ADJOURNED MEETING
DECEMBER 4, 1978
The City Council scheduled for session on this date, met at
12:55 P.M., in the City Council Chambers at City Hall, Yakima,
Washington.
Council members present were Mayor Betty L. Edmondson, Henry
Beauchamp, Don Hinman, Nadine Lee and Jack Sparling. Lynn
Buchanan and Gordon Wonder absent.
This being the time scheduled for the 1979 Budget Review for
the Parks & Recreation Department, Dick Hilligus, Director of
Parks & Recreation, introduced his staff and gave the following
report:
The Parks & Recreation 1979 Budget is down 5% from 1978 and
requests $110,000 in F.R.S. Funds for 1979.
CEMETERY: This department is self-sustaining and had an 18%
increase in burials in 1978. There will be a 9% increase in
burials and liners, or $10.00 for each in 1979. There is a
request for the three-fourths person in the office to be changed
to a full time position, an electric typewriter and a pick-up
for department use.
TREE CONSERVATION: Seasonal employees cut-back will result in a
minimum of clean-up, maintenance of trees and schrubs and no
tree replacements. F.R.S. funds will pay for a full-time Park
Caretaker for $12,400 and $9,012 for Equipment Replacement Fund.
PARK MAINTENANCE: There will be a reduction of 8-9 temporary
employees for park maintenance for a savings of $43,500. This
will also result in a $35,000 decrease for equipment not used by
these workers in 1979. Council was told that the parks will be
mowed less often than in the past because of this loss of
personnel and equipment. F.R.S. funds will pay for a Park Care-
taker, $13,706; Supplies, $890; Equipment Replacement Fund,
$21,528. Hilligus explained that equipment to be parked/stored
included: seven mowers, one tractor, an edger, and a spreader.
Volunteers will be used, whenever possible, to help keep various
parks maintained.
PROGRAMMED RECREATION: Supervised programs will be re-organized
to use a minimum of personnel in 1979. Volunteers will be used
for aides and programs. There will not be any new programs or
any new athletic equipment in 1979. No F.R.S. funds will be used
for this program in 1979. It is projected there will be 250,000
participants in 1979. It was mentioned by Hilligus that the fee
schedule will be reviewed by the Parks Commission and be presented
to the Council in March or April, 1979. Approximately $38,830
will be paid from the General Fund for these programs; this
being the difference between the expected revenues and the amount
projected as the cost of the various programs. Hilligus asked
the Council for their direction or recommendation on how the
Parks & Recreation Department could be more self-sustaining in
their various programs.
GOLF COURSE ACTIVITIES: It is proposed that the Fisher Golf Course
will be irrigated during the day in order to eliminate a night
irrigator in 1979. .$6,108 will be used in F.R.S funds for
Equipment Replacement in 1979. Presently, this program is
subsidized 40% by General Revenue. Discussion followed concerning
the fact that if fees were raised 50 it would result in $9,000
revenue in 1979. It was the general consensus of the Council
that the fees should be raised for adults at Fisher Golf Course.

