HomeMy WebLinkAbout1970-1237 4A 4 ORDINANCE NO. /a32 AN ORDINANCE relating to building regulations;' adopting by reference the Uniform Plumbing Code, 1970 Edition, by the Inter- national association of Plumbing and Mechanical Offi- cials; providing for licensing individuals and firms engaged in the business of, or laboring at the trade of, plumbing; providing penalties for the violation of the provisions of this Chapter; amending Sections 11.44.010, • .040, .050, .060, .070, .080, .090, .100, .110 and .120, and repealing Section 11.44.030 and adding Section 11.44.105, all of the City of Yakima Municipal Code. WHEREAS, R.C.W. 35.21.180 authorizes cities and towns within the State of Washington to pass' ordinances adopting by reference compila- tions and codes relating to the construction of buildings, and WHEREAS, the City Council of the City of Yakima has heretofore examined and understands the scope and purpose of the regulations of the Uniform Plumbing Code, 1970 Edition, by the International Associa- tion of Plumbing and Mechanical Officials, and deems it in the best interests of the City that such Uniform Plumbing Code be adopted as the law of the City of Yakima, and 411 WHEREAS, three copies of such Uniform Plumbing Code have here- tofore been filed in the office of the City Clerk of the City of Yakima for use and examination by the public, as required by law, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 11.44.010 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.010 Adoption of Uniform Plumbing Code. The Uniform Plumbing Code, 1970 Edition, by the International Association of Plumbing and Mechanical Officials, together with and includ- ing appendices thereto, consisting of Appendix A, 'Recommended Rules for Sizing the Water Supply System', Appendix B, 'Explana- tory Notes on Combination Waste and Vent Systems', Appendix C, 'Minimum Plumbing Facilities', Appendix D, 'Rainwater Systems', Appendix E, 'Trailer Park Plumbing and Drainage Systems', 410 Appendix F, 'Medium Pressure Gas Piping Systems' and Appendix G, 'Swimming Pools', of which not less than three copies each have been and now are on file in the office of the City Clerk of the City of Yakima, is hereby adopted and incorporated as fully as if set out in full herein, as the plumbing code of the City of Yakima, except as hereinafter amended, and the provisions and regulations thereof are hereby adopted as the provisions and regulations of the City of Yakima; and the several sections or numbers therein shall constitute, and may be referred to as, the numbers of this Chapter." Section 2. . Section 11.44.040 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.040 Amendments to Part 1-- Administration. The following sections of Part 1, 'Administration' of the Uniform Plumbing Code adopted by this Chapter are hereby amended to read as follows 411 'A. Section 1.1-- Administrative Authority. Whenever t he term "Administrative Authority" is used in this Code, it shall mean the Chief Building Inspector or his authorized representative. B. Section 1.2 -- Authorized Representatives -- Assistants. Whenever the term "Authorized Representatives" or "Assis- tants" is used in this Code, it shall mean Deputy Plumbing Inspectors. C. Section 1.3-- Department Having Jurisdiction. Unless otherwise provided by law, the office of the Adminis- trative Authority shall be the Inspection Division of the Department of Planning and Community. Development. D. Section 1.7-- Violations and Penalties. Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor and upon con- viction thereof shall be punished by a fine of not . to exceed Five Hundred Dollars ($500.00), or by imprisonment in the Yakima City Jail for a period not to exceed six (6) months, or by both such fine and imprisonment. Each sepa- rate day or any portion thereof during which any violation . of this Code occurs or continues shall be deemed to consti- tute a separate offense. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an v proval of, any violation of any , of the provisions of this code. No permit presuming to give authority to violate cr cancel the provisions of this code shall be valid, except insofar as the work or use which it authorizes is lawful. The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing construction opera- tions being carried on thereunder when in violation of this code or of any other ordinance or from revoking any Certi- ficate of Approval when issued in error. Every permit issued by the Administrative Authority under the provisions of this code shall expire by limitation and become null and void if the work authorized by such • permit is not commenced within sixty (60) days from the date of issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of sixty (60) days. Before such work may be recommenced a new permit