HomeMy WebLinkAbout10/28/1980 Adjourned Meeting 163 OCTOBER 28, 1980 STUDY SESSION The City Council met in session on this date at 1:00 P.M. in the Conference Room of City Hall, Yakima, Washington. ,Council members present were Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan, Lynn Carmichael, Bruce Crest and Shirley Doty. Council member Don Hinman present after 1:20 P.M. I. OPEN DISCUSSION FOR THE GOOD OF THE ORDER MAYOR REPORTS Mayor Edmondson announced that the waiver has been granted for the five percent franchise tax on the Cox Cablevision franchise. For the Council's information, Mayor Edmondson distributed a pamphlet regarding Referendum 38 and 39 in which she is quoted as being supportive cf the Referendum. She also reported that the Planning Commission is having problems having a quorum at their meetings and stated that three members have missed- half of the last six meetings. She inquired if Council would like to have a letter sent to them and then asked the Committee of the Council to bring a recommendation for the current vacancy. It was the general consensus of the Council to send the letters. Mayor Edmondson also reported that Don Lemon, serving on the Board of Appeals has moved outside the City limits and hasn't attended a meeting in a long time. She asked if she should send him a letter thanking him for his service and accepting his resignation. It was the general consensus of the Council to have the Mayor send Mr. Lemon a letter, as outlined. Discussion on the letter in the information packet last week from the Yakima Valley Museum and Historical Association Board regarding their offer to serve on a committee to plan Centennial celebrations. (Council member Hinman present after 1:20 p.m.) Concern was expressed by Council members Carmichael and Beauchamp that if one organization does the planning, then perhaps not all the different groups in the City would be represented. It was the general consensus of the Council to have the Mayor speak with the Museum Board and express these concerns. COUNCIL MEMBER COMMENTS Council member Carmichael asked about the rescheduling cf the joint meeting with the County Commissioners on Joint Law Facilities, wondering if December 8th is the earliest time that could be scheduled. Following discussion, it was the general consensus of the Council to reschedule the meeting, even if it means rescheduling it after the first of the year. Council member Beauchamp expressed concern about his observation that several of the City buses were accelerating too fast. City Manager Zais stated he would check on it. Having heard that the PP&L fencing project came in under estimate, Council member Carmichael inquired about the cost of the PP&L fencing project. City Manager Zais stated he would get that information. 2. UTILITIY BTLLINCZ FOR UNEXPLAINED HIGH WATER CONSUMPTION Council having requested a report on this at their 10/7/80 Council meeting, Art Zerbach, Finance Director and Walt Feser, Oistcrner Service Manager, reviewed their 10/17/80 memo.. If Council wishes to reduce the large unexplained water bills, they recommended that the average use over a year's period be computed and that amount be charged. Mr. Zerbach contented that he checked with several other jurisdictions on their policy and their policy is the same as ours. Following discussion, it was MOVED by Hinman, seconded by Buchanan to bring back the legislation regarding the damage claim submitted by Mr. Lammers and the request by Mr. Ellis and place it on the agenda. Unanimously carried by voice vote. OCTOBER 28, 1980 3. REPORT ON PARES & RECREATION 1980 BUDGET ADJUSTMENTS Dick Hilligus, Director of Parks & Recreation, reviewed his memo dated 10/24/80 on the status of his 1980 budget. He reviewed the statistics in the report, stating that the 1980 Parks & Recreation Budget may end 1980 with a $66,000 deficit. He stated that the measures taken in August to attempt to balance the budget will not cover the anticipated shortfall. He commented on the expenses incurred by his department as a result of the volcano eruption and also on the loss of revenue due to the ash. He reviewed the options listed in the report and recommended the option for an interfund loan. It was MOVED by Hinman, seconded by Crest to accept the staff recommendation