AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated between North 40th
Avenue and existing Yakima Tennis Club facilities in the
City of Yakima, Washington, from R-1, Single Family Zone,
to Planned Development Zone.
WHEREAS, pursuant to due and legal notice, the City Council of
III the City of Yakima held a hearing on the 23rd day of April, 1973, upon
the recommendation of the Planning Commission that real property
sttuated between North 40th Avenue and existing Yakima Tennis Club
facilities in the City of Yakima, Washington, be rezoned from R-1,
Single Family Zone, to Planned Development Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the
reasons that such rezoning is in accord with good p1annin3 an with
the General Plan of the City of Yakima; that the majority of propee
owners in the vicinity do not oppose the change in claseification;
that the needs of the City and community do require such change and
that the highest and best use of said property is for a Planned
Development Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Plannivg Commission of the
City of Yakima that the following described real property situated
between North 40th Avenue and existing Yakima Tennis Club facilities in
the City of Yakima, Washington, and more particularly described as
follows, to wit:
Commencing at the north quarter corner of Section 22, Township
13, North, Range 18, E.W.M., thence south along the west line of
the northwest quarter of the northeast quarter of said section
369.7 feet; thence north 89 east 472.6 feet to the true point
of beginring; thence south 3J4 feet to the northerly right of way
line of the Yakima Valley Canal; thence north 85 east 12.5
111 feet; thence south 79 east 100 feet; thence south 86 eat
172 feet; thence north 320.3 feet, more or less, to the center-
line of vacated Crescent Avenue; thence northwesterly along said
centerline 292 feet to the true point of beginning;
TOGETHER WITH that portion of vacated Crescent Avenue accrufrg
thereto;
TOGETHER WTH an easement for roadway purposes over and across
the south 30 feet of the following described premises:
That part of the northwest quarter of the northeast quarter of
Section 22, Township 13 North, Range 18, E.W.M., described as
follows:
Beginning at the north quarter corner of said Section; thence
smith 89 east along the north line of said subdivision 416.0
feet; thence south, reference meridian, parallel with the west
line of said subdivision 25 feet; thence south 62 east 62.60
feet to the northwest corner of Tract 9, Crescent Hill Half Acre
Tracts, as recorded in Volume "E" of Plats, page 33, records of
41 Yakima County, Washington, which plat has been vacated;-thence
South along the west line of said Tract 9 and the southerly el:-
tension thereof 311.27 feet to the centerline of vacated Crescent
Avenue; thence west along the centerline of vacated Crescent
Avenue 472.12 feet to the west line of said subdivision; thence
north 369.99 feet to the point of beginning;
EXCEPT the north and west 25 feet for road;
AND EXCEPT right of way for the Yakima Valley Canal Company's
canal:
be rezoned from R-1, Single Family Zone, to Planned Development Zont,
be, and the same is hereby, approved and said real property is
rezoned to a Planned Development Zone, all in accordance-with, and f.T.o
conform to, the final development plan and program therefor approved
by the Yakima Planning Commission, a copy of which is attached hereto
And.bTreferefice made. a part hereof.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the city.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima CoUnty Auditor a certified copy of this ordiranc.
Section 4. This ordinance be in full force and effect ao
