City Engineer — 576 -6648 SUMMARY EXPLANATION: This project consisted of designing and installing the new suspended ceilings on the first and second floors of the City Hall building. New HVAC diffusers and lighting were provided and installed in conjunction with the new ceilings. Final inspection for this project was made and the recommendation is that the project be accepted. This Council action is to accept the project and approve the final estimate. A five percent retainage bond is in place and will be released 30 days after Council approval. Contractor: Stephens & Sons Construction, Inc. Contract Award: 9/12/01 Contract Cost: $72,089.33 Amt. This Payment: $528.95 The above total contract cost is for construction only and does not include engineering and other costs. All bid proposals shall be accompanied by a bid proposal deposit in cash, certified check, cashier's check or surety bond in an amount equal to five percent (5 %) of the amount of such bid proposal. Should the successful bidder fail to enter into such contract and furnish satisfactory performance bond within the time stated in the specifications, the bid proposal deposit shall be forfeited to the City of Yakima. Plans and specifications may be obtained at the Office of the City Engineer located at 129 North 2nd Street upon payment of the amount of $50.00 for each set, non refundable. Informational copies of maps, plans, and specifications are on file for inspection in the Office of the City Engineer of Yakima in Yakima, Washington, and at Plan Centers in Yakima and Kennewick, Washington. DATED this 20th day of August, 2001 (SEAL) KAREN ROBERTS CITY CLERK PUBLISH Aug. 26, 2001 Aug. 27, 2001 5 CONTRACT REQUIREMENTS Supplementary General Conditions Special Instructions /Conditions Technical Specifications Contract Form CITY HALL RENOVATIONS City of Yakima Yakima, Washington SUPPLEMENTARY GENERAL CONDITIONS PROJECT DESCRIPTION This project consists of the design and installation of modifications to Yakima City Hall in accordance with the plans and specifications provided by the City of Yakima. The work includes the installation of new suspended ceilings on the first and second floors of the building as shown on the drawings. Also noted on the drawings are certain areas where selective demolition of existing ceilings and lighting is required. New HVAC diffusers and lighting will need to be provided and installed in conjunction with the new ceilings. The Contractor will be responsible for designing the reflected ceiling plan and installing the diffusers and light fixtures to achieve maximum efficiency and occupant comfort.. Work in hallways open to the public will have to take place after normal working hours (i.e. weekends or evenings after 5:00 PM). Individual offices and employee hallways may be done during regular working hours (8:00 AM -5:00 PM), provided that the scheduling is coordinated with the owner's representative and 48 hours prior notification is given. Scope of Work: Work under this contract includes but is not limited to any and all labor, materials, equipment, and administrative costs to supply and /or construct the Yakima City Hall Renovations, as described in these contract documents. The project site is located at 129 North 2nd St., Yakima, Washington. All equipment, parts and material shall be new, unused, manufacturer's latest model and in current production. All materials shall have physical and chemical properties to withstand the intended service. Equipment design shall have sufficient excess capacity for durability and safety. The City of Yakima reserves the right to reject any or all bids or accept any presented which meet or exceed these specifications, and which would be in the best interest of the City and will not necessarily be bound to accept the low bid. Contractor shall, and hereby agrees to, release, save, otherwise hold harmless and indemnify the City of Yakima, its, agents, employees, and elected or appointed officials from claims, demands, damages, actions, causes of actions or other liability, injury, or harm caused by act or omissions, foreseen or unforeseen, negligent or otherwise, that would otherwise befall said City arising out of the contractor's implementation of the terms of this contract. Contractor's Duties: 1. Except as specifically noted, provide and pay for: a. Labor, materials, and equipment as shown or specified. b. Tools, construction equipment, and machinery necessary for the work. c. Pay all legally required sales, consumer, and use taxes. 3. Secure and pay for, as is necessary for proper execution and completion of the work and as applicable at time of receipt of bids: a. Government Fees b. Licenses c. City of Yakima Inspection, Installation, and Permit Fees 4. Give required notices. Before any work is started, the Contractor shall submit to the Owner for review and approval an estimated progress schedule indicating the starting and completion dates of the various items of work in accordance with the drawings and/or specifications. 