at this point on Option C, but try to segregate the ash related issues as much as possible. Discussion followed and the question was called for the vote on the notion. Unanimously carried by voice vote. 4. EXECUTIVE SESSION RE PENDING AND PROSPECTIVE LITIGATION AND COLLECTIVE BARGAINING It was MOVED by Carmichael, seconded by Crest to move into Executive Session for the purpose of discussing pending and prospective litigation and collective bargaining. Unanimously carried by voice vote. BUSINESS MEETING 5. ROLL CALL At 3:00 P.M., the Council members commenced the regular meeting, Mayor Edmondson presiding, Cbuncil members Beauchamp, Buchanan, Carmichael, Crest, Doty and Hinman, and City Manager Zais and City Attorney Andrews present on roll call. 6. INVOCATION The Invocation was given by Council member Doty. 7. CONSENT AGENDA Mayor Edmondson referred to the items placed on the Consent Agenda questioning Whether there were any additions or deletions from either Council members or citizens present. Council member Doty requested that Item NO. 18 be added to the Consent Agenda and Council member Crest requested that Item NO. 19 be added. It was the general consensus of the Council that the addition of Items No. 18 and 19, as requested, be made. The City Clerk then read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Hinman, seconded by Carmichael that the Consent Agenda, as read, be passed. Unanimously carried by roll call vote. (Sdbsequent paragraphs preceded by an asterisk (*) indicate items on the Consent Agenda handled under one motion without further discussion.) 8. AUDIENCE PARTICIPATION Mary Hersey, AFSCME Union Representative, referred to an article in the 10/28/80 Yakima Herald Republic and read excerpts from it pertaining to the Parks Department budget. She read the quotes made by the City Manager regarding miscalculations of revenues in the Parks Department. She expressed her serious concerns regarding the management of the Parks Department. Mayor Edmondson commented that a budget is guesstimate. Ms. Hersey stated that every City department suffered because of the volcanic cleanup expenses and no other department gave Council a report like this one. 9. MODIFICATION OF THE OUTSIDE UTILITY POLICY EXTENSIONS Carol Darby, Director of Community Development, reviewed the thanes in the new proposed Section 3 in the Outside Utility Policy. She reviewed the possible adoption dates of the Urban 165 OCTOBER 28, 1980 Area Plan and the Zoning and Subdivision ordinances. She stated that the County has concerns regarding regional staffing and the time frame for implementing it. She distributed some background information on traditional zoning and performance standardization zoning. She suggested that Cbuncil maintain their position on the Outside Utility Policy, and at the time the Urban Area Plan is adopted and the transition plan is in place, the moratorium on the granting of outside Utilities could be lifted. Discussion followed regarding the County Commissioners' concerns about this and possible adverse consequences which may develop if the City does not extend outside utilities, - FesolUtion NO. D-4344, having been read, it was MOVED by Buchanan, seconded by Carmichael that the Resolution be passed. Mayor Edmondson II/ clarified the motion, stating that it does not include the new proposed Section 3. Carried by 5-2 roll call vote. Beauchamp and Hinman voting nay. RESOLUTION NO. D-4344, A RESOLUTION adopting a temporary policy of the City of Yakima regarding the furnishing of water and sewer utility service to property outside the corporate limits of the City. 10. REPORT ON 58TH AVENUE RETAINING WALL Carol Darby, Director of Community Development referred to her memo of 10/23/80 regarding the construction of a rock retaining wall. She reported that the proposal submitted by Mr. Pepper was for a 4 foot wall and that would not be compatible with the existing walls. She stated that Mr. Pepper was contacted for a quote for an 8 foot wall and that quote came in at approximately $8,000. In light of the budget constraints,_ City Manager Zais suggested that this it be specifically budgeted in the 1981 budget.. It was MOVED by BeaudhaMp, seconded by Hinman to defer this proposed project until next year for the 1981 budget. Unanimously