HomeMy WebLinkAbout08/26/1980 Adjourned Meeting 119 AUGUST 26, 1980 The City Council it in session on this date. at 1:00 p.m. in the Conference Room of City Hall, Yakima, Washington. Council members present were_Mayor Betty L. Edmondson, Henry Beauchamp, Lynn Buchanan, Bruce Crest, Shirley Doty and Don Hinman. Lynn Carmichael absent. Mayor Edmondson reported that the Committee of the Council on vacancies on)mards and commissions (Crest, Buchanan and Ednondson), net and she is reporting that there are three vacancies on the Airport Advisory - Commission and they are recommending the appointment cf Russell Love, retired air'traffic controller, to fill the unexpired term_cf Don Erick. It was MOVED by Doty, seconded by Beauchamp to accept the reccmuendation CE the Caumittee and appoint Russell Love to fill the unexpired term of Don Enerick on the Airport Advisory Commission: carried, Beauchamp, Buchanan, Crest, Doty, Edmondson and Hinman voting II/ aye by voice vote. Carmichael absent. Council nembstudents er Beauchamp reported that several s have told him about the need for a crosswalk on Spruce. There was discussion on whether it is a designated crosswalk and may just need repainting. No action was taken. There was discussion regarding the 0.3% sales tax issue Which brought out the fact that the Council members as an organized group cannot promote the passage of the issue, but can work as individuals to assist various groups. City Manager Zais reported that the City staff plans to put tether 'a packet of materials for general information. City Manager Zais referred to the staff report on the emergency medical services levy Which is in answer to the Cduncil request for information on this matter so that consideration might be given to this neans of increasing revenue for the 1981 Budget year. Fire Chief Carroll stated the passage of this levy would allow the use of funds for personnel costs, training, etc., which would release some general fund revenues for other public safety services. Discussion brought out that there was not much time to prepare the proper legislation to get the matter on the ballot and that there is the matter of a transit 0.3% sales levy on the ballot. Also, it is an integral part of the Master Plan and it was suggested that this might he considered along with the Master Plan. After further diScussion, it was the general consensus that this matter not be put on the ballot at this time, but that it be considered in the - 1981 or 1982 election in conjunction with the Master Plan. City Manager Zais referred to the memorandum from the Fire Chief on Emergency Coordinator (Contingency Planning), which was prepared in answer to the memo from Council member Crest expressing his random thoughts and ideas regarding the coordination of emergency preparedness for the City of Yakina. In the Immo, Chief Carroll reviewed the rather extensive efforts that have gone into emergency planning for both City and County over the years and gave his ideas on the function of an emergency coordinator. After discussion, in which Council members indicated they feel this is a very good report, it was MOVED by Crest, seconded by Doty that the City Manager be directed to appoint an emergency coordinator as outlined in this report:. carried, Beauchamp, Buchanan, Crest, Doty, Edmondson and Hinman voting aye by voice vote. Carmichael absent. Chief Carroll reported on the .Council request for information on some type of emergency warning system, stating that Bruce Belfield of the _ . Yakima Fire Department has been working in the field ce major emergency warning with the County for a number of years and has prepared a report on a County-wide basis. He explained the cost impact and stated that the City has no funds in the current budget. There was discussion and suggestions on assisting in a County-wide. emergency _services plan. Other suggestions were to escalate what sirens we have, _get assistance from neighborhoods such as setting up block captains, maintain a.24 hour weather station, use tone encoders such as those available for weather systems, etc. It was the general consensus of the Council that there is a heed to get Yakima Cbunty Emergency Services going and get a plan that is acceptable and useable. 120 0 AUGUST 26, 1980 There was discussion on setting a special date to review Council policy on outside utility agreenents sometime within the next several weeks. It was suggested that three or four dates during the middle or later part of September be rectmOnded and put L in the COuncil packets for consideration. The various ballot issues were mentioned and it was suggested that a - digest of the issues be furnished within the next week or two. One . issue mentioned was a possible street lighting bond issue and it was suggested that this matter be postponed until next year to be considered along with the Whole energy, issue. If there are any requests for street lighting in the meantime, it was suggested to encourage the fOrmation of an L.I.D. It was not that Carol Darby and Dennis Covell will bring a report back to Council regarding the turnouts of lights. II/ It was MOVED by Hinman, seconded. by Crest to into ExecUtive Session to discuss prospective litigation and collective bargaining: 'carried, Beaudhamp, Buchanan, Crest, Doty, Edmondson and Hinman voting aye by, voice vote. Carmichael absent. Following the completion of the Executive Session, at 3:00 p.m., the Council :withers commenced the regular meeting, Mayor Edmondson presiding, Council members Buchanan, Crest, 'Doty, Hinman and City Manager Zais and City Attorney Andrews present on roll call,. Cbuncil members Beauchamp and Carmichael