5. Comply with codes, ordinances, rules, regulations, orders, and other legal requirements of public, federal, state, and local authorities which bear on performance of work. All City of Yakima ordinances shall also apply. 6. Promptly submit written notice to the Owner of observed variances of contract documents from legal requirements. The Contractor shall assume all responsibility for work completed known to be contrary to such requirements without notice to and approval from Owner. Contractor use of Premises: 1. Confine operations at the site to areas permitted by Yakima City Hall representatives and the contract documents. • 2. Do not unreasonably encumber the site with materials or equipment. 3. Assume full responsibility for protection and safekeeping of products stored on premises. 4. The Contractor will take care to control and abate site - generated dust as a result of construction. The Contractor shall, at his cost, provide dust control measures as required by Yakima City Hall representative. 5. The Contractor is allowed to use City Hall restroom facilities limited to the area of construction or public restrooms. 6. The entire site is a non - smoking area. No drugs, alcohol, or weapons of any kind shall be permitted on the site. 7. Construct work in stages to accommodate the Owner's occupancy requirements during the construction period; submit a complete construction schedule. 8. Submission of a bid shall be confirmation that the Contractor has (a) examined the contract documents thoroughly; (b) visited the site to familiarize himself with local conditions that may in any manner affect cost, progress, or performance of the work; (c) familiarized himself with federal, state, and local laws, ordinances, rules, and regulations that may in any manner affect cost, progress, or performance of the work; and (d) studied and carefully correlated bidder's observations with the contract documents in the preparation of the bid. 2. Items noted "Furnished by Owner" will be furnished by the Owner for installation by the Contractor. 3. Limit use of premises to construction operations. 4. Separate the construction area from the existing grounds, other areas of the building, and coordinate use of premises under direction of the Owner. 5. The Contractor shall remove and retain possession of salvage items per Demolition Section of this Contract provided the Owner is given first right of refusal. 6. Notify the Owner a minimum of 48 hours in advance of any utility disruption and minimize disruption. 7. Payment will be mailed within thirty (30) days of the properly completed invoice. 3. Liquidated Damages: For each consecutive day after the 30 day completion time that the work remains uncompleted, the vendor shall pay to the City, via offset against moneys due and payable to the vendor, a sum of five hundred dollars ($500) per calendar day. The City and the vendor agree that the above mentioned damages is a reasonable estimation of compensation which would be due the City for delay - related damages, that they have no intention to stipulate to a penalty, and that they waive any right they may have to interpose an objection to the damages, including that the damages constitutes a penalty, rather than liquidated damages. The City reserves the right to waive this clause in whole or in part, on a case -by- case basis if the vendor can show that the delay occurred from circumstances • beyond his control. Said circumstances would include, but not be limited to, armed hostilities, riots, strikes, picketing boycott, acts of God, national financial or economic disturbances, epidemics, and other events not reasonable foreseeable or against which vendor re of idbly cannot protect himself. 4. All work, including design, shall be performed and completed in accordance with the best modern practices, further, no detail necessary for safe and regular operation shall be omitted, although specific mention thereof may not be made in these specifications. 5. Additional work found necessary that is not specified in this Bid specification shall be listed on a separate sheet entitled "Additional Materials /Labor Required." 6. The attached drawings are illustrative only and may not be to exact scale. All dimensions must be verified by vendor. 7. All work is to be in compliance with all CITY, COUNTY, STATE OR FEDERAL CODES and Is the responsibility of the contractor to ensure compliance. Contractor shall insure that all required inspections are performed and that all • inspection forms have been signed off by the Yakima City Codes Department. 