AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated at Yakima Avenue
between North 10th and North llth Streets in the City of
Yakima, Washington, from R -3, Multiple Family Zone, to
B -3, General Business Zone.
WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 8th day of January, 1973,
upon the recommendation of the Planning Commission that real property
situated at Yakima Avenue between North 10th and North llth Streets in
the City of Yakima, Washington, the legal description of which is set
out hereinbelow, be rezoned from R -3, Multiple Family Zone, to B -3,
General Business Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the,rea-
sons that such rezoning is in accord with good planning and with the
General Plan of the City of Yakima; that the majority of property
• owners in the vicinity do not oppose the change in classification;
that the needs of the City and community do require such change and
that the highest and best use of said property is for General Business
Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the
City of Yakima that the following described real property situated at
Yakima Avenue between North 10th and North llth Streets in the City of
Yakima, Washington, and more particularly described as follows, to wit:
That portion of the northeast quarter of the northeast quarter
of Section 19, Township 13 North, Range 19, E.W.M., described as
follows:
Beginning at the point on the north line of East Yakima Avenue
which point is situate 50 feet east of the east line of Lot 1,
Larrison's Addition to North Yakima, now Yakima, as recorded in
Volume "A" of Plats, page 79; thence northeasterly along the
north line of Yakima Avenue 144 feet; thence north 9 ° 36' west
129.2 feet; thence southwesterly and parallel with the north line
of said Yakima Avenue 5.6 feet, more or less, to the southwesterly
corner of that certain tract of land conveyed to C. V. Showers and
Florence Ferne Showers, husband and wife, by deed recorded in
Volume 357 of Deeds, Auditor's File No. 958251; thence north 148.2
feet, mor' or less, to a point 215 feet south of the north line
of said subdivision; thence west 173 feet; thence south 39.4 feet;
thence west 21 feet; thence south 13 ° 35' east 168.6 feet; thence
northeasterly and parallel with the north line of said Yakima
Avenue 23.4 feet; thence south 10 ° 28' east 128.1 feet to the
point of beginning.
EXCEPT that portion if any which may lie within that certain
• tract of land conveyed to, Frank Struzik, by deed recorded in
Volume 435 of Deeds, Auditor's File No. 1159656;
be rezoned from R -3, Multiple Family Zone, to B -3, General Business
Zone, be, and the same is hereby, approved and said real property is
hereby rezoned to B -3, General Business Zone.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima County Auditor a certified copy of this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
• law and by the City Charter.
