government Funding Report re Public Transportation Planning Grants available, 1/17/80; and Washington State Research Council Report, 1/1/80. There being no further business to come before the Council, the meeting was adjourned at the hour of 7:15 P.M. to then meet with the Yakima County Commissioners at the Yakima County Courthouse on January 30, 1980, at 2:00 P.M.