14 CITY HALL RENOVATIONS City of Yakima Yakima, Washington AWARD CONDITIONS Public Liability and Property Damage Insurance: The Contractor shall obtain and keep in force during term of the contract and until 30 days after the Physical Completion date, the following insurance with companies or through sources approved by the State Insurance Commissioner pursuant to Chapter 48, RCW. The insurance provided must be with an insurance company with a rating of A -: VII or higher in the A.M. Best's Key Rating Guide, which is licensed to do business in the State of Washington (or issued as a surplus line by a Washington Surplus lines broker). The Contracting Agency reserves the right to approve the security of the insurance provided, the company, terms and coverage, and the Certificate of Insurance. If any policy is written on a claims made form, the retroactive date shall be prior to or coincident with the effective date of this contract. The policy shall state that coverage is claims made, and state the retroactive date. Claims made form coverage shall be maintained by the Contractor for a minimum of three years following the expiration or earlier termination of this contract, and the Contractor shall annually provide the Contracting Agency with proof of renewal. If renewal of the claims made form of coverage becomes unavailable, or economically prohibitive, the Contractor shall purchase an extended reporting period ( "tail ") or execute another form of guarantee acceptable to the Contracting Agency to assure financial responsibility for liability for services performed. The policies of insurance shall contain a "cross liability" endorsement substantially as follows: The inclusion of more than one insured under this policy shall not affect the rights of any insured as respects any claim, suit, or judgment made or brought by or for any other insured or by or for any employee of any other insured. This policy shall protect each insured in the same manner as though a separate policy had been issued to each, except that nothing herein shall operate to increase the company's liability beyond the amount or amounts for which the company would have been liable had only one insured been named. The policies of insurance for general, automobile, and pollution policies shall be specifically endorsed to name the Contracting Agency and its officers, elected officials, employees, agents and volunteers, and any other entity specifically required by the Contract Provisions, as additional insured(s). In addition, Contractor's insurance shall be primary as respects the Contracting Agency, and any other insurance maintained by the Contracting Agency shall be excess and not contributing insurance with the Contractor's insurance. The Contracting Agency shall be given at least 20 days prior written notice of any cancellation, reduction in coverage, or other material change in any insurance policy. Insurance shall provide coverage to the Contractor, all subcontractors, the City of Yakima, and each of those respective agencies' employees, agents, and elected or appointed officials. The coverage shall protect against claims for personal injuries, including accidental death, as well as claims for property damages which may arise from any act or omission of the Contractor or the subcontractor, or by anyone directly or indirectly employed by either of them. 15 CITY HALL RENO VATIONS City of Yakima Yakima, Washington Contractor hereby assumes all risk of damage to its property, or injury to its officers, directors, agents, contractors, or invitees, in or about the Property from any cause, and hereby waives all claims against the Contracting Agency. The Contractor further waives, with respect to the Contracting Agency only, its immunity under RCW Title 51, Industrial Insurance. Upon request, the Contractor shall forward to the Contracting Agency the original policy, or endorsement obtained, to a Contractor's policy currently in force. The Contractor shall not begin work under the contract until the required insurance has been obtained and approved by the Contracting Agency. Failure on the part of the Contractor to maintain the insurance as required shall constitute a material breach of contract upon which the Contracting Agency may, after giving five working days notice to the Contractor to correct the breach, immediately terminate the contract or, at its discretion, procure or renew such insurance and pay any and all premiums in connection therewith, with any sums so expended to be repaid to the Contracting Agency on demand, or at the sole discretion of the Contracting Agency, • • offset against funds due the Contractor from the Contracting Agency. All costs for insurance shall be incidental to and included in the unit contract pricesof the contract and no additional payment will be made. Coverages and Limits All coverages combined single limit shall be $1,000,000 per occurrence. The commercial general liability policy will contain a "per Job Aggregate" Endorsement. If this endorsement is not provided, an additional $2,000,000 umbrella limit will be required over and above the $1,000,000 underlying. A commercial general liability deductible of $5,000 or Tess is acceptable. The contractor will be responsible for the payment of that deductible for any losses which occur. Higher retention or deductible limits may be acceptable on prior approval by the City. Providing coverage in these stated amounts shall not be construed to relieve the • Contractor from liability in excess of such limits. Evidence of Insurance The Contractor shall provide evidence of insurance by the following method: A completed ACORD form #25 (or equivalent) shall be submitted which conforms to the following requirements: 1. The ACORD form shall be accompanied by a completed Endorsement naming, the City of Yakima, tts agents, employees, and elected or appointed officials as an additional insured and containing the insured's name and policy number, and shall be signed by a duly authorized agent. 