STUDY SESSION
The City Council net in session on this date at 6:30 P.M. in the Council
Chambers of City Hall, Yakima, Washington. Council members present were
Mayor Lynn Carmichael, Clarence Barnett, Henry Beaudhamp, Lynn Budhanan,
Shirley Doty, and W. K. "Pete" Moore. Council member Jack Sparling
absent.
1. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
Mayor Carmichael reported she had received a telephone call
fran a citizen expressing concern about the number of vendors
along the Sunfair Parade, Who were causing some trouble.
City Manager Zais stated that in the information packet there
was a letter sent to the Chairmen of the Visitors & Convention
Center and the Capitol Theatre Corporation regarding the
resignation of Forbes Rogers, Manager of the Capitol Theatre.
II/ He stated that in the letter he proposed an alternative
management for those facilities. He stated it is important
that the V & C and CTC Board representatives meet with City
representatives to discuss this concept. Following
discussion, it was the general consensus of the Council that
Mayor Carmichael and council member Moore be the Council
representatives to meet with representatives of those
organizations at a time to be scheduled by the City Manager.
2. REPORT ON 1983 BUDGET FORECAST: CONTINGENCY REDUCTIONS
City Manager Zais reviewed his memo regarding the contingency
reductions for the 1983 budget. He cammented that it was
difficult to exclude reductions fran any one area and the
efforts to make these decisions were not painless. He stated
that citizen involvement is important, but staff had expressed
concern about the timing of a hearing, because of the deadline
to notify the State about the implementation of the 0.5% sales
tax. He recommended that the 0.5% sales tax be implemented at
this time to maximize the benefits of receiving an entire
year's revenue fran this source. He spoke about why this is
necessary and advised Council that if they determine during
the budget ditcussions that this tax is not necessary, the
ordinance can be repealed. Council member Barnett commented
that the citizens who have contacted him indicate they don't
Wish to see an additional sales tax imposed until they are
convinced the City has made every possible reduction prior to
imposition of the tax. He stated the need to establish a
format or process to get the message to the people. He stated
he would like to receive some information on the possibility
of using the Washington State Research Council at no charge or
for a nominal fee to see if they can help develop a format to
explain the budget to the citizenry. Discussion followed
regarding the timing of holding the hearing because of the
II/ deadline for notifying the State about imposing the sales tax
if it is to become effective in January, 1983. Mayor Carmi-
chael commented that Municipal Research can help us formulate
a format such as Council member Barnett was inquiring about.
Council member Doty stated that staff can prepare overhead
projection charts with simple explanations. Gary Webster,
Chamber of Cammerce, reported that the Washington State Re-
search Council had performed a study for the City of Spokane,
but that it was a lengthy process. He stated the Chamber has
been considering the possibility of retaining the Washington
State Research Council to develop a program to discuss the
City's budget. However, the firm had indicated they would
need 60-90 days to accomplish that task. He stated they have
looked at the 0.5% sales tax issue and have some concerns, but
haven't made a decision on it and want to review the infor-
mation in this report. Following further discussion regarding
the proposed forums to receive public input, it was MOVED by
Moore, seconded by Doty to move this discussion to Item No.
8-A on the Business Agenda. Unanimously carried by voice
vote. Sperling absent.

3. EXECUTIVE SESSION
It was MOVED by Doty, seconded by Buchanan to move into Exec-
utive Session for the purpose of discussing the topic of
pending litigation. - Unanimously carried by voice vote.
Sparling absent.
BUSINESS MEETING
4. ROLL CALL
At 7:30 p.m., the Council members commenced the regular meet-
ing, Mayor Carmichael presiding, Council members Barnett,
Beauchamp, Budhanan, Doty, and Moore and City Manager Zais and
City Attorney Andrews present on roll call. Council member
Sparling absent and excused.
5. INVOCATION II/
The Invocation was given by City Manager Zais.
6. OONSENT AGENDA
Mayor Carmichael referred to the items placed on the Consent
Agenda, questioning whether there were any additions or dele-
tions from either Council members or citizens present. Coun-
cil member Barnett requested that Items NO. 11 and 20 be added
to the Consent Agenda. He further requested that Item No. 18
be removed, at the request of a citizen who was unable to
attend this meeting. It was the general consensus of the
Council that the addition of Items No. 11 and 20 and the
deletion of Item No. 18, as requested, be made. The City
Clerk then read the Consent Agenda items, including resolu-
tions and ordinances by title. It was MOVED by Doty, seconded
by Moore that the Consent Agenda, as read, be passed. Unan-
imously carried by roll call vote. Sparling absent. (Subse-
quent paragraphs preceded by an asterisk (*) indicate items on
the Consent Agenda handled under one motion without further
discussion.)
*7. MINUTES
The Council minutes of September 21 and 28, 1982 were ap-
proved, having been duly-certified accurate by two Council
members and no one present wishing to have said minutes read
publicly.