absent. The Invocation was given by Mayor Edmondson. Mayor Edmondson referred to the items. placed on the Cbnsent Agenda questioning Whether there were any additions or deletions from either Council members or citizens present. _Mayor Edmondson requested that Item No. 8 be removed from the Consent Agenda. Council member Buchanan requested that' it No. 19 1E added to the Consent Agenda. It was the general consensus of the Cbuncil that the deletion of Item NO. 8 and the addition of Item No. 19, as requested, be made. The City Clerk then read the Consent Agenda items including resolutions and ordinances by title. It was MOVED by Doty, seconded by Hinman that the Consent Agenda, as read, be passed: carried, Buchanan, Crest, Doty, Edmondson, and Hinman voting aye on roll call. Beauchamp, and Carmichael Absent. Mayor Edmondson stated that the July ath minutes indicate that she was not present. She stated that she was present during the Study Session and that all statements attributed as being said by the Assistant Mayor were said by the Mayor. She also wished to correct an in the July 22, 1980 minutes on page 91. She stated that Mrs. Kim Hbrindhi of Japan wished to donate a check and did so with the help of Mrs. Sara O'Meara, Director of the International Orphan, Inc. in California. Cbuncil member Doty questioned the motion regarding the deletion of references to cats in the City animal control ordinance. City Manager Zais reviewed the discussion Which took place on July 15, 1980 and Council member DO indicated her acceptance of the minutes. Council member Hinman reported that he did not report on the number of hookups in the Fairview-Sumac area as reflected in the July 1st Council minutes. Mayor EdMondson referred this to staff to check the _tape of that Council meeting. Council member Buchanan reported that he was in attendance at the July 15, 1980 joint meeting with the Police & Fire Civil Service Commission and that information was omitted from those minutes. Council member Doty referred to the July 8th,minutes stated she could not recall making a statement about 0.2% sales tax for transit operations. She requested that the last part of the sentence be deleted and end after "0.3%- sales tax". It was MOVED ,by Hinman, seconded by Crest that the minutes of the July 1, 8, 15,_ 22 and 24, 1980 minutes, having been corrected and no one present wishing to have said minutes read publicly, be approved: carried, Buchanan, Crest, Doty, Edmondson and Hinman voting aye by voice vote. Beauchamp and Carmichael absent. Mayor Edmondson reported that the Yakima Beetles, National Legion World Champs for 1979 and nine years straight State Champions, although losing, played a tremendous game Sunday. She commended them for having been the World Series Champs. 121 AUGUST 26, 1980 Ken Cox Cable TV,.was present to respond to Council questions. CoLincil members asked questions about the completion date of construction, time lag for hooking up service to the homes and capability of" underground utilities. Mr. Schiller reported that he interprets the franchise to say that they have 12 months following the constr completion to make the connections. He reported he believes the 2,000 requests they have now for cable should be completed within the next, 60 days. He further reported that they have hired a company to start the underground work beginning next Tuesday. They plan on doing about five miles of underground with that contractor this year and have already accomplished 3 to 31/2 miles with their own crews; and have budgeted for ten miles next year. He stated that the crews are following PP&L in making the construction ;Alen they have power in an II/ area. Mayor Edmondson announced that Russell Love has been appointed to fill the unexpired term of Don Erick serving on the Airport Advisory Commission.. - *It was MOVED by DO seconded by Hinman. that the right-of-way use permit requested by Rainier National Bank located on So. lst Street and Yakima Avenue, be passed: carried, Buchanan, Crest,' Doty, Edmondson, and Hinman voting aye on roll call. Beauchamp and Carmichael absent. It was MOVED by Doty, seconded by Hinman that Resolution No. D-4313, authorizing the amendment of the total amount cf the City Treasurer's change fund, be passed: carried, Buchanan, Crest, Daty,'Fdmondson and Hinman voting:aye on roll call. Beauchamp and Carmichael absent. RESOLUTION NO. D-4313, A RESOLUTION amending Resolution No. D-3959, adopted September 5, 1978 and - authorizing the existence cf a City Treasurer's Change Fund and other petty cash funds, within' the General Fund of the City of Yakima. *It was MOVED by Doty, seconded by Hinman that the report on the status of interfund loans, dated 8/20/80, be approved: carried, Buchanan, Crest, Doty, and Hinman voting aye on roll call. Beauchamp and Carmichael absent. *It was MOVED by Doty, seconded by Hinman that the report of the Director of Com/unity Development dated 8/19/80 with respect to the completion of the Moose Lodge Water L.I.D. No. 1029, contract performed by Skyline Construction, Inc., be approved, the work be accepted and payment of the final estimate as therein set forth is hereby authorized: carried, Buchanan, Crest, Doty, Edmondson and Hinman voting aye on roll call. Beauchamp and Carmichael absent. It was MOVED by Doty, seconded by Hinman that ResolUtion No. D-4314, denying the claim of David R. Coombs, for damages which occurred when the City Utility Accounts allegedly overcharged him, be passed: carried, Buchanan', Crest, Doty, EdmondSon and Hinman voting aye on roll II/ call. Beauchamp and Carmichael absent. RESOLUTION NO. D-4314, A RESOLUTION denying the