AQUATICS ACTIVITIES: Swim programs and pool hours will be
reduced in 1979. It was noted that weather contributed to the
decrease in the number using the pools; resulting in a loss of
$12,000 in revenue in 1978. F.R.S. Funds requested for $20,000,
Washington Pool; $25,000, Franklin Pool includes opening,
maintenance and personnel for the entire 1979 season. Also,
$696 for Equipment Replacement Fund is requested of F.R.S.
Funds. It was noted that this $45,000 is almost half of the
$110,000 requested by this Department for F.R.S. Funds. Hilligus
explained the problems with the Lions Pool cover and that $140,000
will be requested in 1980 to replace the top in the Capital
Improvement Six-Year Plan.
SENIOR CITIZENS ACTIVITIES: No F.R.S. monies are requested
for the program. There will not be any changes in the
programs or the use of volunteers at the Senior Center in
1979. The cost factor is approximately 70 per Senior Citizen
using the Center during 1979 and a 13% reduction from the I/
1978 budget.
ADMINISTRATION: The Parks Superintendent position will be left
vacant during 1979. F.R.S. Funds requested are $660 for Equip-
ment Replacement Fund.
PARKS & RECREATION CAPITAL: Hilligus stated that the Six-Year
Program for Capital Improvement projects should be completed in
1979. These include identifying some land in Neighborhood 15;
automatic irrigation systems for Naches Avenue Parkway and
Miller Park; complete construction of the S.E. Community
Center wading pool. These will finish the monies in this
particular program. No new F.R.S. Funds for Capital Improv-
ment are requested in 1979. Hilligus stated that the six-year
old Comprehensive Plan will need to be updated by July, 1979.
A Park Needs Study Committee has been formed to recommend
project priorities.
At 3:00 P.M., the Council members commenced the regular meeting,
Mayor Edmondson presiding, Council members Beauchamp, Hinman,
Lee and Sparling and Acting City Manager Zais and City
Attorney Andrews present on roll call. Council members
Buchanan and Wonder absent. It was MOVED by Hinman, seconded
by Beauchamp to excuse Council members Buchanan and Wonder
from this meeting: carried, Beauchamp, Edmondson, Hinman,
Lee and Sparling voting aye by voice vote. Buchanan and
Wonder absent.
The Invocation was given by Councilman Hinman.
Mayor Edmondson referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions
from either Council members or citizens present. Mayor
Edmondson requested that the minutes of November 16, 1978
be removed from the Consent Agenda in order to make a
correction. It was the general-consensus of the council that
the deletion of the minutes of November 16, 1978, as requested,
be made. The City Clerk then read the Consent Agenda items,
including ordinances, by title. It was MOVED by Beauchamp,
seconded by Lee that the Consent Agenda, as read, be passed:
carried, Beauchamp, Edmondson, Hinman, Lee and Sparling
voting aye on roll call. Buchanan and Wonder absent.
It was MOVED by Beauchamp, seconded by Lee that the adjourned
meeting of November 20 and the regular meetings of November 20
and 27, 1978, having been duly certified accurate by two
Council members and no one present wishing to have said minutes

read publicly, be approved: carried, Beauchamp, Edmondson,
Hinman, Lee and Sparling voting aye on roll call. Buchanan

Mayor Edmondson stated that on the 6th line under Tourist
Promotion in the minutes of the adjourned meeting of November 16,
1978, the additional $15,000 is going to the Visitors & Convention
Bureau for tourist promotion of the Yakima Center, not for the
Yakima Center and requested that the minutes be corrected to
reflect that change. It was MOVED by Hinman, seconded by
Beauchamp, that the minutes of the adjourned meeting of
November 16, 1978, be approved, as amended: carried, Beauchamp,
Edmondson, Hinman, Lee and Sparling voting aye by voice vote.

This being the time fixed for the hearing on the Assessment Roll
for L.I.D. No. 1013, North 60th Avenue, Chestnut to Barge,
Paving District, Mayor Edmondson stated that Council has
received staff reports and other data on this matter. There
being no citizen present to speak to this matter, it was MOVED
by Lee, seconded by Hinman that Ordinance 2233, confirming the
assessment roll for L.I.D. No. 1013, North 60th Avenue, Chestnut
to Barge Paving District, be passed: carried, Edmondson, Hinman,
Lee, Sparling and Beauchamp voting aye on roll call. Buchanan
and Wonder absent.
ORDINANCE NO. 2233, AN ORDINANCE confirming the assessment roll
covering Local Improvement District No. 1013, as created and
established by Ordinance No. 2129 of the Ordinances of the
City of Yakima.
This being the time fixed for the hearing on the Assessment Roll
for L.I.D. No. 1015, Prestige Manor Sewer District, Mayor
Edmondson stated that Council has received staff reports and
other data on this matter. There being no citizen present to
speak to this matter, it was MOVED by Beauchamp, seconded by
Lee that Ordinance No. 2234, confirming9ithe assessment roll
for L.I.D. No. 1015, Prestige Manor Sewer District, be passed:
carried, Hinman, Lee, Sparling, Bdauchamp and Edmondson voting
aye on roll call. Buchanan and Wonder absent.
ORDINANCE NO. 2234, AN ORDINANCE confirming the assessment roll
covering Local Improvement District No. 1015 as created and
established by Ordinance No. 2155 of the Ordinances of the
City of Yakima,
This being the time fixed for the hearing on the Assessment
roll for L.I.D. No. 1016, Prestige Manor Street District, Mayor
Edmondson stated that Council has received staff reports and
other data on this matter. There being no citizen present to
speak to this matter, it was MOVED by Lee, seconded by Hinman
that Ordinance No. 2235, confirming the assessment roll for
L.I.D. No. 1016, Prestige Manor Street District, be passed:
carried, Lee, Sparling, Beauchamp, Edmondson and Hinman voting
aye on .roll call. Buchanan and Wonder absent.
ORDINANCE NO. 2235, AN ORDINANCE confirming the assessment roll
covering Local Improvement District No. 1016 as created and
established by Ordinance No. 2156 of the Ordinances of the
City of Yakima.
This being the time fixed for the hearing on Resolution No. D-3990
for the creation of a Local Improvement District, to install
sewer lines in the vicinity of 43rd Avenue and Aller Street,
and no citizen being present to speak to this matter, it was
MOVED by Lee, seconded by Hinman that Ordinance No. 2236,
creating L.I.D. No. 1023, 43rd & Aller Sewer District, for
the construction of a sewer, be passed: carried, Sparling,
Beauchamp, Edmondson,. Hinman and Lee voting aye on roll call.
Buchanan and Wonder absent.

