OCTOBER 7, 1980
BUSINESS MEETING
1. ROLL CALL
The City Council met in session on this date at 1:00 P.M., in
the Council Chambers of City Hall, Yakima, Washington; Mayor
Edmondson presiding, Council members Beauchamp, Buchanan,
Carmichael, Crest, and Doty and City Manager Zais and City
Attorney Andrews present on roll call. Council member Hinman
present after 1:07 P.M.
2. INVOCATION
The Invocation was given by Council member Carmichael.
3. CONSENT AGENDA
Mayor Edmondson referred to its placed on the Consent Agenda
questioning Whether there were any additions or deletions from
either Council members or citizens present. Council member
Carmichael requested that Item No. 13 be added to the Consent
Agenda, however, City Manager Zais stated that that item
should be removed from the Agenda. Mayor Edffondson requested
that Item No. 4 be removed from the Consent Agenda. It was
the general consensus of the Council that the deletion of Item
No. 4, as requested, be made. The City Clerk then read the
Consent Agenda items including resolutions and ordinances by
title. It was MOVED by Carmichael, seconded by Buchanan that
the consent Agenda, as read, be passed. Unanimously carried
by roll call vote. (Subsequent paragraphs preceded by an
asterisk (*) indicate items on the Consent Agenda handled
under one motion without further discussion.)
4. MINUTES
Mayor Edmondson reported that on page 143 of the September 25,
1980 council minutes, it indicates that Council member Beau-
champ made a motion, and Council member Beauchamp was absent
from the meeting. The City Clerk indicated she would check
the minutes. It was MOVED by Hinman, seconded by Carmichael
that the Council minutes for September 23, 1980 and September
25, 1980, as corrected, be approved, having been certified
accurate by two Council members and no one present wishing to
have said minutes rPaa pdblicly.
5. AUDIENCE PARTICIPATION
PROCLAMATION
Mayor Edmondson proclaimed the month of October as United Way
Month. She stated that the week of October 5, 1980 is Postal
Consumer Protection Week, along with this being Consumer
Protection Week. She also proclaimed that the week of October

5th is Urban Indian Cultural Awareness Week. She announced
that Council member Hinman will be presenting the elected
officials at a special memorial for Justice William 0. Douglas
on October 16th at 3:00 p.m. at the Presbyterian Church.
CITIZEN'S CONCERN RE: WATER BILL
Jerry Ellis, 1108 Maple, spoke about his high water bill for
$76.20 compared to his normal bill of $11.00. He explained
that the water consumption previous to his high bill was 12
units or 9,000 gallons. The $76.20 represents 141 units of
water or 105,700 gallons of water used. He reported that his
water meter was tested and checked out at 98% capacity. He
stated that 30 days after this bill, he had only used 8 units
of water. He reported he did use the water to do some irrigat
ing, but estimates usage for about 10 to 12 hours. he would
be willing to pay for 18 or 19 units. City Attorney Andrews
explained the damage claim process and commented that Mr.
Ellis is now at the point where he would be if his damage
claim would have been denied and he was appealing that dec-
ision. Council members discussed this dilemma and several

Council members then expressed concern about the damage claim
on this agenda which was denied and was also for an un-
- r‘ explained high water bill: *-:Following discussion, it was MOVED
by crest, seconded by Doty to have staff lock at this and come
up with recommendations on how to address this type af situa-
tion. Unanimously carried by voice vote. It was determined
that Mr. Ellis has until OctOber 26th to pay half his water
bill and the balance by November 26th to avoid discontinuance
of service and the staff should be able to respond to Coun-
cil 's request by that time. It was MOVED by Doty, seconded by
Crest to reconsider the denial of the Frederick Lammer's
damage claim. Unanimously carried by voice vote. It was the
general consensus of the Council that if Mr. Lammer's bill has
not been paid, to contact him and use the same method used for
Mr. Ellis.
CHINOOK TCWERCCCUPANCY
Referring to an article and subsequent editorial in the Herald
Republic newspaper, the City Manager stated he objected to the
information errors Which had been made, regarding occupancy af
the Chinook Tower. City Manager Zais went on to explain that
he believed the actions taken in this instance were proper
under the circuffstances. Basically, the two businesses in-
volved would have suffered significant financial loss due to
erroneous info/nation supplied to them by the building owner.
If the City had maintained a very strict enforcement pro-
_ Cedure, no relief would_ have been available. He further
-explained that a "Hold Harmless" agreement had been concluded,
r!f _riAlidhreleased the City from liability imthe event of damage
or injury prior to issuance of a certificate of occupancy.
Furtheiffore, it was reremphasized to the building owner that
no further occupancy af the building would be permitted.
Referring specifically to the aforementioned newspaper items,
the City Manager stated that he had not issued any order to
close the files on the matter, but that his assistant, Larry
Wittenberg, had done so. In light of the circumstances, he
found Mr. Wittenberg's actions to have been justified as he
was not familiar with the history of the situation, nor had he
been involved in the decision. It was his estimate that a
better examination of the facts could be had after the return
of the City Manager.
6. REPORT ON 1980 CENSUS
Carol Darby, Director of Community Development, referred to
her 10/3/80 letter to the Regional Census Center and commented
that the letter indicates the City is asking than to keep the
file open. It was MOVED by Carmichael, second by Crest to
accept the report form Community Development re Census.
Unanimously carried by voice vote.

