HomeMy WebLinkAbout08/19/1974 Business Meeting and Adjourned Meeting 08/23/1974 AUGUST 19, 1974 The City Council met in session on this date at 6:30 P.M. in the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown, Betty L. Edmondson, W. K. "Pete" Moore, Charles A. Rich and Bill Whitaker. Mayor Broad reminded Councilmen of the Task Force meeting Tuesday evening, which both he and the City Manager will attend. The City Council took the following action re appointments to Boards and Commissions: It was MOVED by Moore, seconded by Brown that John Fairbrook and Ellis Cummins be reappointed to the Planning Commission: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote. Schussler absent. It was MOVED by Brown, seconded by Whitaker that Paul Goode be appointed to the Board of Adjustment: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote. Schussler absent. It was MOVED by Whitaker, seconded by Brown that Rolla Gould be appointed to the Police and Fire Civil Service Commission: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voing aye by voice vote. Schussler absent. City Manager McMicken advised Council members that the funeral for Emil Kissell, Parks Superintendent, would be Wednesday, August 21, at First Church of the Nazarene. City Manager McMicken discussed the proposed sidewalk ,repair pro- gram, outlined in City Manager Report No. 206. He noted that the existing approach to sidewalk repair has had many drawbacks because it has been voluntary and the City has not been able to obtain participation from property owners. The new program con- templates a mandatory program through the adoption of an Ordinance requiring property owners to be responsible for sidewalk repairs. In this context, abutting property owners would be responsible for the total expense of constructing new sidewalks one block or less in length; the total expense of repairing or reconstructing a portion of sidewalk that has been damaged by negligence, or 50 percent of the cost of reconstructing or repairing where the sidewalk is damaged by age or deterioration. The City would share the remaining 50 percent of the repair costs. Property owners who cannot afford to pay the total expense in one lump sum would be afforded the opportunity to pay over a 10-year pro- rated period. The City Engineer's office would send out formal, legal notices contacting property owners to comply with the sidewalk repairs necessary. Councilmen Brown, Edmondson and Rich expressed concern that such legal notice should be accompanied by cover letter explaining the need for repairs and property owners' obligations. Councilmen also inquired as to the delivery of these notices to property owners. City Attorney Andrews in- dicated that his understanding of State Law is that they must be hand delivered; however, he will confirm this. Street Superintendent, Doug Terry, gave a review of the capabili- ties of the street crews, emphasizing that he would work on a maintenance district basis in two districts at the same time on the east and west sides of the City. Mr. Terry also discussed the City's Perma-bind and Chip Seal maintenance programs this year, indicating preference for Chip Seal over Perma-bind for durability and longevity. 111 AUGUST 19, 1974 At 8:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Edmondson, Moore, Rich and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Schussler having requested permission to be excused from this meeting, it was MOVED by Brown, seconded by Edmondson that Council- man Schussler be excused: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote. * The minutes of the two previous regular meetings of August 5, 1974, and August 12, 1974, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. Referring to the proposed agreement with the Washington State Highway Commission for repair work in the vicinity of the City's Water Treatment Plant, City Manager McMicken reported that the line has been replaced and that the City will be reimbursed $500 for the work. It was MOVED by Brown, seconded by Moore that Resolution No. D-3171, authorizing the execution of said agree- ment, be passed: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye on roll call. Schussler absent. RESOLUTION NO. D-3171, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement with the Washington State Highway Commission for repair work in the vicinity of the City's Water Treatment Plant. Transit Manager, Bob Knight, reviewed the proposed revised sched- uling and routing of City transit service in connection with the addition of four newly purchased 45-passenger buses. Mr. Knight reported that those surveyed along the Summitview route have agreed to a change which would include Englewood Avenue between Crescent and 64th Avenues. He indicated that he would like to see one-half hour service on Summitview in the mornings and evenings. Mr. Knight further explained that the First Street route was changed when the traffic light at Walnut and South First was inactivated in connection with the Walnut Street