OCTOBER 21, 1974 The City Council met in session on this date at 6:30 P.M. in the Conference Room at Yakima City Hall. 1Council members present at the meeting were Mayor Bert Broad, ,Wray Brown, Betty L. Edmondson, Dick Jarms, W. K. "Pete" Moore and Charles A. Rich. ' Herb West, Executive Director, Yakima County Commission on !Alcoholism, discussed the need for a holding facility for alcoholics 'under the City-County detoxification program. In addition, he ;advised the Council of the need for transportation to bring indi- viduals into the Detox Center and recommended that the Police I/ ;Department perform that function. Judge Ray Munson discussed Ithese problems noting that there would be an immediate need by ;January 1, to decide on the facility arrangements for housing alcoholics. The Alcoholism Commission recommended that the City 'jail facility be used in such a capacity. The City Manager expressed the opinion that the transportation problems should be resolved by the Commission inasmuch as the Police Department does not have ithe man power or equipment to perform such a "taxi service". IFurthermore the question of picking up alcoholics would require 'further negotiations with the Police Department, consequently the question of facilities was the primary concern of the Council at this time. Police Chief Jack LaRue discussed these issues ;noting that the Police Department's interpretation of the original intent of the law for decriminalizing alcoholics was to relieve the Police from performing pickup and delivery for detention. Se- condly, the Chief noted that the Commission would have to defer to the possibility of overruns in the County jail which might !necessitate continued use of the City jail facilities. A require- ment for access to the City jail has been stipulated in the pro- !posed transfer of jail operations to the County. In summation, the Chief believed that the new law eliminating alcoholics, as 'interpreted by the Commission, was simply changing the form of Police procedures in this matter and not relieving the police of the responsibility. He recommended that there should be a Ifurther appraisal of this by both parties. The Council took the matter under advisement for further study by City staff. Police Chief Jack LaRue discussed the new Uniform Field Citation 'Pilot Program, wherein Yakima would institute a special program of issuing citations for misdemeanors such as fighting, riotous ;conduct, shoplifting, profanity, minors in possession of liquor, etc; instead of performing an arrest and booking procedures. This would allow for more time in the field for officers and relieve the police from conducting unnecessary and superfluous arrests. The Council will be advised of - 0e progress of this program over the next several months. The Council reviewed the proposed landscaping of 16th and Tieton/16t I/ and Nob Hill and concurred that a basic landscaping plan be con- sidered as opposed to the more expensive plan presented. A revised Icost estimate will be included in the Capital Improvement Program for 1975. ;The Council reviewed the proposed agreement with the County !Commission creating an Urban Yakima Area Joint Board and agreed with its provisions. The next action is to transmit the pro- 'posed agreement to the County Commission for their review and approval. At lAt 8:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Edmondson, Jarms, Moore and Rich, City Manager McMicken and City Attorney Andrews present on roll call. Councilman ISchussler being absent on roll call, and having requested to be excused for the remainder of October, it was MOVED by IRich, seconded by Moore that Councilman Schussler be excused for the month of October: carried, Broad, Brown, Edmondson, !Jarms, Moore and Rich voting aye by voice vote. 1 1 11111 1 9 A OCTOBER 21, 1974 The Invocation was given by Mayor Broad. The minutes of the previous regular meeting of October 15, 1974, having been duly certified accurate by two Councilmen and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. The Council having appointed Mr. Dick Jarms to the position vacated by Bill Whitaker at the previous Council meeting, City Clerk Iris Litzenberger administered the Oath of Office to Councilman Jarms at this time. This being the time set for Hearing on an Appeal of the Planning Commission's denial of a Rezone Application filed by Mr. Anthony S. Sali, for property situated near Pecks Canyon Road below Scenic Drive, Principal Planner Dick Hill reviewed the Planning Staff Report and the Planning Commission Minutes dated August 1, 1974 and October 1, 1974, respectively. He noted that I/ the application has been before the Planning Commission on two previous locations and that denial is recommended for the following reasons: 1. The placement of such a facility at this time on the fringe of the City without good access, well defined, planned streets, and no sanitary sewer service is premature development. 