The City Council met in session on this date at 1:30 P.M. in the
Council Chambers of City Hall, Yakima, Washington. Council, members
present were Acting Mayor Nadine Lee, Lynn Buchanan, Don Hinman,
Jack Spar ling and Gordon Wonder. Mayor Edmondson and Councilman
Henry Beauchamp absent and excused.
Acting Mayor Lee reported that anyone wishing to attend the AWC
Convention in Spokane on June 12 thru 15, should make their
reservations now. Councilman Wonder questioned if several Council
members should attend this convention in light of the tight budget.
Council members discussed controlling travel expenses and it was the
general consensus of the Council tO discuss this again when all Council
members are present.
Council members discussed the Fire Department Emergency Medical Aid
Responses, Councilman Spar ling questioning if it is feasible to send the
pumper on these calls and wouldn't the police get there faster. Ken
Groth, Battalion Chief, referring to his 2/1/79 report, stated that the
pumpers are already manned and supplied with basic life support
equipment. He stated that if a pursuit vehicle is going to be used,
they would have to all be supplied with the necessary equipment
because it would not be known where they would be located in the City
when a call came in. He stated that life saving equipment would still
have to remain the on pumper. Councilman Wonder inquired if the City
could charge for this service. Mr. Groth stated that that matter would
have to be referred to the Legal Department, however, the Washington
State Legislature just recently has allowed fire departments to charge
for ambulance service. We are not providing ambulance service, just
giving life supporting measures. Last year the Fire Department made
approximately 578 calls at an estimated cost of $1500. Councilman
Buchanan indicated that the citizens receiving this service pay for it
through their taxes. Council members discussed the cost of equipping
life supporting equipment on police cars and training the officers.
Larry Pryor, President, Yakima Emergency Services that operates
Yakima Ambulance, spoke in support of the Fire Department's response
to emergency calls. He stated that if the ambulance arrives on the
scene before the Fire Department then they notify them and the Fire
Department does not complete their run. He stated that he believes the
Fire Department is handling these calls the most economical way they
can. It would take more personnel to have them use a separate
vehicle. After stating that Council really doesn't have enough
information about the operation of the Fire Department, it was MOVED
by Wonder, seconded by Spar ling to appoint a Fire Department
Investigation Committee consisting of three Council members, Buchanan,
Hinman and Spar ling and three members of the Community: carried,
Hinman, Lee, Spar ling and Wonder voting aye by voice vote. Buchanan
voting nay. Beauchamp and Edmondson absent. It was the general
consensus of the Council that Jack Spar ling would Chair that committee
and any information or reports from staff regarding that matter should
be given to the Committee.
At 3:00 P.M., the Council members commenced the regular meeting,
Acting Mayor Nadine Lee presiding, Council members Buchanan,
Hinman, Spar ling and Wonder and City Manager Zais and City Attorney
Andrews present on roll call. It was MOVED by Wonder, seconded by
Spar ling that Mayor Edmondson and Council member Beauchamp be
excused from this meeting because they are out of town: carried,
Buchanan, Hinman, Lee, Spar ling and Wonder voting aye by voice vote.
Beauchamp and Edmondson absent.
The Invocation was given by Councilman Hinman.
Acting Mayor Lee referred to the items placed on the Consent Agenda
questioning whether there were any additions or deletions from either
Council members or citizens present. Acting Mayor Lee requested that
Item No. 10 be removed from the Consent Agenda. It was the general
consensus of the Council that the deletion of Item No. 10, as
requested, be made. The City Clerk then read the Consent Agenda
items, including Resolutions and Ordinances by title. It was MOVED by
Wonder, seconded by Spar ling that the Consent Agenda, as read, be
passed: carried, Buchanan, Hinman, Lee, Spar ling and Wonder voting
aye on roll call. Beauchamp and Edmondson absent. (Subsequent
paragraphs preceded by an asterisk (*) indicate items on the Consent
Agenda to be handled under one motion without further discussion.)

