AN ORDINANCE relating to health and sanitation; establishing rates
and specifying practices for garbage and refuse collec-
tion service; and amending Subsections 4.16.140 (c) and
(d), and amending Subsections 4.16.170 (a), (b) and (c)
of the City of Yakima Municipal Code.
410 BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. Subsections 4.16.140 (c) and (d) of the City of
Yakima Municipal Code are hereby amended to.read as follows:
"4.16.140 Classification of Premises -- Charges.
(c) The collection of all refuse in the residential
classification shall be conducted by the City of Yakima
equipment and personnel and financed by garbage and refuse
collection fees hereinafter set forth. The City of Yakima
shall not collect refuse from apartments or multiple units
in excess of four units except upon the request of the owner
or operator thereof. The following collection fees and
practices shall apply for all garbage collection services
conducted by the City of Yakima.
(1) There is hereby imposed for garbage and
refuse collection in the residential classification
the following charges for each residential unit carried
under the same account number and street address as for
110 water department metered services:
Basic 1 -can residential service
at alley or curb $1.40 per month
Extra charge for second can at
alley o r curb . . . . . . . .. . . . . . . . 050 per month
Each additional can at alley or
curb over 2 cans .50 per month
Carry -out service charge per can .50 per month
The "carry -out service charge" shall apply to cans
placed for collection more than twenty -five feet, but
less than one hundred feet, from the curb or alley from
which collection is made. No can shall be collected if
placed more than one hundred feet from the . curb or
alley from which collection is made.
(2) Where garbage and refuse collection service
is performed for apartments or multiple housing units
wherein all of the units are carried under the same
account number and street address as for water depart-
ment metered services and the garbage cans are all
411 centrally located in one place, the basic one can
residential service charge set forth in subparagraph
(1) above shall be modified as follows:
First residential unit .......... $1.50 per month
Second residential unit 1.00 per month
Third residential unit 1.00 per month
Each additional residential unit. 1.00 per month
The above listed charges shall be based on the total
number of .residential units that can be used for house-
• keeping purposes, and no discount shall be allowed for
vacancies.
(3) All of the charges for garbage and refuse
collection provided in Subparagraphs(1) and (2) above
shall be billed for and paid at the same time and for
the same period as billings and payments are made for
other City utility services; or, in the event a cus-
tomer is served by the municipal garbage division but
is not served with another city utility, garbage and
refuse collection charges shall be billed and paid for
according to the schedule which would be applicable to
such customer were he so served with another city
utility service. Accounts shall become delinquent if
not paid within the time specified by Section 7.68.025
of the City of Yakima Municipal Code for payment of
water service charges.
(4) Garbage and refuse collection charges will
be suspended for any customer upon advance notice to
the office of the Division of Utility Accounting that
a particular premises served will be unoccupied, and
such charges will be resumed on notice to such office
to resume service. No such suspension of charges for
garbage and refuse collection service will be made for
any premises served with . any other city utility unless
all city utility service to such premises is likewise
suspended.
Application for resumption of service to a new
customer shall be made to the office of the Division
of Utility Accounts on forms provided for that purpose
which shall contain the name of the customer and the
110 street address and number of units of the premises to
be served.
(5) Collection service may be suspended for nonpayment
of accounts, but such suspension shall not relieve the
person owing such account from the duty of complying
with the provisions of this chapter or other ordi-
nances pertaining to garbage refuse or sanitation.
Such suspension of service shall render the premises
where such collection service is suspended subject to
condemnation for lack of sanitary requirements, and
the owner or person in charge or in possession of said
, premises shall be subject to prosecution for maintain-
ing a nuisance thereon.
(6) Upon failure to pay such charges and upon
delinquency, the amount thereof shall become a lien
against the property from which the garbage collection
service shall have been rendered. Such lien shall be
made effective by filing a notice thereof specifying
the charges, the period covered by the charges and
giving a legal description of the premises at which
the service was rendered. Such lien shall be filed
with the same official and within the time and shall
be foreclosed within the time and manner prescribed
by law for filing and foreclosing liens for labor and
material. Such lien shall be prior to any and all
other liens and encumbrances filed subsequent to the
filing of such lien, but shall be subject to all
general taxes and local improvement assessments,
whether levied prior or subsequent thereto.

(d) The residential classification of refuse collec-
tion shall include the collection of all refuse up to two
cubic yards per month from private residences in the City
of Yakima, and from all flats, duplexes and apartment
houses, except as hereinabove provided, but which shall
not include trees or large lambs: Branches and shrubbery
• trimmings must be securely tied in bundles not to exceed
two feet in diameter or four feet in length and placed in
a location that is accessible to the collectors; (i.e.
where there are no alleys, this material must be placed in
front of the property at the curb, and where there are
alleys, such material shall be kept on private property in
an accessible location to such alley, without hindering or
interfering with the normal traffic in the alley). Brush
and trimmings must not be placed against any building or
fence so as to constitute a fire hazard. City service does
not include the collection of discarded fruit from trees,
nor rubbish or debris of any kind except in minor quanti-
ties, resulting from construction, alterations, demolition,
remodeling or landscaping of any property. Grass, Takings
and rubbish must, be in non porous containers.
The collection of all refuse in excess of two cubic
yards per month per private residence or apartment unit
shall be the rate of ten dollars per hour."
Section 2. Subsections 4.16.170 (a), (b) and (c) of the City of
0 Yakima Municipal Code are hereby . amended to read as follows:
"4.16.170 Collection of Garba,e in Residential Dis-
trict-- Regulations. There are hereby established the fol-
lowing rules and regulations pertaining to receptacles,
preparation and care of garbage by property owners or per
Sons in control in the Residential District:
, (a) The owner or person in charge of or in pos-
session of any dwelling, flat, duplex or apartment
house in the Residential District shall at all times
keep or cause to be kept portable sanitary containers
for the disposal,therein of garbage and refuse and
shall depositor cause to be deposited therein such
garbage and refuse.
(b) It shall be the duty of the owner or person
in control of any dwelling flat, duplex, or apartment
house to furnish to and to see that his tenants are
supplied with such sanitary containers as provided in
this chapter.
(c) Such containers shall : be watertight, of good
construction with no major dents, of not more than
thirty gallons capacity, shall have a handle at each
side thereof and tight fitting lids.. Such lids shall
be removed only when necessary to place garbage and
refuse in such containers, or to take the same there -
from. Such containers shall be kept in a sanitary
condition with the outside thereof clean and free from
accumulating grease and decomposing matter. The gross
weight of any container when full shall not exceed
seventy -five pounds."

Section 3. The garbage and refuse collection rates and prac-
tices specified in this ordinance shall apply to garbage and refuse
collection setvice rendered commencing October 1, 1970. Such rates
and practices, as the same are now ipecified by Sections 4.16.140 and
410 4.16.170 of the City of Yakima Municipal Code prior to their amend-
ment by this ordinance shall apply to garbage and refuse collection
service rendered through September 30, 1970, and shall not be
affected by this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided
by law and by the City Charter.
