AN ORDINANCE relating to licenses and business regulations; prohibiting
advertising of mobile specialized emergency care service
without a license; providing for the issuance and revoca-
tion of mobile intensive care business licenses; adopting
rules and regulations governing mobile intensive care
businesses; providing a penalty for violations; and
adopting Chapter 5.09 A, "Mobile Intensive Care", con-
. sisting of Sections 5.09 A.010, 5.09A.020, 5.09A.030,
5.09A.040, 5.09A.050 and 5.09A.060, as a new chapter and
new sections of the City of Yakima Municipal Code.
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Chapter 5.09A is hereby adopted as a new chapter of
the City of Yakima Municipal Code, which new chapter shall be entitled,
and shall read, as follows:
"CHAPTER 5.09A
Mobile Intensive Care
5.09A.010 Mobile Intensive Care Business License Required—
Prohibition Against Advertising. It shall be unlawful for any
person, firm or corporation to advertise or otherwise hold itself
out to the public as offering or providing mobile intensive care
service by using the words "certified", "paramedics", "coronary
care", "heart care", "intensive care", or other words or phrases
411 of similar import calculated to denote mobile specialized emergency
care service of the nature authorized by R.C.W. 18.71.200 to be
performed by a physician's trained mobile intensive care paramedic,
without first obtaining and being the holder of a mobile intensive
care business license pursuant to this chapter.
5.09A.020 Application for License--Fee.
A. Any person, firm or corporation desiring to obtain
a mobile intensive care business license shall file with the
City Clerk an application on forms to be furnished by the
City and to contain such information as may be deemed neces-
sary by the City Clerk to administer the provisions of this
chapter.
B. An application for a mobile intensive care business
license shall be accompanied by a fee of $50 which shall
not be reimbursed regardless of whether the license is isqued.
Such license shall be valid for a period of one year from
its date of issue unless revoked as provided by this chapter.
5.09A.030 Qualifications of Applicant--Standards for I.3suirg
_
License.
A. No mobile intensive care business license shall be
issued by the City Clerk unless it appears to him, after
investigation of the qualifications of the applicant, that the
following qualificatioris of the applicant are satisfied:
1. The applicant is the holder of a valid ambulance service
business license issued pursuant to Chapter 5.09 of the
City of Yakima Municipal Code.
2. That all drivers and attendants of applicant are the
holders of valid ambulance driver and attendant permits
as required by Section 5.09.060 of the City of Yakima
Municipal Code.
3. That all ambulance attendants of applicant have been
examined and qualified as physician's :trained mobile
intensive care paramedics by the health officer of the
Yakima County Health District •or by the University of
Washington's School of Medicine or by their designated
representatives.
the investigation of the City Clerk results in
his determination that the qualifications of the applicant
are satisfied, as provided by subsection A of this section,
then the City Clerk shall issue a mobile intensive care busi-
ness license to applicant.
5.09A.040 Revocation of License.
A. The City Manager shall have the authority to revoke
any mobile intensive care business license issued pursuant to
this chapter if, after a hearing by the City Manager, any of
the following grounds are found to exist:
1. If the mobile intensive care business license was pro-
cured by fraud, or if the application therefor contains
any false statement of a material fact, or if a fact
concerning the applicant or his business was not dis-
closed at the time of his making the application when
such fact would have constituted just cause for refusing
to issue the license;

been revoked pursuant to Section 5.09.050 of the City
of Yakima Municipal Code.
3. If the licensee fails to maintain the qualifications for
the original issuance of the license as specified in
Section 5.09A.030 of this chapter.
4. If the licensee violates any provision of this chapter.
B. Any such license revocation shall be effectPd in the
manner specified by Section 5.09.050 of the City of Yakima
Municipal Code for the revocation of an ambulance service
business license; and a decision and order by the City Mana-
ger to revoke any such license shall be subject to review by
appeal to the City Council in the manner specified by Section
5.09.050 of the City of Yakima Municipal Code.
5.09A.050 Rules and Regulations. There are hereby estab-
lished the following rules and regulations pertaining to mobile
intensive care service offered or provided by virtue of a license
issued pursuant to this chapter:

1. Ambulance S,zivice Rules and Regulations Applicable.
The licensee shall comply with all rules and regulations
established by Section 5.09.130 of the City of Yakima
Municipal Code NTlicable to ambulance service, except
as any such rule or regulation may be modified by the
rules and regulations in this section.

2. Size of Patient Carrying Area, The patient carrying
area of vehicles used for mobile intensive care service
shall be constructed so as to accommodate ease of move-
ment for two attendants in a standing position with
access to the patient from both sides, and with the
distance from the floor to the top inside such patient
carrying area to measure not less than 72 inches.
3. Equipment. Vehicles used for mobile intensive care ser-
vice shall comply with requirements of Section 5.09.130
• 1 of the City of Yakima Municipal Code, and further shall
be equipped with the following additional minimum emer-
gency equipment:
a. Floodlight outside the van.
b. EKG transmitting equipment.
c. Portable heart monitor and direct current defibril-
lator capable of delivering 320 watt-seconds.
d. A device capable of transmitting EKG signals via
telephone.
e. A portable carrying device containing:
(1) oral pharnygeal airways,
(2) bag-mask rescusitative device,
(3) aspirator,
(4) equipment for endotrachial intubation,
(5) equipment for starting intraveneous infusions,
(6) blood pressure cuff,
(7) stethoscope,
110 (8) appropriate emergency drugs.
4. PerF:onnel. All mobile intensive care service vehicles
shall b manned by a crew of at least 3 persons to con-
sist of a driver and 2 attendants, both of which atten-
dants shall be certified as physician's trained mobile
intensive care paramedics as required by Secti:m.
5.09A.030 of this chapter.
5.09A.060 Penalty for Violations. Any person, firm or cor-
poration convicted of violating any provision, or failing to comply
with any requirement, rule or regulation, of this chapter, sball
be punished by a fine not to exceed $250 for each offense. Each
day of any such violation or failure to comply shall constitute a
separate offense."
Section 2. This ordinance shall be in full force and effect
C. days after its passage, approval and publication as provided by
law and by the City Charter.