It was MOVED by Wonder, seconded by Spar ling that the minutes of
the January 29, 1979 meeting having been duly certified accurate by
two Council members and no one present wishing to have said minutes
read publicly, be approved: carried, Buchanan, Lee, Hinman,
Spar ling, and Wonder voting aye on roll call. Beauchamp and
Edmondson absent.
This being the time fixed for the hearing on the rezone of City-owned
property situated south of Nob Hill Boulevard between 32nd and 34th
Avenues, Councilman Wonder stated that the City is modifying the
existing zoning so it will have less impact on the neighborhood. There
being no citizens present wishing to speak to this matter, it was
MOVED by Wonder, seconded by Hinman that Ordinance No. 2263,
accepting the recommendation of the Planning Commission and rezoning
said property, be passed: carried, Hinman, Lee, Sparling, Wonder and
Buchanan voting aye on roll call. Beauchamp and Edmondson absent.
ORDINANCE NO. 2263, AN ORDINANCE accepting the recommendation of
the Planning Commission and rezoning said certain property situated
between 32nd and 34th Avenues south of Nob Hill Boulevard in the City
of Yakima, Washington, from B-2, Local Business Zone, to B-1,
Modified Business Zone.
Council members discussed the status of the Battered Women's Program
and the allocation of Community Development Funds. Carol Darby,
Director of Community Development, reported that the change in
administration of the Battered Women's Program has not changed the
status of the program. Ken Crawford, Chief of Housing and
Neighborhood Conservation, reviewed the HUD regulations which
concerned this project. He stated that no decision was made as to who
would hold the title - the City or the YWCA. HUD regulations permit
the property to be deeded to a non-profit organization, for a specific
project. The title should be restrictive so that if the property were
sold, then they would have to come to Council for approval and the
proceeds up to. $32,000 would be returned to the Community
Development Block Grant. Miss Darby expanded on this, referring to
the five restrictions listed in her memo, should the City deed the
property to the Y.W.C.A. She recommended deeding the property to
the Y.W.C.A. with the five restrictions, as follows, stating that this
would keep the City from getting into social programs:
A. Provide adequate maintenance of facility.
B. Pay all costs related to property taxes, insurance, and
assessments as required.
. C. Must maintain property for the Battered Women's Program.
Any changes to the Program must be approved by the Council
at a public hearing.
D. Property cannot be sold without consent, and approval of
Council. Proceeds up to $32,000 to be returned to the
Community Development Block Grant Fund.
E. Allow Y .W. C. A . to have mortgage on property not to exceed
$13,000 if approved by the mortgagee.
It was MOVED by Wonder, seconded by Hinman to accept the
recommendation of staff and proceed along the lines as outlined:
carried, Buchanan, Hinman, Lee, Sparling and Wonder voting aye by
voice vote. Beauchamp and Edmondson absent.
*It was MOVED by Wonder, seconded by Sparling that Resolution No.
D-4030, authorizing payment of $165.55 to David W. Moericke, in
settlement of a claim for damages when a water pipe broke at the
Larson Garage, flooding his place of business, be passed: carried,
Buchanan, Hinman, Lee, Sparling and Wonder voting aye on roll call.
Beauchamp and Edmondson absent.
RESOLUTION NO. D-4030, A RESOLUTION authorizing the payment of
$165.55 to David W. Moericke in settlement of a claim for damages filed
with the City of Yakima.
Acting Mayor Lee, referring to the damage claim submitted by Edward
Watten, inquired if it is made public that there is a basic charge for
water service whether the residence is occupied or not. City Attorney
Andrews stated that although the ordinance states that the charge for
water service is continued, even if the premises is not occupied, it is
the policy of the Customer Service Division that major reconstruction
will be considered the same as new construction and upon notification

