HomeMy WebLinkAbout09/05/1978 Business Meeting 77 SEPTEMBER 5, 1978 The City Council met in session on this date at 1:30 PM in the Council Chambers of City Hall, Yakima, Washington. Council members present were Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan, Don Hinman, Nadine Lee, Jack Sparling and Gordon Wonder. Mayor Edmondson announced that Dick Anderwald had called and postponed the joint meeting with the Yakima County Commissioners which was scheduled for September 7, 1978. Councilman Sparling reported there is a traffic flow problem. at 2nd II/ Street and Yakima Avenue created by allowing left hand turns at that intersection. Council member Lee agreed, stating that she had brought this up for discussion several times in the past. City Manager Eastman stated that he would refer this matter to staff for a report. It was MOVED by Lee, seconded by Wonder to move into Executive Session to discuss personnel: carried, Beauchamp, Buchanan, Edmondson, Hinman, Lee,. Sparling and Wonder voting aye by voice vote. Mayor Edmondson announced that only Council members will participate in the Executive Session. At 3:20 PM, the Council members commenced the regular meeting, Mayor Edmondson presiding, Council members Beauchamp, Hinman, and Lee and Assistant City Manager Zais and City Attorney Andrews present on roll call. Mayor Edmondson announced that Councilman Wonder had asked to be excused from the meeting due to illness, however, neither Councilman Buchanan or Sparling had given her reasons for their absence from this meeting-. The City Clerk then read the Consent Agenda items including a Resolution and amiGrdinance by title. This being the time.fixed for the hearing on,Petition_No. 922,,filed Sammar, Inc., requesting annexation of property in the vicinity of 1205- 1207 No. 2nd Street,%Larry Wright, Principal,Planner, outlined the area on the map, explaining that the total area to be developed for 26 units under Section 8 Housing Assistance is seven lots, including the two lots involved in this annexation. There being no citizen present to speak to this matter, it was,MOVED by Lee,seconded by Hinman,that Ordinance No. 2205, annexing and zoning said property, be passed: carried, Edmondson, Hinman, Lee and Beauchamp, voting aye: on roll call. Buchanan, Sperling_ and Wonder absent. ORDINANCE NO. 2205, AN ORDINANCE annexing property to the City of Yakima and zoning: said- property.' - - .P Carol Darby, Director of Community stated that the Council Committee.:(consisting-of Mayor Edmondsomband.2.Counci1:members Sparling and Wonder) had reviewed the five cable TV proposals. She stated they felt they neecImoretime to do-amorepthoroueLanalysis and to(lobtain background information-before giving,arecommendation. :Shealso..stated that tomorrow the Committee will meet with the five companies. and staff should have a recommendation available-no-later than the - 18th. Councilman Beauchamp,stated that-it important.,to. know_as:much as we_can.on each proposal- in order-to choose-the-best one for.the SEPTEMBER 5, 1978 ,Carol Darby, Director of Community Development, stated that there will be a meeting at Desoto Aircraft on Wednesday with the area residents to discuss the intention to create a Local Improvement District for installation of domestic water mains for property in the Airport Industrial Park. She stated that staff will bring a recommendation back to Council next week. *It was MOVED by Lee, seconded by Hinman that Resolution No. D -3958, authorizing abatement of fire hazards on private property, be passed: carried, Beauchamp, Edmondson, Hinman and Lee voting aye on roll call. Buchanan, Sparling and Wonder absent. RESOLUTION NO. D -3958, A RESOLUTION requiring the abatement of fire hazards on certain property; directing notice to property owners to abate such hazards and, in the alternative, authorizing abatement by the Fire Marshal. *It was MOVED by Lee, seconded by Hinman that Resolution No. D -3959, creating a petty cash fund for the Convention Center and Senior Citizen Center, and amending Resolution No. D -3080, re existing petty cash and change funds, be passed: carried, Beauchamp, Edmondson, Hinman and Lee voting aye on roll call. Buchanan, Sparling and Wonder absent. RESOLUTION NO. D -3959, A RESOLUTION amending Resolution No. D -3080, adopted February 19, 1974, and authorizing the existance of a City Treasurer's Change Fund, and other petty cash funds, within the General Fund of the City of Yakima. Dick Hilligus, Director of Parks & Recreation, reviewed his memo of August 30, 1978, regarding the proposed September pool schedule. He stated that the members of the Park Commission have been polled by phone and they approve of this schedule. It was the general consensus of the Council to approve the September pool schedule. Councilman Beauchamp requested a report on the 10C swim program. Mr. Hilligus stated that he is waiting for a report on that, but it appears that there has not been a great impact on the attendance. He stated that there have been a few more swimmers at Washington and Miller Pools. *It was MOVED by Lee, seconded by Hinman that the report of the City Engineer dated August 22, 1978, with respect to the completion of the work on Public Works Contract - Naches /Yakima Avenue Intersection Improvement performed by Yakima Asphalt Paving 'Company._be approved, the work be accepted and payment of the final estimate;'., as therein set forth is hereby authorized: carried, Beauchamp, Edmondson, Hinman and Lee voting aye on roll call. Buchanan, Sparling and Wonder absent. *It was MOVED by Lee, seconded by Hinman that Ordinance No. 2206, adopting and amending the classification plan and compensation plan for City employees, to include the new position of Water Service Representative III, be passed: carried, Beauchamp, Edmondson, Hinman and Lee voting aye on roll call. Buchanan, Sparling and Wonder absent. ORDINANCE NO. 2206, AN ORDINANCE relating to City personnel; adopting a classification plan and a compensation plan for City employees; amending sections 2.20.100 and 2.20.110 of the City of Yakima Municipal Code. Fred Andrews, City Attorney, reviewed his memo to Police Chief Jack LaRue, dated August 25, 1978, regarding an amendment which would delete some language from Section 6.48.010 of the City of Yakima Municipal Code, which the Supreme Court has held to be invalid, relating to a requirement for persons to make a Police report in certain circumstances. He stated that the Court has found that it is not up to the citizens to determine whether the request made by a Police Officer is lawful or not. It was MOVED by Lee, seconded by Beauchamp that Ordinance No. 2207, relating to false reports to the police, be passed: carried, Hinman, Lee, Beauchamp and Edmondson voting aye on roll call. Buchanan, Sparling and Wonder absent. ORDINANCE NO. 2207, AN ORDINANCE relating to public safety and morals; amending Section 6.48.010 of the City of Yakima Municipal Code; and declaring an emergency. SEPTEMBER 5, 1978 Discussion followed on whether Council should move into Executive Session to discuss labor negotiations. Assistant City Manager Zais stated that he was to meet again this week with the Union and can postpone that meeting, so it would not pose a problem if this Executive Session is not held. It was the general consensus of the Council to postpone the Executive Session on labor negotiations if it does not present:a burden on staff. Councilman Beauchamp requested a report on how many City vehicles there are and how many employees are assigned vehicles. Assistant City Manager Zais stated that he recalls a report prepared in 1976 which he believes reports there are approximately 130 vehicles, at which time, 44 were going home on assigned use. T, stated that pursuant to that report, it was reduced to about 16 vehicles going home for_qmployees on "callback". He stated that he would provide Council with a copy of that report.
