OCTOBER 30, 1978
The City Council met in session on this date at 1:3(} PM in the Council ,
Chambers of City Hall, Yakima, Washington. Council members present were
Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan, Don Hinman,
Nadine Lee, Jack Sparling and Gordon Wonder.
Mayor Edmondson reported that the dedication for the reopening of the
Capitol Theatre will be on Saturday, November 4, 1978, and proclaimed
that day as "Brand New Life for a Grand Old Lady Day". In honor of the
Capitol, Theatre, Mayor Edmondson stated that the month of November Is
proclaimed to be "Capitol Theatre Month" and presented that proclamation
to Frank Bradley, President, Capitol Theatre CorporatYpn, Mr. Bradley
read a press release, dated October 30, 1978, stating that Governor Ray
and U.S. Representative Mike McCormack will be honored guests at the
Reopening of the Capitol Theatre on November 4, 1978.
Councilman Beauchamp stated that he was very impressed with the celebration
II/ in honor of Justice William B. Douglas and the assistance given by
George Martin, Attorney, and Richard D. Casad, Regional Administrator,
General Services Administration, and encouraged the Mayor to send a
letter to these gentelemen thanking them for their efforts. Mayor
Edmondson stated that there was a long list of people to thank and
letters are being prepared now, doing so.
Councilman Wonder suggested that Council schedule a study session on the
status of the Larson Garage. Assistant City Manager Zais reported that
the lease for the Larson Garage is being readvertised and in the event
there is no response, the lease for the garage may be negotiated. He
also stated that any input from Council mambarswould.ba h�lpfu1/
Councilman Wonder suggested that a bid be sent to the operator, of the
Dragon Inn. Following discussion, it was the general consensus of the
Council that a study session be scheduled after the second bid opening
on the lease for Larson Garage.
Bob Weaver, Personnel OffYcer,.raviewad his 10/24/78 report on Affirmative
Action Program and Contract Compliance. He informed Council that the
goals set for minority hiring have been exceeded. Me. a7so.reportmd that
the Affirmative Action Plan Is a five year program started In 1977 and
should ba.rev7owed and updatad. He expressed concern regarding Civil
Sarvice. Rules.and Regulations requiring that a. position be opened first
for promotion-of City employees and then be opened to the. public, which
restricts the hiring of minorities to enter at the entry )eve1. He
briefly reviewed the contract compliance program, stating that there are
several contracts which will need to be reviewed for cpntract.complience.
Assistant. City. Manager Zais stated.that that wlll.be the responsibility
of the Project Manager.
Council members next discussed.tha art guidelines for the Yakima Center,
Councilman Sparling suggesting that the photos from the avigation committee,
now located at the Airport, be considered for the Yakima Center. It was
suggested by Councilman Wonder that this idea be presented to the Art
Selection Committee. Following discussion, it was MOVED by Wonder,
seconded by ,Beauchamp to approve the presentation of the Art. Selection
Committee's proposal and budget $5,000 for art next year and recommend
that the photps.at.the Airport, as suggested by Councilman Sparling, be
II/ considered for.the Yakima Center: carried, Beauchamp, Buchanan, Edmondson,
Hinman, Lee, Sparling and Wonder voting aye by voice vote. .
It was MOVED by Beauchamp, seconded by Hinman to move into Executive
Session to discuss personnel,: carried, Beauchamp, Buchanan, Edmondson,
Hinman, Lee, Sparling and Wonder voting aye by voice vote. It was the
general consensus of the Council that, only .Council members be present In
the Executive Session.

