The City Council met in session on this date at 1:00 P.M. in the
Conference Room of City Hall, Yakima, Washington. Council members
present were Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Carmichael,
Bruce Crest, Shirley Doty and Don Hinman. Councilman Lynn Buchanan
absent.
It was MOVED by Hinman, seconded by Carmichael that the agenda be
dispensed with and business items will be considered on a need basis:
carried, Beauchamp, Carmichael, Crest, Doty, Edmondson and Hinman voting
aye by voice vote. Buchanan absent.
City Manager Zais reported on the impact of the eruption of Mount St.
Helens has had on the City crews as far as the cleanup operation is
concerned. He stated that the emphasis is on public health from the
standpoint of water. He stated that although the Water Treatment Plant
is operating adequately, one well has been activated for a time and we'
could divert to the other three wells. He also expressed concern about
the City Sewer Treatment Plant. Dennis Bertek, Supervising Sanitary
Engineer, reported on the Wastewater Treatment Plant. He reported they
are experiencing problems with the ash and sand caning down the sanitary -
sewer lines. He advised that people are lifting the manhole covers and
putting ash into the lines. He stated the sand is getting into the
pipes causing mechanical failure with the pumps. He stated one of the
trickling filters is dawn. He reported we are continuing to treat the
sewage and dump it into the river, however, he did not know how long we
could continue this because of the sand and ash getting into the system.
He reported that staff is working with DOE and they are concerned about
the discharge into the river. He stated that emergency change orders on
the Mullen and Peter Kiewit contracts will be necessary to maintain the
equipment. He explained some of the work that will have to be done
under an emergency change order, i.e., contractor will have to undo some
work that has been done Which will allow use of the settling basin and
also request Peter Kiewit to construct a necessary lagoon and construct
'a berm containment area. He requested authorization to use emergency
purdhasing procedures. He also requested Council authorization to allow
him to sign emergency contracts and agreements with other agencies that
will assist us. It was MOVED by Hinman, seconded by Doty that the City
Manager be authorized to sign any emergency contract or procedure
involving the City during this fall out emergency. Councilman Beauchamp
requested an overview of the kinds of things this motion would cover.
City Manager Zais stated that the Wastewater Treatment facility is the
most important item to be concerned about. He reported that King
County, City of Seattle, Multnomah County and City of Portland and Fort
Simcoe and J & M Construction will be providing equipment and manpower
to aid in the cleanup. He reported on the cleanup efforts, stating that
they are concentrating on the downtown area, major arterials and the
airport. He reported that all off-duty Police Personnel are on standby.
He stated that City Hall is open for limited services; no
over-the-counter service. He reported that refuse collection may resume
at the end of the week. The transit system will operate as soon as
street conditions improve. He stated the City is still discouraging
traffic in the downtown area and encouraging businesses to stay closed
at least one more day. He stated that the City has designated several
landfill sites and any private individual may contact the Public Works
Department for these locations. He stated that the City will not be
flushing the ash into the streets and doesn't want the citizens to do
that either, as it can be harmful to the Sewer Treatment Plant.
Councilman Hinman inquired if there is a system to dispose of the ash.
Mayor Edmondson stated that citizens are asked to pile their ash on the
edge of their property and not in the street. She stated that they can
sprinkle it to keep the dust down, but they should not flush it into the
streets. Councilman Beauchamp asked how the City will pay for the
cleanup. He questioned if the City will qualify for disaster funds if
the area is declared a disaster area. City Manager Zais stated that he
is not worried about the cost right now, but about getting additional
crews and equipment into the City. He stated that until the Federal
government declares this a disaster, the City is obligated to pay for
the equipment and manpower used for the cleanup. The question was
called for the vote on the motion: carried, Beauchamp, Carmichael,
Crest, Doty, Edmondson and Hinman voting aye by voice vote. Buchanan
absent.
Mayor Edmbndson reported that the County Canmissioners have declared the
area as a disaster area and requested the federal government to do

likewise. Following discussion, it was M)VED by Beauchamp, seconded by
Carmichael that a resolution be drafted and authorize the Mayor to sign
and declare; a state of disaster in the City of Yakima: carried,
Beauchamp, Carmichael, Crest, Doty, Ednondson and Hinman voting aye by
! voice vote. Buchanan absent. City Manager Zais reported that the
Memorial Day Parade ha. been cancelled and there won't be any special
services at the caret . Lou Roederer, Code Manager,reported that the
east of First Avenue ,affic signals will be put in the flashing mode.
He stated that tempor.g stop signs have been installed where they are
needed. City Manager 4ais reported that some of the park crews will be
assisting the flagging and others are cleaning the swimming pools.
Mayor Edmondson stated that most of the sports tournaments will bP
cancelled and so wil the community forum meeting. Dick Hilligus,
Director of Parks and recreation, reported that the ballfields will be