2. The wording in the CANCELLATION section "endeavor to" and "but failure to mail such notice shall impose no obligation or liability of any kind upon the company, its agents or representatives" shall be crossed out and initialed by the agent/broker and shall provide for a cancellation notice of at least 20 days, to the City of Yakima. 16 CITY HALL RENOVATIONS City of Yakima Yakima, Washington 3. Add the following text in the section entitled DESCRIPTION OF OPERATIONS / LOCATIONS / VEHICLES / EXCLUSIONS ALLOWED BY ENDORSEMENT / SPECIAL PROVISIONS. The City of Yakima its employees, agents, and elected or appointed officials are additional insures for City Hall Renovation City Project No. 1783. 4. Contain the appropriate amount and types of coverage's that are specified by the Contract. Performance Bond: A Performance Bond issued by a professional surety company authorized to do business in the State of Washington in the amount of one hundred percent (100 %) of the quote shall be executed and delivered to the City and subject to approval of the City Engineer ten (10) work days from the date of the Letter of Award to insure that work will be performed in accordance with the specifications and within time allowed for the Contract. This bond shall insure the City against failure of the successful bidder to promptly correct all discrepancies in manufacture, materials, quality of workmanship, and appearance of the finished work. If the successful bidder fails to perform per specifications, the bond will be forfeited. At the Contractor's option, a certified or cashiers check will be accepted and will be deposited in a non - interest bearing checking account by the City in lieu of a bond, subject to the same provisions, terms and conditions applicable to a bond. The City will pay no interest on any check accepted in lieu of a bond under this requirement. After receipt and acceptance of the finished work, the Contractor will be reimbursed for the check accepted in lieu of the bond by a City of Yakima Treasury Check. A standby letter of credit or other security arranged by the Contractor may be substituted for the bond or check, subject to prior approval by the City. Submittal The Certificate of Insurance and Performance Bond shall be filed with the City Engineer ten (10) days from the date of the Letter of Award. CONTROL OF THE WORK Owner's Authority: Richard Colgan, Building Superintendent, or his designate, shall have the authority to decide all questions which may arise as to the quality and acceptability of work performed, and as to the manner of performance and the rate of progress of the work. All questions which may arise as to the interpretation of the work schedule and questions as to the acceptable fulfillment of the contract shall be brought to the attention of the City Engineer. All requests shall be forwarded to the City Engineer in writing through the through the Building Superintendent. 17 CITY HALL RENOVATIONS City of Yakima Yakima, Washington Conformity with Work Plans and Allowable Deviations: Any deviations from these specifications, as may be required by unforeseen events or weather conditions will be mutually determined by the City Engineer, the Building Superintendent, and the Contractor. Storage of Materials: The contractor shall be responsible to provide his own storage of materials for the project. 1. Materials shall be so stored as to ensure the preservation of their quality and fitness for the work. When considered necessary, they shall be placed on wooden platforms or other hard, clean surfaces, and not on the ground. 2. Delicate instruments and materials subject to vandalism shall be placed under locked cover and, if necessary, provided with temperature control as recommended by the manufacturer. Site Restoration and Cleanup: At all times during the work, keep the premises clean and orderly. 1. Upon completion of the work, the Contractor shall repair all damages caused by equipment and leave the project free of rubbish or excess materials of any kind. 2. The Contractor shall do partial cleanup when he determines it is necessary or when, in the opinion of the Building Superintendent, partial cleanup shall be done for public safety. The cleanup work shall be done immediately upon notification from the Building Superintendent and other work shall not proceed until the partial cleanup is accomplished. PROSECUTION AND PROGRESS Subcontracting The Contractor shall use the Subcontractors List and the Subcontractor Certification form included within these contract documents to comply with the specifications of this section. Progress Schedule The Contractor shall prepare and submit to the Construction Engineer a Construction Progress and Completion Schedule using the Bar Graph or Critical Path Method. Items in the Schedule shall be arranged in the order and sequence in which they will be performed. The Schedule shall conform to the working