8. CURRENT STUDY SESSION ITEMS
ITEM NO. 2
Prefacing his motion to ensure that a public forum will be
held on the budget within a 2-3 week period, it was MOVED by
Moore, seconded by-Beaudhamp to hold a public forum for the
purpose of discussing the imposition of a 0.5% sales tax and
that the meeting be held on October 28th in the Capitol Thea-
tre or YakiMa Center, whidheVer is available. Unanimously
carried by voice vote. Sparling absent. It was MOVED by
Moore, seconded by Doty to authorize staff to prepare the
proper legislation to implement the 0.5% sales tax so it can
be acted upon on the 26th, with the understanding that the
final action would be predicated on the reaction of the people
at that public forum. City Manager Zais and City Attorney
Andrews assured the Council that the ordinance can be repealed
anytime before the beginning of the year should they determine
the tax is not necessary. The question was called for the
vote on the Motion. Carried by 5-1 voice vote. Buchanan
voting nay. Sperling absent.
9. AUDIENCE PARTICIPATION
Stan Lodhrie, Chairman of the Parks & Recreation Commission,
addressed the Council about the concerns the Commission has
towards the contingency reductions planned for the Parks &

Recreation Department. He emphasized the fact that several of
the reductions would eliminate certain programs which are
viewed by the Commission as being critical to the survival of
the Parks Department. He canmented that before the 7.4%
reduction, at zero increase fran last year's budget, the
budget was actually reduced by 7 to 10 percent due to the
inflation factor. He stated the Commission is also concerned
about the loss of their director and the talk about moving the
Parks facility to the City Shops. Council member Beauchamp
stated he also has a concern about the closure of Miller Pool,
if the $67,000 loan is not forgiven and asked where that
suggestion originated. City Manager Zais stated that he gave
a dollar amount to his staff and asked them to determine where
11/ reductions could be made. He stated that when the Parks Dept.
budget was discussed, a couple of the members of the Parks &
Recreation Commission were invited to attend that session. He
further commented that the move of the Parks facility to the
City Shops is still a concept which would not take place until
next January.
Bill Crawford, representative of the Fire Fighters Asso-
ciation, spoke about the duties of the fire fighters and haw
the Department would be impacted by the contingency reduc-
tions. He commented that to lower the manpower and close a
station would greatly reduce the protection of the City. He
stated the Union urges the Council to pass the 0.5% sales tax.
Mayor Carmichael urged both gentlemen to attend the public
forum.
10. PRESENTATION REGARDING CABLE TV PRCGRAMMING
Don Brule, 9 No. 65th Avenue, member of an informal Steering
Committee which was formed in February after Escapade was
aired, stated they are presenting a five-point program for
Council to consider adopting, delineated in their letter of
October 7, 1982. Sister Janice Burke, Superintendent of the
Yakima Diocese Catholic Schools, requested Council to assist
them in bringing quality TV viewing back into the Yakima
Valley. She stated she feels her rights have been violated by
Cox bringing this type of programming into her home and being
required to make a special call to them to have the audio
detuned and the picture scrambled. Reverend Dale Carpenter,
Pastor of the Stone Churdh, spoke against this type of pro-
gramming and hcw it effects the quality of life in our corn-
munity. He spoke about the moral basis for our country being
based on Christianity and urged the Council to listen to %hat
he believes is the voice of the majority. Dr. Dean Starr,
Superintendent of Yakima School District No. 7, spoke about
the concerns of the School Board, teachers and parents regard-
ing the effect this type of programming is having on the
children. He further stated that this programming is contrary
to the school's program on sexuality. He urged Council to
consider this five-point prcgran. Mr. Brule submitted a
petition which he said contains 3,000 signatures opposed to
Escapade. He stated he would like to go on record as
volunteering to help the Council in any way to reverse this
kind of program being aired in Yakima. Council member
Beauchamp commented that he is concerned about this type of
programming, and is against it, and suggested that a stand be
taken even if it is not advisable from a legal standpoint.
Mayor Carmichael pointed out that several of the signatures on
the petition are not within the City limits and not even from
the Yakima area. John Kabrich, Yakima resident, stated that
if the people don't want Cox, with their resent prograruning,
then all they have to do is quit subscribing to it. He
commented that the United States was built on a private
enterprise system and that government needs to be kept out of
private enterprise. Bruna Carstens, 6010 Lincoln, spoke
against this type of programming being available in Yakima.
She further commented that Spotlight is bad enough, showing
R-rated movies during the afternoon and early evening hours.
Phil Weivoda, 7601 W. Nob Hill Blvd., commented that he
believes cable TV was allowed to cane here based on the belief

that they would not air obscene material. Following
discussion, Mayor Carmichael stated that Council would take
this under advisement and thanked the citizens for bringing
this concern to the Council.
