JANUARY 28; 1974
The City Council met in session at 1:30 P.M. on this date in the Con-
ference Room at Yakima City Hall.
Councilmen present at the meeting were Mayor Bert Broad; Wray Brown;
Betty L. Edmondson; W; K- "Pete" Moore; Charles A. Rich, Don Schussler
and Bill Whitaker; '-
There was discussion of the AWC'Legislative Bulletin as it relates to
the L.E.F.F. Bill for police and fire:
City Manager McMicken-gave areport on the Fire StatiorCNo, 1 appraisal,
noting'that it mould take 60 days-and asked the Council is in favor
of a formal-appraisal. It was the consensus of Council that a
formal appraisal not be given:
A report was given by Director of Public Services, , Jack Daniel and
Ken Reed regarding the matter of airport land acquisition. They indicated
a $200,000 cost for selected parcels of land. -
At 2:30 P.M., Council members into the Council Chambers for a Press
Conference.
At 3:00 P.M., the Council members met in the Council Chambers for the
balance of the-meeting, Mayor Broad presiding,-Councilmen Brown,
Edmondson, Moore, Rich, Schussler and Whitaker, City Manager-McMicken
and City .Attorney Andrews present on-roll-call. Councilman Edmondson
requesting-permission to be excused from-the next two regular Council
meetings of February 4 and-February-11, 1974, it was MOVED by Moore,
seconded by Rich that Councilman Edmondson be excused on those dates:
carried, Broad, Brown, 'Moore, Rich, Schussler and Whitaker voting aye
by voice vote.
The Invocation was given by Councilman Brown.
Mayor Broad noted an omission in the Minutes of the previous regular'
meeting of February 21, 1974, in regard to the action taken by the
Council on the traffic diverter, and that this addition will be made
and they will be approved at-the next meeting.
This being the time 'set for the Hearing on EratitionkNo..800, filed by
Orman E. Arnold and others, requesting vacation of King Street between
Rock Avenue and Ledwich Avenue, having been continued from the previous
meeting of January 21, -1974, it was MOVED by Schussler, seconded by
Brown 'that this Hearing be continued to February 4, 1974: carried,
Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting
aye by voice vote.
This being the time set for the Hearing' on the South 3rd Avenue Improvement
Project from Nob Hill Boulevard to Division Street, Director of Public
Works, Dave Vargas, reviewed the recommendation-from the Planning
Commission 'for widening this-proposed area. With—the use of a design r
drawing, Mr. Vargas explained that four feet will be added to the
existing-street-providing for four lanes, but that no parking would
be added. He further explained-the-plans for extension of the side-
walk on -either -side of the street' and the placement of street trees
along the sidewalk. He--reviewed the increased turn radius
at intersections with the provision for ramps to kaccommodate wheel
chairs and bicycles-- He indicated a total cost of $225,000 for
project, with 90 'percent of the funding to be provided by 'Urban Arterial
Board Funds and 10 percent by the City. Mr. explained that
it will be necessary to temporarily close the street during construction,
but that provisions would be made for local traffic. He recommended
the adoption of,a,Negative Environmental Impact Statement, noting
that all authorities contacted agree that this statement is -adequate.
Those present and speaking to this matter were City Engineer Fritz
Jaeger, Tom Howell, Mrs. EverettNicholson, Mrs. W. Carson and
Mrs. Cunningham. After due discussion, it was MOVED by Schussler,
seconded by Whitaker that this Hearing be closed: carried, Broad,
Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye
by voice vote. It was MOVED by Schussler, seconded by Edmondson
that the preliminary design and cost estimate for this project be
approved: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler
and Whitaker voting aye by voice vote. It was then MOVED by Schussler,
seconded by Whitaker that the Negative Environmental Impact Statement

be adopted: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler
and Whitaker voting aye by voice vote.
Referring to the proposed Resolution concerning City employee retirement
age, City Manager McMicken explained that in 1962 the City adopted the
retirement age of 65 years while under the Statewide City Retirement
System and that later extensions were made for certain employees exceeding
that age. He further explained that the City is now under the Public
Employees Retirement System which provides for retirement at 70 years
of age but that the City prefers to keep the retirement age at 65
years and provide for extension of the retirement age on a year to year
basis if necessary. City Attorney Andrews explained the City's position
under the State Laws. After due discussion, it was MOVED by Brown,
seconded by Edmondson that Resolution No. D-3060, declaring the City's
policy concerning retirement age, be passed: carried, Broad, Brown,
Edmondson, Moore, Rich, Schussler and Whitaker voting aye on roll call.
RESOLUTION NO. D-3060, A RESOLUTION specifying the mandatory retirement
age for City employees, and repealing Resolution No. D-435, adopted
August 13, 1962, and D-1460, adopted March 23, 1970.
Chief Building Inspector, Newell Pock, explained the proposed amendment
to the Housing Code Compliance Inspection Program, noting that the
Code now provides for inspections only when there is a change of
occupancy. He explained that provision should be made for inspection
before the sale of property since there is often no change in occupancy,
as is the case with many rental properties. He reviewed the memo on
this subject dated January 2, 1974, recommending the adoption of the
proposed amendment. After due discussion, it was MOVED by Edmondson,
seconded by Brown that Ordinance No. 1615, providing for said amend-
ment, be passed: carried, Broad, Brown, Edmondson, Moore, Schussler
and Whitaker voting aye on roll call; Rich voting nay on roll call.
ORDINANCE NO. 1615, AN ORDINANCE relating to building regulations; pro-
hibiting the sale or occupancy of buildings without obtaining a Certifi-
cate of Occupancy; and amending Section 11.20.020, Subsection H-301 (b),
of the City of Yakima Municipal Code.
Training and Safety Officer, Ed Davis, reviewed the Annual Accident
Report dated January 16, 1974, and reviewed the provisions of the
Safety Training Observation Program. He referred to the material
passed to Councilmen on this subject, noting an annual cost of $220,832
for accidents in 1973. He covered the analysis made of various City
departments and results of the training program presently being carried
on.
A report having been received from the City Engineer on the completion
of L.I.D. No. 993, Englewood Heights West Domestic Water District, it
was MOVED by Schussler, seconded by Brown that February 25, 1974, be
the date set for Rearing on the assessment roll: carried, Broad, Brown,
Edmondson, Moore, Rich, Schussler and Whitaker voting aye by voice vote.
An Ordinance transferring the amount of $200,000 from Federal Shared
Revenue Funds to the Airport Improvement Fund and appropriating $20,000
within the Airport Improvement Fund for Air Terminal Parking Lot Improve-
ments, having been read by title only at the previous meeting, and being
again read by title only at this meeting, it was MOVED by Brown, seconded
by Rich that Ordinance No. 1616, providing for said transfer and appro-
priation, be passed: carried, Broad, Brown, Edmondson, Moore, Rich,
Schussler and Whitaker voting aye on roll call.
ORDINANCE NO. 1616, AN ORDINANCE transferring the amount of $200,000
from 199-Federal Shared Revenue Fund to 361-Airport Improvement Fund;
appropriating the amount of $20,000 from unappropriated money in
361-Airport Improvement Fund to Account 361.546.25.65 as a 1974
appropriation for 361-Airport Improvement Fund.