claim of David R. Coombs filed with the City of Yakima on August 12, 1980. It was MOVED by Doty, seconded by Hinman, that Resolution No. D-4315, denying the claim of Charlotte E. Faulconer for damages which occured When the undercarriage of her automobile was damaged by a manhole cover, be passed: carried( Buchanan, Crest, Doty, Edmondson and Hinman'voting aye on roll call. Beauchamp and Carmichael absent. RESOLUTION NO. D-4315, A RESOLUTION denying the claim of Charlotte E. Faulconer filed with the City of Yakima on July 10, 1980; Referring to the report on granting a Cable TV franchise for territory annexed into the City to Yakima, Valley Cablevision, Carol Darby, Director of Community Development, stated that she did not expect Council to make a decision on this today. She reported that it will come back to Council next week. She briefly reviewed the material distributed to Council which includes a staff report, application, draft franchise ordinance and attachnvnts.. Mayor Edmondson inquired if there will be a definite boundary served by Yakima Valley Cablevision and a definite boundary'served by Cox Cable so the people in those areas won't 122 AUGUST,26, 1980 have a choice. Miss Darby stated that if the line in the service area belongs to Yakima Valley Cablevision, then Yakima Valley Cablevision will be expected to serve that area unless there is an agreement made between the two companies. She reported that she negotiated some additional dollars to be used to fund one half a staff person to administer it. She stated that a 5% franchise fee is proposed and a waiver will be submitted to FCC. Larry Wittenberg, Assistant City Manager, referred to his memo to City Manager Zais. re: Yakima Air Terminal Rates and Charges, stating that this is presented to Council to obtain guidance to staff. He reported that staff is recommending a rate of 4 per square foot based upon an independent appraisal .completed by Ralph Korn. He stated that the Airport Advisory Commission Made a recomtendation at their July meeting for a 2.5 per square foot rate per year for fixed based operators. Council member Hinman expressed concern about the problem for the FBO in passing on the increased rental rate from 1 to 4 per square foot to the consUter. He suggested making this increase gradually throughout t, the next two to four years. Assistant City Manager Wittenberg stated that since the appldisals have been obtained, it could be considered a gift of public funds if the rental rate is less than market value. Mayor EdmOndson expressed concern about disdussing that could possibly, affect another entity and inquired if this has been discussed with the COunty. She stated that the City has asked Yakima County for assistance in funding the Airport operation. City Manager Zais stated that it is still a City operation and we have the obligation to negotiate these leases. He stated he would be happy to review the contents of the leases and the status of the leases with the County. Following discussion, it was MOVED by Crest, seconded by Hinman to postpone discussion on this for two weeks for the opportunity to get input from the County Commissioners: carried, Buchanan, Crest, Doty, Edmondson and Hinman voting aye by voice vote. Beauchamp and Carmichael absent. It was MOVED by Hinman, seconded by Crest that Ordinance No. 2440, providing for an agreement and specifying fees and licenses to operate an autotobile rental business at the Yakima Air Terminal, be passed: carried, Budhanan, Crest, Doty, Edmondson and Hinman voting aye on roll call. Beauchamp and Carmichael absent. *It Was MOVED by Doty, seconded by Hinman that Ordinance NO. 2441, an Ordinance, prohibiting parking on Arlington Street, be passed: carried, Buchanan, Crest, Doty, Edmondson and Hinman voting aye on roll call. Beauchamp and Carmichael absent. ORDINANCE NO. 2441, AN ORDINANCE relating to traffic control, prohibiting parking at all tines on certain streets within the City of Yakima; and amending Section 9.50.500 of the City of Yakima Municipal Code. An Ordinance amending the 1980 Budget, appropriating funds to provide for payment of consulting services, travel expenses and a postage meter, having been read by title only at this meeting, it was MOVED by Doty, II/ seconded by Hinman that this be tabled for one week or until September 2, 1980: carried, Buchanan, Crest, Doty, Edmondson and Hinman voting aye on roll call. Beauchamp and Carmichael absent. City Manager Zais reported that the State Treasurer's Office announced today that there is $25 million that is now available to local govern- ments that were impacted by Mbunt St. Helens volcano. They have agreed to accept or purchase from us the outstanding warrants Which total $1.3 million and carry those at no interest until they are redeemed by the Federal GOvernment. This will save the City somewhere between $30,000 and $40,000. Council member Hinman stated that he received an application for the Planning Commission from a person who resides in Seidl'. He asked if that was a problem. Several of the Council members indicated that a person serving on a board or commission should reside in the City. Items of information supplied to Council were: letter to George Kapellas, Diamond Cab Company in response to his 8/1/80 letter and 8/19/80 appearance before the City council re enforcement of taxi cab ordinances. 8/22/80; memo from Fire Chief Ed Carroll re warning sirens. There being no further business to crane before the Council, it was MOVED by Buchanan, seconded by Doty that this meeting be adjourned at the hour of 4:10 p.m.: carried, Buchanan, Crest, Doty, Edmondson and Hinman voting aye by voice vote.
