HomeMy WebLinkAbout11/27/1978 Business Meeting 138 NOVEMBER 27, 1978 The City Council met in session on this date at 2:45 PM in the Council Chambers of City Hall, Yakima, Washington. Council members present were Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan and Nadine Lee. Council members Don Hinman, Jack Sparling and Gordon Wonder absent and excused. City Attorney Andrews reported that the exchange of property between the City and Seattle First National Bank has been completed, referring to the City's annex on Second Street for Seattle First property at "B" and 3rd Streets. At 3:00 PM, the Council members commenced the regular meeting, Mayor Edmondson presiding, Council members Beauchamp, Buchanan and Lee, Acting City Manager Zais and City Attorney Andrews present on roll call. Council members Hinman, Sparling and Wonder absent. It was MOVED by Lee, seconded by Beauchamp to excuse ,Council members Don Hinman, Jack Sparling and Gordon Wonder from this meeting because they are out of town: carried, Beauchamp, Buchanan, Edmondson and-Lee voting aye by voice vote. Hinman, Sparling and Wonder absent. The Invocation was given by Mayor Edmondson. Mayor Edmondsonreferred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from either Council members or citizens present. The City Clerk then read the Consent Agenda items, including resolutions, by title. It was MOVED by Lee, seconded by Buchanan that the Consent Agenda, as read, be passed: carried, Beauchamp, Buchanan, Edmondson and Lee voting aye on roll call. Hinman, Sparling and Wonder absent. (Subsequent paragraphs preceded by an asterisk (*) indicate items on the. Consent Agenda to be handled under one motion without further discussion.) , This being the time fixed for the hearing on Petition No. 931, filed by Warren Ahnell, requesting annexation of property situated at No. 17th Avenue and Lincoln Avenue, and no one present wishing to speak to this matter, it was MOVED by Beauchamp, seconded by Lee that Ordinance No. 2232, annexing said property, be passed. The requirement of the fire hydrant having been discussed at the 11/6/78 meeting, Council member Lee inquired if it had been included in this Ordinance. Acting City Manager Zais reported that it is not in this Ordinance. The question was called for the vote on the motion: carried, Buchanan, Edmondson, Lee and Beauchamp voting aye on roll call. Hinman, Sparling and Wonder absent. ORDINANCE NO. 2232, AN ORDINANCE annexing property to the City of Yakima and zoning said property. Loretta G. Steele, 1007 So. Naches Avenue, addressed the Council with her concern over her high water bill she had received for the past four months. She recited her investigation into the matter and stated that except for a few leaks, which she fixed after the first high bill, nothing could be found to be the cause of the excessive flow of water. Acting City Manager Zais reported that staff had been apprised of this problem and a letter had been drafted to be sent to Mrs. Steele. Walt Feser, Customer Service Manager, reported that a serviceman had checked for leaks and bad reads and was unable to pick anything up which would have caused the high bill. He stated that the meter had been checked and was found to be in the acceptable range. He reported that except for the two high bills, Mrs. Steele's bills in the past 1 1/2 years have been at the minimum amount of $13.70. Councilman Beauchamp inquired about what recourse the Council has to help Mrs. Steele. City Attorney Andrews stated that Council has the authority to compromise a disputed claim and settle it. However, the City cannot forgive the bill as it would be considered a gift of public funds. Following discussion, it was MOVED by Lee, seconded by Beauchamp to adjust Mrs. Steele's bill of $41.20 down to her normal bill, which would be $13.70: carried, Beauchamp, Buchanan, Edmondson and Lee voting aye by voice vote. Hinman, Sparling and Wonder absent. Art Zerbach, Director of Finance & Budget, stated that Mrs. Steele should be aware that she will have to sign a compromise agreement to cover us with the State Auditor, to which she agreed. 