ORDINANCE NO. 2236, AN ORDINANCE providing for the improvement
of certain property by constructing a pipe sewer with the
necessary wye branches and manholes, establishing a Local
Improvement District, providing for the method of payment
thereof, and creating a special fund.
This being the time fixed for the hearing on a rezone request
filed by Mildred Cahoon for property located at 4001 Tieton
Drive, Council member Lee inquired how the gas station that
was located there got into that zone. Larry Wright, Principal
Planner, stated that it was a non-conforming use as it was
there before the property was annexed and zoned. There
being no citizen present wishing to speak to this matter, it
was MOVED by Lee, seconded by Beauchamp that Ordinance I/
No. 2237, accepting the recommendation of the Planning
Commission and rezoning said property, be passed: carried,
Beauchamp, Edmondson, Hinman, Lee and Sparling voting aye
on roll call. Buchanan and Wonder absent.
ORDINANCE NO. 2237, AN ORDINANCE accepting the recommendation
of the Planning Commission and rezoning property at 40th
Avenue and Tieton Drive from R-3, Multiple Family Zone, to
B-1, Modified Business Zone, and declaring an emergency.
The hearing on the 1979 budget, having been continued from
November 20, 1978, Mayor Edmondson announced that Council has
been having budget study sessions. Ines Rice, 4409 W.
Arlington, spoke in support of allocating sufficient funds
to the Police and Fire Departments to avoid any lowering of
standards for Police and Fire. Ed Hosack, Chief Probation
Officer for District Court Probation Services, spoke in
support of allocating $25,000 of F.R.S. funds for District
Court Probation Services. He reported on the services they
provide the City, stating-that _Atis less expensive to put
a person on probation than it is to have him serve jail time.
He reported that as of October 1st, 43% of 135 cases of pre-
sentence investigation or probation came out of Yakima City
Court - 78% of all County-wide referrals reside in Yakima
City limits. He stated that $177,000 of revenue will be
returned to the City by this program. Mayor Edmondson stated
that that doesn't reflect any of the filing fees that the
City has to pay. Acting City Manager Zais stated that it
would be helpful if Mr. Hosack could provide Council with a
break-down of their budget. It was MOVED by Lee, seconded
by Hinman that the hearing on the 1979 budget be continued
to December 11, 1978: carried, aeauchamp, EdmondsOpiHinman,
Lee and Sparling voting aye by voice vote. Buchanan and
Wonder absent.
Ines Rice, 4409 W. Arlington, submitted to Council a copy of
the Tel Aviv newspaper, in which appeared an article on
Yakima's colored angels.
Mrs. Loretta Steele, 1007 S. Naches Avenue, stated she watched
KYVE's program last Friday night and now feels that her water
meter was not read properly. Councilman Hinman reported that
he had talked with Don Meighan of KYVE and that Mr. Meighan
speculated on the program that maybe not all the meters in
Yakima were read before every billing. Mayor Edmondson stated
that last week Council had agreed to adjust the second high
water bill Mrs. Steele had, but since there wasn any
evidence that the leaky faucets she fixed was not the cause
of the excessive water bill, that bill could not be adjusted.
She stated that last week Mrs. Steele was happy with the
adjustment that was made. Following discussion about whether
the first high water bill should be adjusted, Councilman
Sparling MOVED to let the head of the water department make
adjustments subject to the approval of the Acting City Manager,
for the next three months. The Motion died for lack of a second.