*11. THIRD QUARTER REPORT ON REVENUES AND EXPENDITURES FOR 1982
The third quarter report of revenues and expenditures for
1982, was accepted and approved.
*12. LICENSE RENEWAL TO USE THE MARINE RESERVE CENTER
RESOLUTION NO. D-4718, A RESOLUTION authorizing and directing
the City Manager and City Clerk of the City of Yakima to
execute a license agreement with the United States of America,
Department of the Navy.
*13. RATIFICATION OF YAKIMA AIR TERMINAL BOARD'S ACCEPTANCE OF FEDERAL
AVIATION ADMINISTRATION GRANT FUNDS
RESOLUTION NO. 4719, A RESOLUTION authorizing, ratifying and
adopting an application for federal assistance, and assurances
made therein, by the Yakima Air Terminal Board.
*14. DISPOSITION OF DAMAGE CLAIM
RESOLUTION NO. D-4720, A RESOLUTION authorizing payment of
$195.00 to Linda K. Smith in settlement of a claim for damages
filed with the City of Yakima.
*15. ODNTRACT WITH NATIONAL ADVERTISING COMPANY FOR TRANSIT ADVERTISING
RESOLUTION NO. D-4721, A RESOLUTION authorizing the execution
Of a contract with National Advertising Company for Transit
advertising.
*16. RIGHT-OF-MY USE PERMIT FOR THE YAKIMA MALL
The Right-of-Way Use Permit requested by the Yakima Mall was
approved.
*17. SET DATE OF HEARINGS
A. Octcber 26, 1982 was set as the date of hearing on a major
modification-of a-planned development - requested by Burd & Burd
for prcperty located at 105 W. Washington Ave.
B. October 26, 1982 was set as the date of hearing for a rezone
requested by Gerald Gipson for property in the 600 block of S.
3rd St.
18. OUT-OF-STATE TRAVEL MR JOHN FISHER AND COLIN ONSTAD
Council member Barnett stated that Ines Rice asked him to
voice her opposition in allowing out-of-state travel during
the time when the City is short of funds. It was MOVED by
Moore, seconded by Buchanan to authorize the out-of-state
travel for John Fisher and Colin Onstad, Sewer Division, to
attend the Annual Convention of the Pacific Northwest Pollu-
tion Control Association in Vancouver, B.C. at a cost to the
City of $704; $300 of which is being funded by EPA. Following
discussion, the question was called for the vote on the not-
ion. Unanimously carried by voice vote. Sparling absent.
*19. AN ORDINAWE APPROPRIATING FUNDS TO THE VDLCANO EMERGENCY FUND
(First Reading)
The Ordinance appropriating funds to the volcano emergency
fund, having been read by title only at this meting, was Laid
on the table for one week or until October 19, 1982.

*20. AN ORDINANCE REGULATING INDUSTRIAL WASTE SEWER USE AND PROVIDING
FOR DISPOSAL OFSEPTAGE WASTE MATERIAL
ORDINANCE NO. 2641, AN ORDINANCE relating to public services
and utilities; regulating industrial waste sewer use; pro-
viding for disposal and treatment of septage waste material at
the Wastewater Treatment Plant; repealing Chapter 7.16,
"Industrial Waste Sewer Use", and Sections 7.16.010, 7.16.020,
7.16.030, 7.16.040, 7.16.050 and 7.16.060 thereof;-repealing
Subsection 7.60.020D; amending Subsection 7.62.050H, and
enacting Chapter 7.63, "Septage Waste Disposal" and Sections
7.63.010, 7.63.020, 7.63.030, 7.63.040 and 7.63.050 as a new
chapter and new sections, all of the City of Yakima Municipal
II/ Code.
21. OTHER BUSINESS
City Manager Zais requested additional information regarding
the public forum to be sdheduled on the budget. Following
discussion, it was the general consensus of the Council that
the forum be set for 7:30 p.m. in the Yakima Center. It was
also determined that Council members Barnett, Doty and Moore
will work with staff on the preparation of material for this
forum.
Mayor Carmichael brought up for discussion the opportunity for
Council to attend the National League of Cities conference
since it is taking place on the west coast. Council member
Barnett mentioned that he would be in San Francisco at that
time and could attend the conference, although he was not all
that interested in doing so. Following discussion regarding
the feasibility of attending this conference, it was MOVED by
Beaudhamp, seconded by Budianan to authorize the Mayor to go
to the National League of Cities conference and give Council
member Barnett permission to go there from San Francisco, if
he wants to. Carried by 5-1 voice vote. Doty voting nay.
Sparling absent.
EXECUTIVE SESSION
It was MOVED by Budhanan, seconded by Moore to move into
Executive Session for the purpose of discussing pending liti-
gation and then immediately adjourn the meeting. Unanimously
carried by voice vote. Sparling absent.