OCTOBER 30, 1978
At 3:00 PM, the Council members commenced the regular meeting, Mayor
Edmondson presiding, Council members Beauchamp, Buchanan, Hinman, Lee,
Sperling and Wonder, Assistant City Manager Zais and City Attorney
Andrews present on roll call.
The Invocation was given by Assistant City Manager Za}s,
Mayor Edmondson referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from either
Council members or citizens present. The CYt ..Clerk then read the
Consent Agenda items, including a resolution and an ordinance, by title.
It was MOVED by Hinman, seconded by Beauchamp that the Consent Agenda,
as read, be passed: carried, Beauchamp, Buchanan, Edmondson, Hinman,
Lee, Sperling and Wonder voting aye on roll call. (Subsequent paragraphs
preceded by an asterisk (*) indicate items on the Consent Agenda to be
handled under one motion without further discussion.)
It was MOVED by Hinman, seconded by Beauchamp that the minutes of the
October 16 1978 meeting, having been duly certified accurate by two
Council members and no one present wishing to have said minutes read
publicly, be approved: carried, Beauchamp, Buchanan, Edmondson, Hinman,
Lee, Sperling and Wonder voting aye on roll call.
Mayor Edmondson advised Council that a letter had been received from Ron
Whitaker, Attorney for Glascam Builders, requesting that the rezone
hearing set for today be contlnued. After expressing concern for the
citizens who have come to appear at the hearing today, it the general
consensus of the Council to continue the hearing after testimon from
those citizens present who wished to be heard has been received. City
Attorney Andrews informed Council that if the hearing is not continued
to a certain date, the residents in that area will have to be renPtYfYed
of the continued hearing dote.
This being the time fixed for the hearing on Resolution of Intention D-
3974, to create a Local Improvement District for the purpose of improving
certain streets within the plat of Prospect Park, Councilman Hinman
inquired about the assessments being an equal amount for all properties.
Chris Perks, Engineering Office, explained that . because of the unequal lot
frontage, the residents of the area felt that each parcel should be
assessed equally. Jim Davis, 6404 West Ridge, inquired if the assessment
of $3800 includes street lights, which the residents of the area desire.
Mr. Perks stated that the installation of street lights is not mentioned
in the ordinance. Mr. Davis reported that at a neighborhood meeting,
Mr. Mayer, City Engineer, had informed them that for an additional cost
of $200 per parcel, street lights could be installed. Mr. Davis stated
that he assumed that the street lights would be included because his
previous estimate was $3600 and is now $3800. Dave Thomas, 508 No. 64th
Avenue, also spoke In support of street lights for that area and confirmed
what Mr. Davis had reported. Mr. Perks stated that if the estimate for
the street paving was $3600 and the estimate is now $3800, he believes
that Mr. Mayer must have included the street lighting in the L.I.D.
City Attorney Andrews suggested that the Ordinance be enacted and submitted,
and if needed, an amending ordinance can be enacted next week. He
stated that Council will be advised next week of any action taken on
this. It was then MOVED by Wonder, seconded by Buchanan that Ordinance
No. 2227, creating Local Improvement District No. 1022, Prospect Park
Paving District, be passed: carried, Buchanan, Edmondson, Hinman, Lee,
Sperling, Wonder and Beauchamp voting aye on roll call.
ORDINANCE NO. 2227, AN ORDINANCE providing for the improvement of certain
streets by grading, ballasting, surfacing with asphaltic concrete and
constructing concrete curbs and gutters, together with necessary drainage
features; establishing a Local Improvement District, providing for the
method of payment thereof and creating a special fund.
This being the time fixed for the hearing on the rezone application
filed by Clara M. Voelker, for property located at 40 West Mead, and no
one present wishing to speak to this matter, it was MOVED by Wonder,

seconded by Hinman that Ordinance No. 2228, accepting the Planning
Commission's recommendation and zoning said property, be passed: carried,
Edmondson, Hinman, Lee, Sperling, Wonder, Beauchamp and Buchanan voting
aye on roll call.
ORDINANCE NO. 2228, AN ORDINANCE accepting the recommendation of the
Planning Commission and rezoning property at 40 West Mead Avenue In the
City of Yakima from R -2, Two Family Zone to B -1, Modified Business Zone.
This being the time fixed for the hearing on the rezone application
filed by Glascam Builders for property located on the southeast corner
of Summitview and 48th Avenues, Mayor Edmondson announced it was the
general consensus of the Council that the request for a continuance,
from Ron Whitaker, Attorney for Glascam Builders, be denied. Ron Whitaker,
Attorney, stated that staff had informed him that there would be no
problem in continuing this hearing and he, therefore, notified his
clients that the hearing would be continued and he is not prepared today
to present his material. Mayor Edmondson stated that Council has made
the determination to hear the testimony of any citizen present wishing
to speak to this matter, and then, if necessary, continue the hearing to
another date in order to hear testimony from the applicant. Council
member Lee inquired about dust control and drainage. Larry Wright,
Principal Planner, reported that the dust control plan has been approved.
He reported that the City Engineer has not made a determination on the
drainage, but the developer has agreed to give any easements necessary
for this and has agreed to any requirements of the City Engineer. He
stated that Mr. Campbell has agreed to test to see what the perculation
is on the property. Herb Mayer, City Engineer, reported that staff has
made inquiries with the County to use the drain pipes which run through
the property. Councilman Hinman expressed grave concern about any
drainage problem which may occur in the future and the surrounding n eigh bo r-
h9 o d as a result of this development and suggested that some way be
found to hold the developer accountable for correcting any such problems.
Mr. Wright stated that that would be difficult as the developer would
follow the requirements set forth by the City Engineer. Those citizens
present speaking against the rezone were: Guy Kaplicky, 4702 West
Chestnut, objecting to the density of the Planned Development and the
traffic it would create, submitted a petition of 104 names in opposition
of the Planned Development; and Gerald Puyear, 1 No. 46th Avenue, stating
that the developer should be responsible for any problems that occur
because of this development. Ray Rosenkranz, 106 No. 45th Avenue,
expressed concern about the developer using No. 46th Avenue after the
street has been improved and paid for by an L.I.D. Dorothy Birch, 117 No.
46th Avenue, stated that the developer worked with residents .in the
neighborhood to make a totally unacceptable planned development acceptable.
It was then MOVED by Wonder, seconded by Buchanan to continue this
hearing to November 20, 1978 at 8:00 PM: carried, Beauchamp, Buchanan,
Edmondson, Hinman, Lee, Sperling and Wonder voting aye by voice vote.
Council members discussed the proposed "Subdivision" Ordinance, Mayor
Edmondson reporting that former Councilman Jean Allard had called her
and requested that when a lot is divided without a development plan
being required, that that portion of the Ordinance should be effective
January 1, 1979. Councilman Hinman inquired if staff had made any of the
changes he indicated in the last discussion he wished. Larry Wright,
Principal Planner, indicated that staff felt that if there is going to
be a limitation placed on the obligation to join in on local improvement
districts, it should be a ten year limit and not five as suggested. He
also stated that staff feels that the 60 foot width lot requirement when
dividing lots should be maintained. He stated that the variance section
allowing for appeals to Council gives the ordinance flexibility. Councilman
Hinman indicated that he felt that a division of the lot should be based
upon square footage. Following discussion, it was MOVED by Wonder,
seconded by Lee that Ordinance No. 2229, enacting a new Title 14,
"Subdivision" regulating short subdivisions, subdivisions, preliminary
plats and final plats, be passed. It was MOVED by Hinman that Section
14.20.020C be amended to insert a limit of five years for mandatory
obligations to participate in an LID. The Motion died for lack of a