time and time of completion established under the terms of the Contract and shall be subject to modification by the Construction Engineer. The schedule shall be drawn to a time scale, shown along the base of the diagram, using an appropriate measurement per day with weekends and holidays indicated. The Construction Progress Schedule shall be continuously updated and, if necessary, redrawn upon the first working day of each month or upon issuance of any Change Order which substantially affects the scheduling. Copies (2 prints or 1 18 CITY HALL RENOVATIONS City of Yakima Yakima, Washington reproducible) of newly updated Schedules shall be forwarded to the Construction Engineer, as directed, immediately upon preparation. The Contractor shall submit a weekly activity schedule to the Construction Engineer before 9:00 a.m. on the Friday prior to the week indicated on the schedule. If the Contractor proceeds with work not indicated on his weekly activity schedule, or in a sequence differing from that which he has shown on his schedule, the Construction Engineer may order the Contractor to delay unscheduled activities until they are included on a subsequent weekly activity schedule. LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC Laws to be observed: The contractor shall comply with all applicable laws and regulations pertaining to this contract. In addition, the contractor shall ensure that any subcontractor performing this contract shall comply with all applicable laws and regulations pertaining to this contract. Permits and Licenses: The contractor shall procure all permits and licenses, pay all charges and fees, and give all notices necessary and incidental to the due and lawful prosecution of the work. The Contractor shall have or obtain a valid City of Yakima Business license for the duration of this project. Contractor's Responsibility for Interfering Structures: 1. The contractor shall take necessary precautions to prevent damage to existing structures. 2. Where such existing structures must be modified in order to properly carry out the work, or are damaged during the work process, the contractor shall restore to their original condition to the satisfaction of the owner at the Contractor's own expense. Contractor's Responsibility for Public Convenience and Safety: The contractor shall so conduct his operations as to cause the least possible obstructions and inconvenience to the public. 1. Authorized representatives of the City of Yakima shall at all times have safe access to the work wherever it is in preparation or progress, and the Contractor shall provide proper facilities for such access and inspection. Contractor's Responsibility for Fire Prevention and Protection: The Contractor shall perform all work in a fire -safe manner. 1. Disseminate the Contractor's EEO policy externally by including it in any advertising in the news media, specifically including minority and female news media, and providing written notification to and discussing the Contractor's EEO policy with other Contractors and Subcontractors with whom the Contractor does or anticipates doing business. i. Direct its recruitment efforts, both oral and written to minority, female and community organizations, to schools with minority and female students and to minority and female recruitment and training organizations serving the Contractor's recruitment area and employment needs. Not later than one month prior to the date for the acceptance of applications for apprenticeship or other training by any recruitment source, the Contractor shall send written notification to organizations such as the above, describing the openings, screening procedures, and tests to be used in the selection process. j. Encourage present minority and female employees to recruit other minority persons and women and where reasonable, provide after school, summer and vacation employment to minority and female youth both on the site and in other areas of a Contractor's work force. k. Validate all tests and other selection requirements where there is an obligation to do so under 41 CFR Part 60 -3. I. Conduct, at least annually, an inventory and evaluation of all minority and female personnel for promotional opportunities and encourage these employees to seek or to prepare for, through appropriate training, etc., such opportunities. m. Ensure that seniority practices, job classifications, work assignments and other personnel practices, do not have a discriminatory effect by continually monitoring all personnel and employment related activities to ensure that the EEO policy and the Contractor's obligations under these specifications are being carried out. n. Ensure that all facilities and company activities are nonsegregated except that separate or single -user toilet and necessary changing facilities shall be provided to assure privacy between the sexes. o. Document and maintain a record of all solicitations of offers for subcontracts from minority and female construction contractors and suppliers, including circulation of solicitations to minority and female contractor associations and other business associations. p. Conduct a review, at least annually, of all supervisors' adherence to and performance under the Contractor's EEO policies and affirmative action obligations. 