Acting City Manager. Zais reported that staffli had conducted
an administrative review of the matter and felt that no
adjustment was warranted and Mrs. Steele then appealed to
Council. City Attorney Andrews stated that if nobody makes a
motion, the action that Council took last week will stand.
There being no motion made, Mrs. Steele stated that she would
take this to legal aid and if they won't help, she would take
it to small claims court.
Bob Knight, Transit Manager, reviewed his memo of November 21,
1978, pertaining to the petition received requesting bus
service to Madison House on Englewood Avenue. He reported
that service on Englewood Avenue is in the City's Five-Year
- Plan, but it is not feasible to service that route at this
I/ time. He reported that Madison House is outside the City
limits, and they do have their own van available for the
resident's use. Councilman Sparling inquired if Mr. Knight
had communicated with the group who signed the petition and
Mr. Knight said that he had. Mayor Edmondson reported that
Mrs. Butchart, who sent in the petition, had telephoned to
say that any decision the Council makes was alright with her.

No. 2238, amending Ordinance No. 2199, creating L.I.D. No. 1018,
Ranchette Subdivision Sewer District, and amending the boundary
of the L.I.D., be passed: carried, B Edmondson,
Hinman,Lee and Sparling voting aye on roll call. Buchanan and

ORDINANCE NO. 2238, AN ORDINANCE amending Section 1 of City
of Yakima Ordinance No. 2199, enacted August 14, 1978, entitled
"AN ORDINANCE providing for the improvement of certain property
by constructing a pipe sewer with the necessary wye branches
and manholes; establishing a Local Improvement District,
providing for the method of payment thereof, and creating a
special fund".
*Having previously requested legislation to be prepared, it was
MOVED by Beauchamp, seconded by Lee that Ordinance No. 2239,
amending the Yakima City Municipal Code to repeal sections.

Edmondson, Hinman, Lee and Sparling voting aye on roll call.

ORDINANCE NO. 2239, AN ORDINANCE relating to regulations for
bicycles; and repealing Sections 9.50.860, 9.50.870, 9.50.880,
9.50.890, 9.50.900, 9.50.910, 9.50.920 and 9.50.930 of the
City of Yakima Municipal Code relating to bicycle licensing.

2240, relating to sick leave for Fire Department employees,
be passed: carried, Beauchamp, Edmondson, Hinman, Lee and
Sparling voting aye on roll call. Buchanan and Wonder absent.
ORDINANCE NO. 2240, AN ORDINANCE relating to city government
personnel; providing for and regulating sick leave for certain
Fire Department employees; enacting Section 2.22.075 as a
new section of the City of Yakima Municipal Code; and declaring
an emergency.
Council members discussed the correspondence received from
Yakima Mortgage Bankers Association, Central Washington Home-
builder's Association and Yakima Board of Realtors, relating
to the recently passed Subdivision Ordinance. Acting City

Manager Zais reported that he had conversed with Fred Witham
and he indicated it was their intent and purpose to submit
their letter of protest into the records. It was the general
consensus of the Council that this correspondence be filed
with the City Council and be noted in the records.
It was the general consensus of the Council that Tuesday,
December 12, 1978 at 1:30 P.M., be scheduled as a catch-up
budget study session. It was also the general consensus
of the Council that the budget study session scheduled for
December 11, 1978 be changed to begin at 1:00 P.M.
City Attorney Andrews reported that the Superior Court has
ruled that the Fire Battalion Chiefs will be represented
by the firefighters Union.