2. The problem of the remainder of the Planned Development and its effect on adjacent pro- perties is as yet unresolved. The applicant has stated that he has no tentative plans for the grassed area of this site. The Planning Staff questions whether consideration has been given to the what the effect of this structure and its associated traffic will be on the agri- cultural lands and residential developments located above and around it. Mr. Hill indicated that Mr. Sali requests construction of a tennis complex on the 12 acre site, requesting a rezone from R-1 to Planned Development to accomodate 9 outdoor tennis courts, 4 indoor courts and indoor handball courts. He reviewed the surrounding land use and zoning as discussed in the Staff Report. He noted that access to the facility would be of of Pecks Canyon Road and that the applicant requests the installation of septic tanks. Mr. Hill described the details for the proposed facility also discussed in the report. Mr. Jim Kennedy, representing Mr. Sali, reported that in reviewing the Planning Commission report he found no statement on environmental impact and requested that such a statement be included in any future report in order that the zoning will not be open to review by the courts. He indicated that the statements would indicate that the proposed Planned Development does not have adverse affects on the environment in question. Mr. Kennedy requested that the Council return I/ this matter back to the Planning Commission. The applicant, Mr. Anthony S. Sali, being present, reviewed several requirements of the Planned Unit Development Zone, noting that his proposal fits in with the provisions for aesthetic use of the land. He reported that the Tree Council had set up the landscaping and reviewed the proposed landscaping with the use of a design drawing. Mr. Sali stated that he would take whatever steps necessary in order to see that the open space is maintained. He discussed that fact that a water line does exist down the property but that no sewer is provided and therefore requests placement of septic tanks. Mr. Sali described the proposed building as being 33,000 square feet and 40 feet high and indicated that the building could be dropped another twenty feet but that only two persons .will be able to see the complex. Mr. Sali passed to Councilmen samples of the proposed fencing and roofing material which will be used for the complex. The Council acknowledged receipt of letters from the following persons in favor of the proposed development: Mr. C. R. Sonnabend, Mr. , and Mr. Thomas E. Dow. Letters in opposition were received 1111/ / 93 _ _ OCTOBER 21, 1974 from Mr. Ernest Falk and Mr. and Mrs. John G. Fairbrook. IThose present and speaking in favor of the rezone request were Mr. Don McGuinness, Mr. Joe Lindeman and Mr. Kent Smith. 1 Present and speaking in opposition were Mrs. Wanda Poole, !Gary Smoot, Mrs. Gary Smoot, Helen Tweedy, Margaret Weber and Mrs. Bohannon. Also present and speaking to this matter were Mr. Bill Gandy, Mr. and Mrs. Ben Dover. Councilman Edmondson iindicated she felt it to be a good project, but which in the Jong run would not prove to be a good addition and could not Iapprove a septic tank. In her opinion, the project is premature. Mayor Broad stated he felt it to be a good development, but not for those who would be viewing it from their residences I/ l and indicated his considerations to be similar to those of the Planning Commission. Councilman Jarms expressed concern for those persons living in the area and protection for their personal investments, stating opposition to the proposed development. 'After due discussion, it was MOVED by Brown, seconded by Moore that the staff be directed to prepare legislature following the recommendations of the Planning Commission for denial: carried, Broad, Brown, Edmondson, Jarms, Moore and Rich voting laye by voice vote. Schussler absent. 1 This being the time set for the Hearing on an Appeal of the IPlanning Commission's denial of a Rezone Application filed by Mr. Robert L. Suver and Mr. Paul LaChance, for property !along Naches Avenue at 6th Street between Yakima Avenue and Lincoln Avenue, Principal Planner Dick Hill reviewed the Planning Staff Report and Planning Commission Minutes dated August .1, 1974, and September 3, 1974, respectively. He indicated that the applicant requests a rezone from R-3 Multiple Family 1Zone to B-1 Modified Business Zone to accomodate location of satellite services such as insurance offices, doctor and dentist offices. He reported that the Planning Staff recommends idenial of this request for the following reasons: 1. That the rezone is inconsistent with the General Plan for the City of Yakima. 