8. Contractors are encouraged to participate in voluntary associations which assist in fulfilling one or more of their affirmative action obligations (7a through 7p). The obligation to comply, however, is the Contractor's and failure of such a group to fulfill an obligation shall not be a defense for the Contractor's noncompliance. 9. A single goal for minorities and a separate single goal for women have been established. The Contractor, however, is required to provide equal employment opportunity and to take affirmative action for all minority groups, both male and female, and all women, both minority and non - minority. Consequently, the Contractor may be in violation of the Executive Order if a particular group is employed in substantially disparate manner (for example, even though the Contractor has achieved its goals for women generally, the Contractor may be in violation of the Executive Order if a specific minority group of women is underutilized). 10. The Contractor shall not use the goals and timetables or affirmative action standards to discriminate against any person because of race, color, religion, sex, or national origin. 11. The Contractor shall not enter into any subcontract with any person or firm debarred from Government contracts pursuant to Executive Order 11246. 12. The Contractor, in fulfilling its obligations under these specifications, shall implement specific affirmative action steps, at least as extensive as those standards prescribed in paragraph 7 of this Special Provision, so as to achieve maximum results from its efforts to ensure equal employment opportunity. If the Contractor fails to comply with the requirements of the Executive Order, the implementing regulations, or these specifications, the Director shall proceed in accordance with 41 CFR 60 -4.8. 14. The Contractor shall designate a responsible official to monitor all employment related activity to ensure that the company EEO policy is being carried out, to submit reports relating to the provisions hereof as may be required by the government and to keep records. Nothing herein provided shall be construed as a limitation upon the application of other laws which establish different standards of compliance or upon the application of requirements for the hiring of local or other area residents (e.g., those under the Public Works Employment Act of 1977 and the Community Development Block Grant Program). 32 CITY HALL RENOVATIONS City of Yakima Yakima, Washington (July 10, 2000) Disadvantaged Business Enterprise (DBE) Participation The Disadvantaged Business Enterprise (DBE) requirements of 49 CFR part 26 apply to this contract. The requirements of this contract are to report what is accomplished to enable the Contracting Agency to track achievement. No preference will be included in the evaluation of bids /proposals, no minimum level of DBE participation shall be required as a condition for receiving an award and bids /proposals will not be rejected or considered non- responsive on that basis. DBE Goals No DBE goals have been assigned as a part of this contract. Affirmative Efforts to Increase DBE Participation Contractors are encouraged to: 1. Advertise opportunities for Subcontractors or suppliers in a manner reasonably designed to provide DBEs capable of performing the work with timely notice of such opportunities. All advertisements should include a provision encouraging participation by DBE firms and may be done through general advertisements (e.g., newspapers, journals, etc.) or by soliciting bids /proposals directly from DBEs. 2. Utilize the services of available minority community organizations, minority Contractor groups, local minority assistance offices and organizations that provide assistance in the recruitment and placement of DBEs and other small businesses. 3. Establish delivery schedules, where requirements of the contract allow, that encourage participation by DBEs and other small businesses. 4. Achieve DBE attainment through joint ventures. DBE Participation When a DBE participates in a contract, only the value of the work actually performed by the DBE will be counted. 1. Count the entire amount of the portion of the contract that is performed by the DBE's own forces. Include the cost of supplies and materials obtained by the DBE for the work of the contract. Include supplies purchased or equipment leased by the DBE. Exclude supplies and equipment the DBE Subcontractor purchases or leases from the Contractor or its affiliate. 2. Count the entire amount of fees or commissions charged by a DBE firm for providing a bona fide service, such as professional, technical, consultant, or managerial services, or for providing bonds or insurance, provided the fees are reasonable. 3. When a DBE subcontracts part of the work of its contract to another firm, the value of the subcontracted work shall be counted if the DBE's Subcontractor is also a DBE. The work that a DBE subcontracts to a non -DBE firm does not count as participation. 