second. It was MOVED by Hinman, seconded by Beauchamp that Section
14,20.020C be amended to insert following "after the land", the phrase
"for a period of'10 years from the time the short plat Ys'opproved//.
Following discussion, the question was called for the vote on the motion:
Hinman voting aye by voice vote. Beauchamp, Buchanan, Edmondson, Lee,
Sperling and Wonder voting nay. The motion failed for want of a majority

It was MOVED by Hinman, seconded by Beauchamp that Resolution Np, D-
3984, establishing bus routes and schedules for the public transportation
system, be passed: carried, Beauchamp, 'Buchanan, Edmondson,'Mlnman,
Lee, Sperling and Wonder voting aye on roll call.

travel for Council members Hinman and Wonder to attend the National

ORDINANCE NO. 2230, AN ORDINANCE relating to City personnel; adopting a
compensation plan for City employees; amending Section 2.20.110 of the
City of Yakima Municipal Code; and declaring an, emergency.
Council member Lee inquired if the dead trees in the CBD area are going
to be replaced. Larry Wright, Principal Planner, stated that they are
in the process of replacing them and that they are still under guarantee.

Council member Lee also Inquired bout the traffic problem which exists
by allowing left hand turns at 2nd Street and Yakima Avenue. Following
discussion, it was the general consensus of the Council to request staff
to check into the traffic problem at Yakima Avenue and 2nd Street and
Yakima Avenue and lst Street due to left hand turns being allowed at
those intersections and also ����� the possibility of removing a couple
of parking stalls on //B/' Street at the intersection of //B// and lst
Streets to allow for a right hand . turn lane.
Assistant City Manager Zais reported that a report from CH2M-Hill regarding
the High Level Water Reservoir by Englewood Dr. 7s due by mid November.
He also reported that the preliminary report from Preston Shepherd on
the Nob Hill Boulevard Study will be filed in his office by November 13.
Items of information supplied to Council were: Minutes of Joint Meeting
of three Legislative Districts (Union Gap, Yakima County and City of
Yakima); AWC Board Meeting Report of October 6, 1978; letter from Doug
II/ GrandquYs, Exacutiva QYrector, YCCOQ, rw l979 Budget; and copy of mYnutas
of Fire Relief and Pension Board 10/11/67.
There being no further business to come before the Council, it was MOVED
by Hinman, seconded by Wonder that this meeting be adjourned at hour of
5:15 PM, to then meet at the Bushwacker Restaurant on Saturday, November
4, 1978v at 11:30 AM for the purpose of adopting a Resolution of Dedication
of the Caplt0 Theatre: carried, Beauchamp, Buchanan, Edmondson, Hinman,
Lee, Sparling and Wonder voting aye by voice vote.