II/ 7. REPORT ON COMPUTER SYSTEM FOR DEPARTMENT CF COMMUNITY DEVELOPMENT
The 9/25/80 staff_ report was discussed_regarding the mini-
computer system for the Community Development Department.
Carol Darby, Director of Community Development, explained that
if this is approved they will develop detailed specifications
and request bids before purchasing this computer. Discussion
followed on the coordination of the various computers operated
by the City and how this computer would-correlate with them.
Ms. Darby reported that there is (programs) software available
to make it compatible with the other computers. She stated
they are looking at having the capablility af connecting to
the City system in about one or two years. Assistant City
Manager Wittenberg reported that he intends to have a com-
mittee formed consisting of selected department heads and the
Information Systems Manager to explore all options including
distributed processing versus centralization within the City.
Following discussion, it was MOVED by Hinman, seconded by
Crest to accept the staff report and authorize staff to pro-
ceed as outlined. Unanimously carried by voice vote.

*8. AMENDMENT TO "RULES CF PROCEDURE CF YAKIMA CITY COUNCIL"
RESOLUTION NO. D-4335, A RESOLUTION amending "Rules of Pro-
cedure of Yakima City COuncil".
*9. MEMORANDUM CF UNDERSTANDING WITH LOCAL 1122 CF AFSCME UNION RE:
PAYMENT CF PHASE IV RETROACTIVE PAY TO CERTAIN CITY EMPLOYEES
RESOLUTION NO. D-4336, A RESOLUTION declaring January 1, 1979
as being the effective date for salary adjustments for certain
City employees, and authorizing and directing the City Manager
and City Clerk of the City of Yakima to execute a Memorandum
of Understanding with Local 1122 aE the Washington State
Council of County and City Employees, AFSCME, regarding the
the effective date cf those salary adjustments.
*10. ESTABLISH BUS ROUTES AND SCHEDULES FOR THE CITY'S PUBLIC TRANSPOR-
TATION SYSTEM
RESOLUTION NO. D-4337, A RESOLUTION establishing bus routes
and schedules for the public transportation system operated by
the City cf Yakima.
*11. "REINSTATMENT AND EXTENSION AGREEMENT; RE: AIRPORT LEASE AND USE
AGREEMENT" WITH HUGHES AIR CORPORATION
RESOLUTION NO. D-4338, A RESOLUTION authorizing and directing
the City Manager and City Clerk aE the City of Yakima to
execute a "Reinstatement and Extension Agreement; re: Airport
Lease and Use Agreement" with Hughes Air Corp., d/b/a Hughes
Air West.
*12. DISPOSITION CF DAMAGE CLAIM
RESOLUTION NO. D-4339, A RESOLUTION authorizing payment of
$152.88 to Richard B. Jarmo in settlement aE a claim for
damages filed with the City cf Yakima.
13. ITEM REMOVED FROM AGENDA
*14. ORDINANCE CREATING A WASTEWATER FACILITIES CAPITAL RESERVE FUND
ORDINANCE NO. 2454, AN ORDINANCE relating to funds and ac-
counts; creating a Wastewater Facilities Capital Reserve Fund
and designating its purpose; and amending Section 3.65.010 af
the City cf Yakima Municipal Code.
*15. FIRST READING CU APPROPRIATION ORDINANCE RE PAYMENT CU CARPET IN
CAPITOL THEATRE AND FOR AIRPORT LEASE NEGOTIATIONS
An Ordinance amending the 1980 Budget, appropriating, trans-
ferring and reappropriating money for payment of carpet in the
Capitol Theatre and for Airport Lease negotiations, having
been read by title only at this meeting, was laid on the table
for two weeks or until Tuesday, October 21, 1980.
16. OTHER BUSINESS II/
APPOINTMENT CF MEMBER TO AIRPORT ADVISORY COMMISSION
Mayor Edmondson reported that the Council Committee is rec-
cmmending that Warren K. Hilliard, Jr. be appointed to the
Airport Advisory Commission and gave a brief background report
on Mr. Hilliard's experiences and qualifications. It was
MOVED by Doty, seconded by Crest that Mr. Hilliard be ap-
pointed to the Airport Advisory Commission. Unanimously
carried by voice vote.
EXECUTIVE SESSION
It was MOVED by Buchanan, seconded by Carmichael to go into
0 Executive Session for the purpose cf discussing collective
bargaining and then immediately adjourn the meeting. Un-
animously carried by voice vote.

Items of information supplied to Council were: Letter from
Executive Board for Broadway Elementary School re traffic/
pedestrian problem along Washington Avenue. 9/19/80; memo
from City Attorney re damage claims referred to insurance
carriers. 10/1/80; Yakima Fire Department Emergency Activity
Report for September 1980; and agenda for 10/7/80 Planning
Commission neeting.
17. ADJOURNMENT
Following the completion cE the Executive Session and there
being no further business to come before the Council, it was
MOVED by Crest, seconded by Doty that this meeting be adjourn-
ed at the hour cE 2:19 P.