Underpass construction. The bus route was consequently detoured on South Third Street, eliminating the section between Walnut and E. Washington on South 1st Street. He noted that most of those riding this route desire to have this be a permanent change. With the use of a route map, he explained the new scheduling and use of the four new buses on the main routes. He reported that one new bus will be used for backup. The proposed changes will be implemented September 3. It was MOVED by Whitaker, seconded by Rich that Resolution No. D-3172, revising the scheduling and routing of the City's bus service, be passed: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye on roll call. Schussler absent. RESOLUTION NO. D-3172, A RESOLUTION revising the schedule of route for the public bus transportation system operated by the City of Yakima. Mr. El Williams, Bench Advertising Company, Inc., Portland, Oregon, reviewed his proposal for installing 200-250 bus stop benches in Yakima. He explained that paid advertisements would be placed on the back panel of the benches. He passed to Council- men folders explaining his proposal and the types of advertisements accepted for display. He indicated that the main stops would be designated on the bench as bus stops. Mr. Williams covered the proposed payment plan and insurance coverages as found in his proposal and letter dated July 27, 1974. City Manager McMicken indicated that the benches would be excluded from the City's downtown core area in light of current downtown redevelopment plans. Mr. Knight reported that the buses would continue to stop at any corner as well as the main designated stops. Mr. * Inadvertently omitted above: The Invocation was given by Councilman Edmondson. I AUGUST 19, 1974 Knight spoke in favor of the bench advertising proposal. Mr. Williams indicated that his firm tries to keep benches out of main residential areas. Bob Knight reported that the present benches in use were obtained from the Odd Fellows organization and are in bad need of repair. If the new proposal were accepted, Mr. Williams would place the present 15 benches where appropriate. Councilman Rich questioned the new proposal in light of the City's Sign Code and provisions for Right-of-way Use Permits. City Manager McMicken indicated that the proposal will be considered and that Mr. Williams would be contacted on this matter. Referring to a presentation made by Mark Anderson, at the Council meeting of July 22, 1974, requesting truck traffic control on North 8th Street, Traffic Engineer Bill Stark reviewed his Memo on this subject dated August 15, 1974. Referring to the request for the installation of a traffic signal at North 8th and "B" Streets, Mr. Stark noted that a traffic count taken at this location indicates that the number of vehicles entering the intersection from both streets is below the minimum required for signalization. He further referred to the attached report from the Police Department regarding readings on the noise readings generated by the trucks. Mr. Stark indicated that the best way to eliminate the noise would be for the trucks to use another street, but this is not feasible at the present time. He noted that the existing speed is being maintained along this street, but recommended that a 25 MPH speed limit be enforced, which would also help to reduce noise. He reviewed the further recommendation that Boise-Cascade look in to a long-range plan for private access. It was MOVED by Whitaker, seconded by Rich that the appropriate legislation be prepared to provide for 25 mile per hour speed limit along North 8th Street: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote. Schussler absent. City Manager McMicken reviewed his Report #224 regarding Changes in Bid Procedures. He explained that the proposed ordinance provides for compliance with new State laws on formal bid procedure. He also indicated that the changes will provide for more administrative control in considering affected departments when the bid award is made. In reference to bid awards on public improvement projects, Mr. McMicken reviewed the City's recent Charter Amendment requiring those projects over $5,000 to pass through the formal bid procedure. He noted that this is the practice of second, third, and fourth class cities, but that it does not apply to first class cities throughout the state. He indicated that a repeal of this amendment would allow City forces to do the work on public improvement projects in excess of the $5,000 limit, where appropriate. After due discussion, it was MOVED by Whitaker, seconded by Edmondson that Ordinance No. 1694, providing for said changes in bid procedures, be passed: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye on roll call. Schussler absent. It was then MOVED by Moore, seconded by Rich that appropriate legislation be prepared providing for the matter of repealing of this Charter Amendment to be submitted to a vote of the people: carried, Broad, Brown, Edmondson, Moore and Whitaker voting aye by voice