33 CITY HALL RENOVATIONS City of Yakima Yakima, Washington DBE Prime Contractor A DBE prime Contractor shall only count the work performed with its own forces as well as the work performed by DBE Subcontractors and DBE suppliers. Joint Venture When a DBE performs as a participant in a joint venture, only count that portion of the total dollar value of the contract equal to the distinct, clearly defined portion of the work that the DBE performs with its own forces. Commercially Useful Function You may count expenditures to a DBE Contractor if the DBE is performing a commercially useful function on that contract. 1. A DBE performs a commercially useful function when it is responsible for execution of the work of the contract and is carrying out its responsibilities by actually performing, managing, and supervising the work involved. To perform a commercially useful • function, the DBE must also be responsible, with respect to materials and supplies used on the contract, for negotiating price, determining quality and quantity, ordering the material, installing (if applicable) and paying for the material itself. 2. A DBE does not perform a commercially useful function if its role is limited to that of an extra participant in a transaction, contract, or project through which funds are passed in order to obtain the appearance of DBE participation. 3. A DBE does not perform a commercially useful function if it fails to exercise responsibility with its own work force for at least 30 percent of the total cost of its contract. Trucking Use the following factors in determining whether a DBE trucking company is performing a commercially useful function: 1. The DBE must be responsible for the management and supervision of the entire trucking operation for which it is responsible for on a particular contract, and there cannot be a contrived arrangement for the purpose of meeting the DBE goals. 2. The DBE must itself own and operate at least one fully licensed, insured, and operational truck that is used on the contract. 3. Credit towards project goals for DBE trucking firms who do not own at least one truck, will be granted only for the fees the DBE firm retains for providing the hauling service. 4. In order for DBE project goals to be credited, DBE trucking firms must be covered by a subcontract or a written agreement approved by WSDOT prior to performing their portion of the work. 5. DBE trucking firms are required to perform at least fifty percent (50 %) of the work with his /her own trucks and personnel. 6. DBE trucking firms may utilize owner /operator trucks. The number of owner /operator trucks may not exceed any limitations on subletting or reassigning the work specified. All owner /operators must appear on the DBE Contractor's or DBE Subcontractor's payroll designated as owner /operator. The hours worked or wages paid may be reflected either on the payroll or on the record of payments to each owner /operator. 34 CITY HALL RENOVATIONS City of Yakima Yakima, Washington 7. DBE trucking firms may lease or rent trucks from other sources, except from prime Contractors to whom they are Contractors, provided: a) A written valid lease /rental agreement on all trucks leased or rented is submitted to the project manager prior to the beginning of work; and b) Only the vehicle (not the operator) is leased or rented. c) The agreement must include the lessors name, trucks to be leased, and agreed upon amount or method of payment (hour, ton or load hauled). d) All lease agreements shall be long -term agreements, not project -by- project. The DBE is limited to leasing or renting two (2) additional trucks for each truck owned by the DBE trucking firm. Expenditures with DBEs Expenditures with DBEs for materials or supplies shall be counted as provided in the following: Manufacturer • If the materials or supplies are obtained from a DBE manufacturer, count 100 percent of the cost of the materials or supplies. Regular Dealer 1. Counting If the materials or supplies are purchased from a DBE regular dealer, count 60 percent of the cost of the materials or supplies. 2. Definition a) To be a regular dealer, the firm must be an established, regular business that engages, as its principal business and under its own name, in the purchase and sale or lease of the products in question. b) A person may be a regular dealer in such bulk items as petroleum products, steel, cement, gravel, stone, or asphalt without owning, operating, or maintaining a place of business, as provided elsewhere in this specification, if the person both owns and operates distribution equipment for the products. Any supplementing of regular dealers' own distribution equipment shall be by a long- term lease agreement and not on an ad hoc or contract -by- contract basis. c) Packagers, brokers, manufacturers' representatives, or other persons who arrange or expedite transactions are not regular dealers. Purchased from a DBE With respect to materials or supplies purchased from a DBE who is neither a manufacturer nor a regular dealer, count the entire amount of fees or commissions charged for