139 NOVEMBER 27, 1978 Dolores Goodman, 1002 So. 6th Street, stated that Mrs. Steele's problem is an example why.the HumanRelations Officer is needed, stating that this problem probably could have been resolved by that office. Mayor Edmondson stated that the Council would like to meet with the Human Relations Commission whenever they can. It was MOVED by Lee, seconded by. Buchanan that Resolution No. D-3994, authorizing payment of $75.49 to Mrs. Edward Boettcher in settlement of a damage claim when the City sewer backed up causing flooding in her basement, be passed: carried, Beauchamp, Buchanan, Edmondson and Lee voting aye on roll call. Hinman, Sparling and Wonder absent. RESOLUTION NO. D-3994, A RESOLUTION authorizing the payment of $75.49 to Mrs. Edward Boettcher in settlement of a claim for damages filed with the City of Yakima. *It was MOVED by Lee, seconded by Buchanan that Resolution No. D-3995, denying payment of a damage claim filed by James E. Bolian, Jr., for damage of a door at 2616 Powerhouse Road, Apt. B, as a result of a forced entry by the Yakima Police Department, be passed: carried, Beauchamp, Buchanan, Edmondson and Lee voting aye by voice vote. Hinman, Sparling and Wonder absent. RESOLUTION NO. D-3995, A RESOLUTION denying the claim of James. E. Bolian, Jr., filed with the City of Yakima on October 31, 1978. Police Chief Jack LaRue, referred to his memo of October 26, 1978, regarding the bicycle licensing program and explained his reason for wishing to delete that program. The expense of the program was one of the reasons given. It costs the City $2.61 to license each bicycle and the City collects a 50 fee for the one-time license. Sgt. Orr, Traffic Safety and Bicycle Office reported that 9 times out of 10 the bike no longer belongs to the licensee. Carol Darby, Director of Community Development, reported that staff has been working on a bicycle path plan and those on the Committee want a more enforceable bike licensing program. Council member Lee suggested a publicity campaign to let people know how to have their bike properly identified. It was then MOVED by Lee, seconded by Beauchamp to have the proper legislation prepared to delete the bicycle licensing program, as recommended by Chief LaRue: carried, Beauchamp, Buchanan, Edmondson and Lee voting aye by voice vote. Hinman, Sparling and Wonder absent. Gini Heintzman, Director of the Yakima Valley Transportation Exchange, referred to her letter dated November 12, 1978, and corrected an error in the percentage of trips in City transportation, which should be 56% and not 96%, as typed. She requested that the City should include in their UMTA application, a 5% application for funds for Yakima Valley Transportation Exchange. She further requested to be placed on the December 11, 1978 Council agenda to give further information after she has the opportunity to meet with staff. She submitted copies of the budget and program she is proposing. Acting City Manager Zais stated that in the UMTA grant submission, the City did include a sub-application for the 5% for this purpose. Bob Knight, Transit Manager, confirmed that. Following discussion, it was MOVED by Lee, seconded by Buchanan to accept Mrs. Heintzman's letter of November 12, 1978 and discuss this further on December 11, 1978 after she has met with City staff: carried, Beauchamp, Buchanan, Edmondson and Lee voting aye by voice vote. Hinman, Sparling and Wonder absent. Acting City Manager Dick Zais reported that a Resolution appointing Cloe Garrison to serve on the Yakima Valley Regional Library Board of Trustees, filling the vacancy of William Southeet; which expires the end of December, 1980, has been received from Yakima County. He stated that it is a County appointment, but needs to be confirmed by the City Council. It was MOVED by Beauchamp, seconded by Buchanan to confirm the County Commissioners' appointment of Cloe Garrison to serve on the Yakima Valley Regional Library Board of Trustees: carried, Beauchamp, Buchanan, Edmondson and Lee voting aye by voice vote. Hinman, Sparling and Wonder absent. Councilman Beauchamp requested a list of members serving on Boards and Commissions. 140 NOVEMBER 27, 1978 Acting City Manager Zais reported on the AFSCME negotiations, stating that the Union Negotiating Committee had indicated they wish to consider, this further before they take it to the Union members. Items of information supplied to the Council were: copy of information form submitted by Central Washington Comprehensive Mental Health re FRS requests; report on interfund loan 10/31/78; memo on business license issuance - new procedures 11/21/78; memo re real estate contract - old fire station #1 11/21/78; memo re 1978 weedy lot abatement 11/20/78; monthly report of the Chief of Police for October, 1978; and invitation to attend City Employees' Christmas Party. There being no further business to come before the Council, it was MOVED by Lee, seconded by Beauchamp that this meeting be adjourned at the hour of 4:10 PM: carried, Beauchamp, Buchanan, Edmondson, and Lee voting aye by voice vote.