Memorial Day and Fis er Golf Course will be open tomorrow. Mayor
Edmondson expressed con ern that since Council is urging the citizens to
stay home, then the o-rks facilities should not be opened. Following,
discussion, it was the general consensus of the Council that the parks
facilities should rem:in closed until after May 27, 1980. Mayor
Edmondson stated that Cfty Council has the authority to mandate business
closures. Council - , g-rs discussed whether or not there should be a
statement in the reso'ution declaring a disaster suggesting that the
businesses stay closed until Friday. It was the general consensus of
the Council to encour.ge the businesses to stay closed the balance of
this week, but not inilude this in the resolution and not make it a
mandate. Seeking clar fication, City Attorney Andrews inquired if the
purpose of this resolut is to set a legal and political foundation to
receive federal funds or to simply urge the community to keep traffic
off the streets until e of the City cleanup can be performed. Mayor
Edmondson stated its purpose is a combination of both of what was
mentioned. Gary Webs , Chamber of Commerce, stated that the Chamber
is anxious to cooperage with the City. He stated that the Chamber is
contemplating forming . task force to do some long range planning on has
to handle this. Tom Fi-ldstead, Fire Dept. stated that the Firefighters
are here and are willi • to assist in any way possible.
Mayor Edmondson announced that this is National Insurance Women's Week.
She also declared thal the week of May 18-24 is National,Public Works
Week. Mayor Edmondson - ounced that May 23-24 are Poppy Days, declared
by the American Legion and the American Legion Auxiliary and VFW Buddy
Poppy Days declared by e Veterans of Foreign Wars. She announced that
this event may be postooned due to the disaster.
Mayor Edmondson announced that the two Resolutions of Appreciation will
be continued for two , zeks.
Council members disc sed the appointments to the Task Force on
Hazardous Materials. ayor Edmondson reported that Reverend Howard Cole
has requested to be . sidered for a citizen at large appointment. She
reported that Wolfgant Emorzak, a chemical engineer, has submitted an
application. It was 'IVED by Crest, seconded by Carmichael to appoint

Mayor Edmondson refe ,ed to the items placed on the Consent Agenda
questioning whether -re were any additions or deletions from either
Council members or c' izens present. Councilman Beauchamp. requested
that It No. 12 be -dded to the Consent Agenda and Councilman Crest
requested that Item No. 15 be added.- Mayor Edmondson requested that
Item No. 16 be added o the Consent Agenda. City Manager Zais stated
that Item No. 16 should not be put on the Consent Agenda. Mayor
Edmondson suggested th-t Item No. 13 could be added, however, Councilman
Beauchamp stated he h., a question on that. Mayor Edmondson requested
that Item No. 17 be adged, however, Council member Doty stated she has a
question on that item. City Attorney Andrews stated that Council could
set a date of hearing for next week on Item No. 26. It was the general
consensus. of the Coungil that the addition of -Items No. 12 and 15, as
requested, be made: e Deputy City Clerk then read the Consent Agenda
items, including resolitions and an ordinance by title. It was MDVED by

It was MOVED by Beauchamp, seconded by Carmichael that the minutes of
the April 10 and 15, 1980 meetings, having been duly certified accurate
by two Council members and no one present wishing to have said minutes
read publicly, be approved: carried, Beauchamp, Carmichael, Crest,
Doty, Edmondson and Hinman voting aye on roll call. Buchanan absent.
Council members received Petition No. 961, Notice of Intention to
Commence Annexation proceedings, filed by Mantey, Inc., for property
situated south of Nob Hill Boulevard and east of So. 38th Avenue. It
was MOVED by Beauchamp, seconded by Carmichael that May 27, 1980, be set
as the time for a meeting with the initiating party who signed the
Notice of Intention to Commence Annexation Proceedings, dated May 5,
1980, the initiating party being A. E. Mantey.

D-4245, authorizing the filing of a pre-application with the Department
of Transportation for a grant to aid in financing snow removal
equipment, fencing and property acquisition, be passed: carried,

roll call. Buchanan absent.
RESOLUTION NO. D-4245, A RESOLUTION authorizing the filing of a
pre-application with the Department of Transportation, United States of
America, for a grant under the Airport and Airway Development Act of
1970, as amended.