2. That the proposal is in direct opposition to the concepts of the Central Business • District Plan which discourages the un- economical "sprawl" of commercial develop- ment into the periferal areas of the Central Business District. 3. That the rezone would nullify the positive effect of the 40-foot parkway on Naches Avenue which creates a natural buffer between the com- mercial and noncommercial uses located in this portion of the City. 4. That the area for which the rezone is sought should remain classified as Multiple-Family Residential to serve the needs of people - desirous of living near the downtown area. 5. That the area is properly situated so as to support continued improvement and redevelop- ment as Multiple-Family Residential. 6. That sufficient commercial zoning already exists in the downtown area and its immediate environ to support future office development. - The applicant, Mr. Bob Suver, being present, indicated that since the last time this request was before the Planning Commission, the Yakima Mall has been constructed and is situated just 90 feet from the property in question. Mr. Robert Mills, 106 North 6th Street, cited the number of elderly persons living in the area which could 111, / 91( OCTOBER 21, 1974 - - - - - - - - be served by offices located in this area. Mr. William Filcher, 1201 North Naches, spoke in favor of the proposed rezone, citing the high cost involved in upkeep of the older homes in this location and problems with meeting City Code requirements. Mr. Harry ;Whitehead, Attorney, spoke in favor, stating that'the existing !buildings are deteriorating and an eyesore along Naches Avenue. Mr. Zimmerman also spoke in favor, citing problems incurred with ;upkeep and maintenance of older property in light of rising taxes. IThere was discussion by the Council regarding the easements of IYakima Avenue as a natural buffer between the Central Business Dis- ; itrict and the eastside residential area. Councilman Brown spoke in ! favor of rezoning the area north of Naches Avenue to B-1 inasmuch as multiple-family dwellings will fit in and would compliment the !downtown. Mayor Broad stated a desire to see the buffer line held. 'Councilman Moore spoke in favor of the rezone to B-1. Councilman 'Jams also spoke in favor of a rezone to B-1. Councilman Rich spoke to the possibility of the Planned Development'Zone for the area in ;question. After due discussion, it was MOVED by Moore, seconded by Rich that the Motion referring this matter back to the Planning ! Commission for a rehearing, be passed:. carried, Brown, Jarms, Moore and Rich voting aye on roll call. Broad voting nay on roll call. It was MOVED by Rich, seconded by Edmondson that Resolution ,No. D-3197, initiating a parking and business improvement 1 ;area, be passed: carried, Broad, Brown, Edmondson, Jarms, Moore and Rich voting aye on roll call. Schussler absent. RESOLUTION NO. D-3197, A RESOLUTION of the City Council of the City of Yakima, Washington, initiating a parking and business !improvement area within the Central Business District of the City. It was MOVED by Moore, seconded by Jarms that Resolution No. D-3198, ISection 5., be amended to read "at 3:00 o'clock P.M. on the 12th Iday of November, 1974": carried, Broad, Brown, Edmondson, !Jarms, Moore and Rich voting aye by voice vote. It was then MOVED by Moore, seconded by Jarms that Reso- lution No. D-3198 be also amended to insert the words "City !Clerk" in Section 6: carried, Broad, Brown, Edmondson, Jarms, Moore and Rich voting aye by voice vote. It was then MOVED by Brown, seconded by Moore that Resolution No. D-3198, a Resolution of intention to create a Parking and Business Improvement Area, be passed as amended: carried, Broad, Brown, Edmondson, Jarms, Moore and Rich voting aye on roll Icall. D-3200, A RESOLUTION of the City Council of the City of Yakima, Washington, providing for a public hearing on the plan for establishment of off-street parking space, improvements to pedestrian spaces and general improvements to the Central Business District of the City. Director of Management and Budget, Bob Hilsmann, briefly reviewed the proposed Collective Bargaining Agreement with the Police 1 'Patrolman's Association for 1975 and 1976, reporting an average of 9.2 per cent salary increase. It was MOVED by Rich, seconded by Moore that Resolution No. D-3201, authorizing the execution of said agreement with the Yakima Police Patrolman's AssOciation, be passed: carried, Broad, Brown, Edmondson, Jarms, Moore l and Rich voting aye on roll call. D-3201, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute ; l a Collective Bargaining Agreement with Yakima Police Patrolman's Association. City Attorney Andrews 'explained that some old documents were found which give permission for the theatre premises to encroach upon the post office property with the theatre stairs and railing, which permission should have been transferred to the City when the theatre changed ownership. . .