vote; Rich voting nay by voice vote. Schussler absent. City Manager McMicken reported on the applications for Right-of-Way Use Permits filed by Yakima Fruit and Cold Storage Company and Artificial Ice and Fuel Company. Yakima Fruit and Cold Storage is requesting encroachment onto First Avenue for construction of a portable shack on skids. Chief of Code Administration, Newell Pock, reported that the space will provide portable office space. He indicated that Artificial Ice and Fuel Company is requesting tunnel space for refriger- ation purposes. It was MOVED by Whitaker, seconded by Brown that the requests for Right-of-way Use Permits by Yakima Fruit and Cold Storage Company and Artificial Ice and Fuel Company, be granted: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote. Schussler absent. City Manager McMicken reported that the request by Dwinell's Central Neon Company for a Right-of- way Use Permit will be continued. City Manager McMicken reported on the Outside Utility Request for water service to the property owned by Ralph Holm at 1809 West Lincoln Avenue, reporting that a line lies adjacent to the property available for connection at a charge of approximately $144. The applicant 1 4 :3 AUGUST 19, 1974 has agreed to future annexation. He reported the staff's recom- mendation that only the developed portion of the parcel be granted service. Councilman Edmondson spoke to the matter of a possible change in future land use by the applicant. City Attorney Fred Andrews explained the provisions in the agreement for property use in conformance with the City's General Plan, contained in Exhibit "B", but which is not attached to this agreement. City Attorney Andrews indicated that signing Exhibit "B" would limit the property use to residential and suggested that the Planning Department work with Mr. Holm on this matter. It was the consensus of the Council to defer a decision on this matter until the staff's work is completed. Present and speaking to this matter was Mr. Ralph Holm. Referring to the Outside Utility Request for water service to property at 614 West Washington Avenue, City Manager McMicken noted a similar question in regard to possible future use of the property for commercial purposes. It was the consensus of the Council that this matter be deferred for obtaining Exhibit "B". An Ordinance appropriating $100,000 in the Water-Sewer Fund to pay for the Yakima Area Waste Water Facilities Planning Study to be performed by R. W. Beck and Associates, having been read by title only at this meeting, was laid on the table for one week or until August 26, 1974. Petition No. 825 having been filed with the City Clerk on August 16, 1974, by Fred Osborne and others, requesting improvement of property by the construction of a watermain in the vicinity of Vendome Drive, it was MOVED by Whitaker, seconded by Rich that Petition No. 825, for the creation of a Local Improvement District, be referred to the City Manager and staff for study and recommendation: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote. Schussler absent. Damage Claims having been filed with the City Clerk on: a. August 12, 1974, by Frank E. Howe, Rt. 4, Box 220, Yakima, in the amount of $48.25 for damages to per- sonal property by a City vehicle; b. August 16, 1974, by the St. Paul Insurance Company for Hammers Stores Limited, 4545 15th NE, Seattle, in the amount of $333.40 for damages to an employee's vehicle while in Yakima from a dead and decaying tree; c. August 16, 1974, by Mrs. Robert M. Paul, 809 South 24th Avenue in the amount of $97.44 for damages from a City sewer backup, it was MOVED by Brown, seconded by Edmondson that said damage claims be referred to the City Manager and staff for study and recommendation: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote. Schussler absent. City Manager McMicken referred to an off-agenda item regarding an ordinance providing for parking regulations at the Yakima Air Terminal. It was MOVED by Edmondson, seconded by Brown that Ordinance No. 1695, regulating parking at the Yakima Air Terminal, be passed: carried, Broad, Brown, Edmondson, Moore, Rich and Whitaker voting aye on roll call. Schussler absent. ORDINANCE NO. 1695, AN ORDINANCE relating to traffic control, adopting an Air Terminal parking regulation plan and regulating parking at the Yakima Air Terminal; authorizing certain personnel to issue parking violation notices; authorizing impoundment of illegally parked vehicles; enacting Sections 1.18.042 and 9.50.542 as new sections of the City of Yakima Municipal Code; and declaring an emergency. Schussler absent. ; City Manager McMicken requesting authorization for out-of-state travel for Public Works Director, Dave Vargas, -to travel to Toronto, Ontario, !Canada, to attend the annual Congress of American Public Works Assoc ation, September 13-20-1974, it was MOVED by Brown, seconded by Edmoridson that said travel be approved and expenses paid: carried, Broad, 'Brown, Edmondson, Moore, Rich and Whitaker voting aye by voice vote.