carried by voice-vote: . * 11. D-4345, A RESOLUTION approving the renewal of and modification to an agreement with the United States of America, Department of Agriculture, for the lease of space in the City Central Building at the Air *12. SUPPLEMENTAL AGREEMENT WITH STATE DEPARTMENT OF HIGHWAYS FOR PARTIAL REIMBURSEMENT OF COSTS ASSOCIATED WITH THE SOUTH 48TH AVENUE BRIDGE PROJECT RESOLUTION NO. ORDINANCE AMENDING THE BUDGET AND APPROPRIATING FUNDS FOR YAKIMA VALLEY TRANSPORTATION EXCHANGE Ordinance No. 2456, amending. the 1980 budget, appropriating and transferring funds for the Yakima Valley Transportation Exchange having been read by title only previously, was passed. ORDINANCE NO. 2456, AN ORDINANCE amending the 1980 Budget for the City of Yakima; appropriating the amount of $55,448 from unappropriated money in 462-Transit Fund to Account 462.512.543.00.31.001 therein as a 1980 appropriation for the 462 Transit Fund. *16. ORDINANCE APPROPRIATING FUNDS FROM THE FIRE CAPITAL FUND FOR PAYMENT CF INSTALLATION OF CHAIN LINK FENCING AT FIRE STATION NO. 5 An Ordinance amending the 1980 Budget, appropriating funds to pay for chain link fencing at Fire Station N. 5, having been read by title only at this meeting, was laid on the table until Tuesday, November 4, 1980. *17. ORDINANCE APPROPRIATING $20,000 FROM THE CUMULATIVE RESERVE FUND FOR CAPITAL IMP/RD/EVENTS FOR AIRPORT ROOFING An Ordinance amending the 1980 Budget, appropriating funds for Capital Improvements for Airport roofing having been read by title only at this meeting, was laid on the table until Tuesday, November 4, 1980. *18. ORDINANCES ADOPTING VARIOUS UNIFORM CODES - 1979 EDITION A. ORDINANCE NO. 2457, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Building Code, 1979 Edition, Copyright 1979 by the International Conference of Building Officials, regulating the errection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures in the City of Yakima; and amending Sections 11.04.010, 11.04.020, 11.04.030, 11.04.040, 11.04.050, 11.04.060, 11.04.070, and 11.04.080, and enacting new sections 11.04.015, 11.04.025, and 11.04.027, all of the City of Yakima Municipal Code. ORDINANCE NO. 2463, AN ORDINANCE relating to buildings; adopting by reference the Uniform Code for the Abatement of Dangerous Buildings, 1979 Edition, by the International Conference of Building Officials, and making amendments thereto; defining terms; providing for the repair or demolition of dangerous buildings; .establishing procedures for recovering the cost of such repair or demolition; repealing Chapter 11.46, "Dangerous Buildings ", and Sections 11.46.010, 11.46.020, 11.46.030, 11.46.040, 11.46.050, 11.46.060, 11.46.070, 11.46.080 and 11.46.090 thereof; and enacting new Chapter 11.46, "Dangerous Buildings ", and Sections 11.46.010, 11.46.020, 11.46.030, 11.46.040, 11.46.050, 11.46.060, 11.46.070, 11.46.080, 11.46.090 -, 11.46.100 and 11.46.110, all of the City of Yakima Municipal Code. ORDINANCE CREATING A LOCAL IMPROVEMENT GUARANTY FUND ORDINANCE NO. 2465, AN ORDINANCE relating to funds and accounts; prescribing rules and regulations for the maintenance and operation of the Local Improvement Guaranty Fund of the City; and enacting Chapter 3.03, "Local Improvement Guaranty Fund ", and Sections 3.03.010, 3.03.020, 3.03.030, 3.03.040, 3.03.050, 3.03.060, and 3.03.070 as a new chapter and new sections of the City of Yakima Municipal Code. 20. OTHER BUSINESS PP &L FENCING Responding to Council's earlier question on the final contract cost for the PP &L fencing project, Dennis Covell, City Engineer, reported that the final cost was $37,000 which was below the estimate. He reported that they were able to move the fence back to try to keep all the gardens and shrubs and existing fencing in place. Carol Darby, Director of Community Development, stated that this is viewed as a temporary measure. STUDY SESSION It was the general consensus of the Council to hold the Study Sessions in the Council Chambers. 8 OCTOBER 28, 1980 APPOINTMENT TO THE PLANNING °OMISSION Following Council member Hinman's report from the Council Planning Commission Appointment Committee, it was MOVED by Hinman, seconded by Crest that the vacancy on the Planning Commission be filled by Janet Snodgrass. Unanimously carried by voice vote.