shall be first obtained to do so.'" Section 3. Section 11.44.050 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.050 Amendment s to and Deletions from Part 2--qualifi- cation of Plumbers. The following Sections of Part 2, 'Qualifica- tion of Plumbers', of the Uniform Plumbing Code adopted by this Chapter are hereby amended to read as follows: 'Section 2.6-- Application Fee. Every person applying for a Plumber's Certificate of Qualification or Registration shall pay to the Secretary of the Board of Plumber Examiners at the time he makes such application the following fees: i (a) Plumbing Contractor's Certificate .......... $5.00 (b) Journeyman Plumber's Certificate .,......... $5.00' 'Section 2.9-- Expiration of Certificates of Qualification or Registration. Every Certificate of Qualification or Regis- tration shall remain in force and effect for the life of the holder unless cancelled or revoked.' Section 2.10 is deleted in its entirety." Section 4. Section 11.44.060 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.060 Addition of New Section 2.12 to Uniform Plumbing Code. There is hereby added to Part 2, 'Qualification of Plumbers', of said Uniform Plumbing Code, adopted by this Chapter, following Section 2.11, a new Section 2.12 to read as follows: 'Section 2.12 -- License, Bond and Insurance Required. (a) It shall be unlawful for any person, firm or corpora- * tion to engage in the business of installing or contracting to install, repair or alter plumbing or sidesewers without first having obtained and being the authorized holder of a valid and subsisting Plumbing Contractor's License or Sidesewer Contrac- tor's License, and without having filed with the City Clerk a valid and subsisting surety bond and insurance as hereinafter provided. (b) A Plumbing Contractor's License qualifies the holder to obtain permits for all types of plumbing including side - sewer work. (c) A Sidesewer Contractor's License qualifies the holder to obtain permits for sewers, drywells, private sewage disposal systems and similar outdoor work, but he is prohibited from performing any plumbing work or installing piping of any kind under roofed areas or within buildings. (d) A Contractor's license shall remain valid only during such time as said surety bonds and said policies of insurance remain in full force and effect.'" 411 Section 5. Section 11.44.070 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.070 Addition of New Section 2.13 to Uniform Plumbin: Code. There is hereby added to Part 2, 'Qualification of Plumbers', of the Uniform Plumbing Code, adopted by this Chapter, following Section 2.12, a new Section 2.13 as follows: - 3 - 'Section 2.13= -Bonds and Insurance -- Specified. The surety bonds and insurance required of Plumbing Contractors and Sidesewer Contractors shall be as follows: (a) Bonds. Surety bonds shall be in the sum of Two Thousand Dollars for each establishment or place of business maintained within the City of Yakima by any person, firm or corporation engaged in such businesses, payable to the City of Yakima for the use and benefit of said City, and any and all persons 411 dealing with the licensee or his agents in his capa- city as Plumbing Contractor or Sidesewer Contractor, and shall be executed by the licensee and by a surety company authorized to do business in the State of Washington, which bond shall be conditioned that the licensee and his agents shall fully comply with all provisions of law relating to plumbing and /or sewers, and that any person injured by failure to comply therewith may have a right,of action on said bond in his own name, and also against the principal for any violation of, or failure to comply with said pro - visions of law. The surety on such bond shall not be liable thereunder to any one person in excess of the sum of Two Thousand Dollars, but the principal shall be fully liable without limitation. (b) Insurance. Public liability and property damage insurance and products liability insurance shall be provided in an amount of not less than $10,000 for each person and $20,000 for each incident for personal injury, and $10,000 for property damage for each incident of liability.'" 