by the owner, that basic charge will be discontinued until the premises
are occupied. It was MOVED by Hinman, seconded by Wonder that
Resolution No. D-4031, denying payment of a claim for damages
submitted by Edward Watten, for allegedly being overcharged for water
and sewer service and transit tax, be passed: carried, Lee, Spar ling,
Wonder, Buchanan and Hinman voting aye on roll call. Beauchamp and
Edmondson absent.
RESOLUTION NO. D-4031, A RESOLUTION denying the claim of Edward
Watten filed with the City of Yakima on January 23, 1979.
John Munzanreder, Equipment Maintenance Superintendent,' explained
the need for the equipment Maintenance management system services
with Mainstem Corporation. He reported that his staff gets behind on
their record keeping during the budget time, to get the necessary
information to the various departments. Willis White, Public Works
Director, stated that this is basically a bookkeeping function, which is
currently being performed by two staff members. He reported that he
would need two additional people to give him the same information that
Mainstem would provide. Following further discussion, it was MOVED
by Buchanan, seconded by Spar ling that Resolution No. D-4032,
authorizing the execution of an agreement with Mainstem Corporation for
equipment maintenance management systems services, be passed:
carried, Spar ling, Wonder, Buchanan voting aye on roll call. Hinman
and Lee voting nay. Beauchamp and Edmondson absent.
RESOLUTION NO. D-4032, A RESOLUTION authorizing and directing the
City Manager and City Clerk of the City' Of Yakima to execute an
agreement with Mainstem Corporation for equipment maintenance
management systems services.
Carol Darby, Director of Community Development, informed Council of a
proposed lease agreement with the Air National Guard for the old
terminal building at the airport for a minimum of five years at $1.00 per
year. The building is currently being used by the Civil Air Patrol,
but the facility is not up to code. The Air National (uard would
rehabilitate the building and after five years, they would look at other
airport property for a long-term lease. The Air National Guard is a
Civil Engineering Flight Unit which would begin with 3.0 men and grow
to approximately 74 men in the unit. One advantage to the City
besides bringing the facility up to code, is that they perform community
projects. Don Emerick, Airport Advisory Commission, expressed the
Commission's support of the lease of the facility to the Air National
Guard. It was MOVED by Buchanan, seconded by Sparling to approve
the report and authorize staff to proceed with negotiations with the Air
National Guard for a five year lease at $1.00 per year: carried,
Buchanan, Hinman, Lee, Sparling and Wonder voting aye by voice vote.

It was MOVED by Wonder, seconded by Sparling that Ordinance No.
2264, relating to traffic control and setting time limits for parking in
City lots and providing for enforcement of parkihg violations, be
passed: carried, Buchanan, Hinman, Lee, Sparling and Wonder voting
aye on roll call. Beauchamp and Edmondson absent.
ORDINANCE NO. 2264, AN ORDINANCE relating to traffic control;
specifying a time limit for parking in public parking lots; providing for
enforcement of parking violations; amending Subsection 9.50.675 A and
9.60.040 A, and repealing Subsection 9.60.040 B, all of the City of
Yakima Municipal Code.

ORDINANCE NO. 2265, AN ORDINANCE relating to City personnel;
providing fringe benefits for certain City employees; amending Sections
2.40.020 and 2.40.100 and Subsections 2.04.30B, 2.24.010A, 2.40.090
A, and 2.40.090B, and enacting Section 2.20.120 as a new Section, all
of the City of Yakima Municipal Code and declaring an emergency.
The Cit Manager next reported that the next two Council meetings will
be held on Tuesday, February 13 and 20 as the preceding Mondays are
holidays. He reported that Carol Darby, Director of Community

Development has requested a special study session to meet with Council
to discuss regional planning issues, i.e., outside utility connections,
wastewater agreement, and annexation. It was the general consensus of
the Council to schedule this study session for February 20 at 1:30 P.M.
Items of information supplied to Council were: (1) City Manager's
response to Robert Leichnitz's letter regarding the possible
reorganization of the building inspection and code enforcement division
under the Fire Department 1/26/79; (2) memo from Director of Parks &
Recreation re joint School District/City Agreement for use of
recreational facilities 2/1/79; (3) list of bids awarded throughout the
year 1978; (4) letter from Chamber of Commerce re support of area
school levy elections on February 6, 1979; (5) Yakima County
Resolution No. 69-1979 dated January 30, 1979 re appointment of Acting
Supervisor and Acting Director for the Yakima County Data Processing
Department; (6) minutes of Civil Service Commission (City Employees)
meeting of January 4, 1979; and (7) AWC legislative bulletin #3,
January 26, 1979.
There being no further business to come before the Council, it was
MOVED by Spar ling, seconded by Wonder at this meeting be