Referring to the proposed Ordinances adopting by reference 1973 Editions
of the Uniform Building, Plumbing and Mechanical Code, Chief Building
Inspector, Newell Pock, explained that these codes are updated every
three years as a result of the annual meetings of the International
Conference of Building Officials at which new requirements are intro-
duced. It was MOVED by Whitaker, seconded by Rich that Ordinance No.
1617, adopting by reference the 1973 Edition of the Uniform Building
Code, be passed: carried, Broad, Brown, Edmondson, Moore, Rich,
Schussler and Whitaker voting aye on roll call.
ORDINANCE No. 1617, AN ORDINANCE relating to building regulations;
adopting by reference the Uniform Building Code, 1973 Edition, Copy-
right 1973 by the International Conference of Building Officials,
regulating the direction, construction, enlargement, alteration, re-
pair, moving, removal, conversion, demolition, occupancy, equipment,
use, height, area and maintenance of buildings or structures in the
City of Yakima; and amending Section 11.04.010 of the City of Yakima
Municipal Code.
It was MOVED by Rich, seconded by Moore that Ordinance No. 1618, adopt-
ing by reference the 1973 Edition of the Uniform Plumbing Code, be
passed: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and
Whitaker voting aye on roll call.
ORDINANCE NO. 1618, AN ORDINANCE relating to building regulations;
adopting by reference the Uniform Plumbing Code, 1973 Edition, by the
International Association of Plumbing and Mechanical Officals; amend-
ing Section 11.44.010, 11.44.040 and 11.44.050, enacting new Sections
11.44.020 and 11.44.130, and repealing Sections 11.44.060, 11.44.070,
11.44.080, 11.44.090, 11.44.105 and 11.44.120, all of the City of
Yakima Municipal Code.
It was MOVED by Moore, seconded by Rich that Ordinance 1619, adopting
by reference the 1973 Edition of the Uniform Mechanical Code, be passed:
carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and Whitaker
voting aye on roll call.
ORDINANCE NO. 1619, AN ORDINANCE relating to building regulations;
adopting by reference, the Uniform Mechanical Code, 1973 Edition, by
the International Conference of Building Officials and the Inter-
national Association of Plumbing and Mechanical Officials, together
with "Appendix A", Uniform Mechanical Code Standards and Uniform
Building Code Standards, and "Appendix B", Steam and Hot Water Boilers,
Steam and Hot Water Piping and Fuel Gas Piping, and amending Sections
11.32.010, 11.32.040 and 11.32.060 of the City of Yakima Municipal
Code.
Petition No. 804, having been filed with the City Clerk on January 23,
1974, by Dennis Sunderland and others, requesting improvement of pro-
perty by the construction of a sewer in the vicinity of Rancho Lane,
it was MOVED by Schussler, seconded by Edmondson that Petition No. 804,
for the creation of a Local Improvement District, be referred to the
City Manager and Staff for study and recommendation: carried, Broad,
Brown, Edmondson, Moore, Rich, Schussler and Whitaker voting aye by
voice vote.
Damage Claims having been filed with the City Clerk on:
a. January 21, 1974, by Stanley Joe Carlson, 2911 Shelton Avenue,
in the amount of $104.75 for damages to his contact lenses
while on duty as a Yakima Police Officer;
b. January 23, 1974, by Steven E. Meagher, 3312 Lincoln Avenue,
in the amount of $291.17 for damages to his automobile by a
City vehicle;
c. January 22, 1974, by Mr. and Mrs. Leo Menard, 1909 Tieton
Drive, in the amount of $107.10 for damages from a City
sewer;

City Manager McMicken requesting authorization for out-of-state travel
for Parks Director, Bill Hutsinpiller, to travel to Orlando, Florida,
for the presentation of the merit award on Lions Swimming Pool, it was
MOVED by Schussler, seconded by Moore that said travel request be
denied: carried, Broad, Brown, Edmondson, Moore, Rich, Schussler and
Whitaker voting aye by voice vote.