411 Section 6. Section 11.44.080 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.080 Addition of New Section 2.14 to Uniform Plumbing Code. There is hereby added to Part 2, 'Qualifications of Plumbers', of the Uniform Plumbing Code, adopted by this Chapter, following Section 2.13, a new Section 2.14 to read as follows: 'Section 2.14 -- Licensing of Journeymen. (a) It shall be unlawful for any person to labor at the trade of plumbing in the capacity of journeyman plumber or at the trade of sidesewer installer in the capacity of journeyman installer without first having obtained and being the authorized holder of a valid and susbisting Journeyman Plumber's or Journeyman Sewer Installer's License. (b) A Journeyman Plumber's License permits the holder to work on all types of plumbing including side- 41 1 sewers, only while in the employ of a properly licensed plumbing contractor. (c) A Journeyman Sewer Installer's License per- mits the holder to work on only that portion of outdoor piping included within the limits of a Sidesewer Con- tractor's License, and he may only perform this work while employed by a regularly licensed Plumbing or Sidesewer Contractor. ' ' - 4 - Section 7. Section 11.44.090 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.090 Addition of New Section 2.15 to Uniform Plumb- Code. There is hereby added to Part 2, 'Qualifications of Plumbers', of the Uniform Plumbing Code, adopted by this Chapter, following Section 2.14, a new Section 2.15 to read as follows: 'Section 2.15 -- License Procurement and Fees. Original and renewal licenses may be issued by the City Clerk to any applicant who holds a valid Certificate of Qualification or Registration, as provided for in this Chapter or whose application is approved by the Inspection Division. License fees shall be paid to the City of Yakima at time of issuance in accordance with the following schedule: Original Renewal Plumbing Contractor's License $ 150.00 $ 75.00 Journeyman Plumber's License 5.00 5.00 Sidesewer Contractor's License 50.00 25.00 Journeyman Sewer Installer's License 5.00 5.00 Licenses expire on December 31st of each year.'" Section 8.. Section 11.44.100 of the City of Yakima Municipal Code is hereby amended to read as follows "11.44.100 Amendment to Section 304. A new subsection (c) of Section 304 of the Uniform Plumbing Code adopted by this Chapter is hereby added to read as follows: 'Section'304 -- Damage to Drainage System or Public Sewer. (c) No such rainwater shall be allowed to flow over any public sidewalk, but shall be conducted under the sidewalk to the gutter or storm drain. In areas where storm drains are not available such rainwater shall be conducted to dry wells constructed for that purpose.'" Section 9. Section 11.44.110 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.110 Amendments to Section 506. Subsections 506 (a) and (c) of the Uniform Plumbing Code adopted by this Chapter are hereby amended to read as follows: 'Section 506 (a) Each vent pipe or stack shall extend • through its flashing and shall terminate vertically not less than ten (10) inches above the roof nor less than one (1) foot from any vertical surface.' 'Section 506 (c) Vent pipes shall be extended separately or combined, of full required size, not less than ten (10) inches above the roof or fire wall. Flagpol- ing of vents is prohibited except where the roof is used for' purposes other than weather protection. In such cases the vent shall extend not less than seven (7) feet above the roof and be securely stayed.'" - 5 - Section 10. Section 11.44.120 of the City of Yakima Municipal Code is hereby amended to read as follows: "11.44.120 Amendment to Section 807. Section 807 of the Uniform Plumbing Code adopted by this Chapter is hereby amended to read as follows: 110 'Section 807 -- Waterproofing of Openings. Joints at the roof around pipes, ducts or other appurtenances shall be made water tight by the use of lead or other approved flash - ings or flashing material. Exterior wall openings shall be made water tight. Counterflashing shall not restrict the required internal cross - sectional area of the vent. "" Section ll. Section 11.44.105 is hereby adopted and added as a new section of the City of Yakima Municipal Code, which new section shall read as follows: "11.44.105 Amendment to Section 401. Section 401 of the Uniform Plumbing Code adopted by this Chapter is hereby amended to read as follows: 'Section 401 -- Materials (a) Drainage pipe shall be cast iron, galvanized steel, galvanized wrought iron, lead, copper, brass, ABS, PVC or other approved materials having a smooth !II and uniform bore, except: 1. That no galvanized wrought iron or galvanized steel pipe shall be used underground and shall be kept at least six (6) inches above ground; 2. ABS or PVC installations limited to residential construction two (2) stories in height. (b) Drainage fittings shall be of cast iron, malleable iron, lead, brass, copper, ABS, PVC or other approved materials having a smooth interior waterway of the same diameter as the piping served and all such fittings shall conform to the type of pipe used. 1. Fittings on screwed pipe shall be of the recessed drainage type. Burred ends shall be reamed to the full bore of the pipe. 2. The threads of drainage fittings shall be tapped so as . to allow one fourth (1/4) inch per foot grade.'" Section 12. Section 11.44.030 of the City of Yakima Municipal Code is hereby repealed in its entirety. Section 13.