D-4246, fixing the time of hearing on Yakima School District No. 7
Right-of-Way Vacation Petition No. 958, for June 10, 1980: carried,
Beauchamp, Carmichael, Crest, Doty, Edmondson and Hinman voting aye on
roll call. Buchanan absent.
RESOLUTION NO. D-4246, A RESOLUTION fixing the time and place for
hearing on a petition for vacation of an alley right-of-way within the
City of Yakima.
*It was MDVED by Beauchamp, seconded by Carmichael that the report on
the Fairview-Sumac Sewer Project: Utility Connections to Mobile Homes,
dated 5/16/80, be accepted and approved: carried, Beauchamp,
Carmichael, Crest, Doty, Edmondson and Hinman voting aye on roll call.

Council discussed the 1977 Audit for Community Development Block Grant -
Disallowed Costs. Councilman Beauchamp inquired if staff had
investigated a 10% allowance for indirect costs. City Manager Zais
reported that staff had made this inquiry of HUD, however, it is not
acceptable. He reported that the development of an indirect cost plan
is beyond the staff capabilities and suggested that this item be
continued. It was the general consensus of the Council to continue this

It was MOVED by Beauchamp, seconded by Carmichael that Change Order No.
1 to Contract No. 5 with Peter Kiewit and Sons on the Wastewater
Treatment Plant Construction, be approved: carried, Beauchamp,
Carmichael, Crest, Doty, Edmondson and Hinman voting aye on roll call.
Buchanan absent.
It was the general consensus of the Council to continue Item No. 16,
Consideration of Charter Amendment to Increase $2,000 Bid Limit for
Purchase of Supplies, Materials, Equipment, etc., for one week.
Referring to the engagement of professional appraisal services to
establish airport land rental rates, Council member Doty expressed
concern about the necessity of hiring this service. City Manager Zais
stated that it is essential for the purpose of satisfying the State
Auditor. It was MOVED by Crest, seconded by Doty to accept the report
and authorize staff to prepare the necessary legislation: carried,
Beauchamp, Carmidhael, Crest, Doty, Edmondson and Hinman voting aye by
voice vote. Buchanan absent.

Following the suggestion of the City Manager; it was the general
consensus of Council to continue Item No. 18, Updated Report re:
Digestive Cleaning and SludgeHauling, for one week. -

right use permits from Sundquist 'Fruit Company to Blaze Northwest
and Hollingbery Cold Storage for property at 38 1st Avenue and 316

RESOLUTION NO. D-4247, A RESOLUTION of Intention to"Create a Local
Improvement District.
It was MOVED by Beauchamp, seconded by Carmichael that Resolution No.
D-4248, authorizing the execution of an agreement with United Builders
for partial reimbursement of construction costs for a sewer line for a
portion of Block 1 and 2 of Johnson Addition, be passed: carried,
Beauchamp, Carmichael, Crest, Doty, Edmondson and Hinman voting aye on
roll call. ,Buchanan absent.
RESOLUTION NO. D-4248, A RESOLUTION authorizing the City Manager and
City Clerk of the of Yakima to execute. an agreement with United
Builders of Washington, Inc., for the partial reimbursement of
construction costs for a sewer line.

the Community 'Development Department, dated May 14, 1980 with respect to
the completion of- the work on the 1979 Paving Project - Schedule B,
Community Development Paving, performed by Superior Asphalt, be
approved, the work be accepted and payment of the final estimate as
therein set forth is hereby authorized: carried, Beauchamp, Carmichael,
Crest, Doty, Edmondson and Hinman voting aye on roll call. Buchanan

the Community Development Department, dated May 14, 1980 with respect to
completion of the work on North First Street Paving Project performed by
Yakima Asphalt Paving, be approved, the work be accepted and payment of

ORDINANCE NO. 2419, AN ORDINANCE relating to funds and accounts;
creating a Wastewater Facilities Capital Reserve Fund and designating
its purpose and source of funds, and providing the means of expenditure
therefrom; enacting Chapter 3.65, Wastewater Facilities Capital Reserve
Fund", and Sections 3.65.010, 3.65.020 and 3.65.030 thereof, as a new
Chapter and new sections of the City of Yakima Municipal Code.
Council members briefly discussed the meeting with Don Swartz regarding
Council workshop and it was the general consensus of the Council to
postpone it for a month or two and have Council member Doty reschedule
the meeting.

by Beauchamp, seconded by Carmichael that Resolution No. D-4249,
declaring a state of emergency to exist and declaring the City as a
disaster area, be passed: carried, Beauchamp, _ Carmichael,