assistance in the procurement of the materials and supplies, or fees or transportation charges for the delivery of materials or supplies required on a job site, provided the fees are reasonable and typical for the services rendered. GENERAL Description A. The extent of demolition and removal work is shown on the plans and specifications. B. Owner operations will not be interrupted. Work in occupied areas will need to take place so as not to disturb occupants. C. Friable asbestos material will be removed by Owner where it conflicts with new work. Notify Owner if additional asbestos material requires removal, before proceeding with work. Ownership of materials A. Materials resulting from demolition work shall become the property of the Contractor and removed from the site, except as designated by the Owner. Dust control A. Prevent the spread of dust, construction debris, etc. into occupied portions of the existing buildings through the use of temporary partitions and other means deemed fit by the Engineer and Owner. B. Temporary partitions shall be in place before any demolition work is done and shall be maintained in place until all work is completed: C. Quelling dust pollution through the application of water is not acceptable. Protection A. Demolition work progress shall take into consideration the Owner's continued operation. Existing work that is to remain property of the Owner shall be protected from damage and repaired or replaced (Owner's option) at no extra cost. Existing structural elements weakened by demolition shall be reinforced as approved by the Owner. C. Provide safety barriers and equipment as required for protection of all personnel during demolition and removal. D. Maintain fire extinguishers near demolition operations for immediate use. Workers on site shall be able to operate extinguishers effectively and safely. E. Before performing demolition, verify existing structural elements will not be disturbed. The HVAC system shall provide fully ducted air supply. Remove the existing supply /return diffusers, provide new sheet metal transitions with adjustable dampers, and attach instulated flex -duct to the supply openings. The new suspended ceiling cavity may serve as a return air plenum provided all code requirements are met for this type of design. Air Distribution A. The quantity of supply diffusers and return air grilles shall be sufficient to provide even air distribution throughout the zone. They shall be located in response to the final space /plan work station layout to minimize air blowing directly on individual work stations; but in all cases, each supply diffuser shall have a service area not exceeding 250 square feet and each return air grille shall have a serving area not exceeding 1000 square feet. Ballasts shall be designed to operate on the voltage system to which they are connected, suited to, and UL listed for operating the T -8 lamps. C. Total line current harmonic distortion shall not exceed 20 %. D. Ballasts shall meet the requirements of the Federal Communications Commission Rules and Regulations, Chapter 18, Part C (RF Lighting Devices), regarding radio frequency interference (RFI) and electromagnetic interference (EMI). Lighting fixtures shall be set plumb, square, level, and in alignment and shall be secured in accordance with manufacturer's directions and approved shop drawings. B. The installation shall meet with the requirements of NFPA 70. C. Mounting heights specified or indicated shall be to bottom of fixture. The exact mounting of lighting fixture shall be approved on the job before installation is commenced and, where applicable, after coordinating with the type, style and pattern of the ceiling being installed. The absence of a particular activity under the heading "PREVAILING WAGES ARE REQUIRED FOR" does not mean that the activity is not covered. Separate Material Supplier Equipment Operator rates have been eliminated. For those cases where a production facility is set up for the specific purpose of supplying materials to a public works construction site, prevailing wage rates for operators of equipment such as crushers and batch plants can be found under Power Equipment Operators. PREVAILING WAGES ARE REQUIRED FOR: 1. Hauling materials away from a public works project site, including excavated materials, demolished materials, etc. 2. Delivery of materials to a public works project site using a method that involves incorporation of the delivered materials into the project site, such as spreading, leveling, rolling, etc. 3. The production of materials at a facility that is established for the specific, but not necessarily exclusive, purpose of supplying materials for a public works project. 4. Drivers delivering concrete into a crane and bucket, hopper of a pump truck, or forms or footings, are not entitled to prevailing wages unless they operate machinery or use tools that screed, float, or put a finish on the concrete. This position applies only to the delivery of wet concrete. It does not extend to the delivery of asphalt, sand, gravel, crushed rock, or other similar materials covered under WAC 296 -127 -018.
