HomeMy WebLinkAbout1972-1462 ORDINANCE NO. /`/ AN ORDINANCE creating the Federal ;;hared 1.evonu, Fund as a special fund of the City of Yakima specifying the source of revenue to be deposited in such fund; designating the purposes of such fund; providing for the method of expen- diture from such fund; adding Chapter 3.87, "Federal Shared Rovonuc Fund ", to consist of Sections 3.87.011., 3.87.020 and 3.87.030, as a new chapter and new sections of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Chapter 3.87, "Federal h rid IlL.Ircnuc Fund " , to consist of Sections 3.87.010, 3.87.020 and 3.87.030, is hereby added as a new chapter of the City of Yakima Municipal Code, which new chapter and sections shall read as follows: "CHAPTER 3.87 I cdcral Sh -,red Rcvcnuc Fund 3.87.010 Fund Created -- Source of Revenue. There is hereby created a special fund to be known as the Federal ;;hared Revcnuk,;F There shall be deposited into such fund all money received by the City under Subtitle A, "Allocation and Payment of Funds ", of the State and Local Fiscal Assistance Act of 1972, together with all interest earned from the investment of money within the fund. 3.87.020 Purposes. A. Expenditures from such fund shall be made only for priority expenditures as defined by Section 103 (a) of the State and Local Fiscal Assistance Act of 1972, which priority expenditures are defined as follows: 1. Ordinary and necessary maintenance and operating expenses for: (a) Public safety (including law enforcement, fire protection and building code enforcement), (b) Environmental protection (including sewage dis- posal, sanitation and pollution abatement), (c) Public transportation (including transit systems and streets and roads), (d) Health, (e) Recreation, (f) Libraries, (g) Social services for the poor or aged, and (h) Financial administration; and 2. Ordinary and necessary capital expenditures authorized by law. B. No money in such fund shall be used, directly or indirectly, as a contribution for the purpose of obtaining Federal funds under any law of the United States which requires a contribution by the City of Yakima in order to receive Federal funds. 3.87.030 EIEtaciit,1E21. Expenditures from the Federal Shirred Rcvunuo Fund shall be made only pursuant to an 41! ordinance passed by the Yakima City Council appropriating a speci- fic amount of money within such fund for a designated purpose and authorizing the transfer of that amount of money to another speci- fied fund for appropriation therein and for expenditure therefrom." Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immedi- ately upon its passage, approval and publication as provided by law and by the City Charter.
