HomeMy WebLinkAbout1970-1251 4 , ORDINANCE NO. /!.,2S AN OaDINANCE relating to traffic control; authorizing the irnprnding of vehicles in certain circumstances; amending subsection 9.80.080 (a) of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Subsection 9.80.080 (a) of the City of Yakima Munici- pal Code is hereby amended to read asfollows: "9.80.080 Authority to impound vehicles,. (a) Any vehicle under the circumstances herein- after enumerated is hereby declared to be a nuisance. Any police officer of the City of Yakima is hereby authorized to impound or cause to be impounded such a vehicle from any public highway: (1) When any vehicle is disabled or left un- attended on any public highway, or on any bridge, viaduct or causeway, or in any tunnel, in such a manner so as to constitute an obstruction to traffic in the judgment of any police officer. (2) When the person or persons in charge of any vehicle are apparently incapacitated to such an extent so as to be unable to provide for the custody or removal of such vehicle in the judgment of any police officer. (3) When any vehicle is parked or left un- attended on any public highway on which parking - is prohibited or prohibited during certain hours by Sections 9.75.040 and 9.75050 of this Title when Signs are posted under the authority of the Traffic Engineer prohibiting such parking and noti- fying that vehicles illegally parked are subject to being impounded, which notification shall be given by including the words "Subject to Impound", "Tow Away Zone", or words of similar import on sucb signs. (4) When any vehicle is parked or left un- attended on any pUblic highway in violation of any temporary sign or barricade prohibiting parking on or entry into such public highway, or any portion thereof, when such sign or barricade has been placed under the direction of the Director of Public Works or his designate to facilitate construction, repair 110 or maintenance of such public highway or any utility within such public highway, and when any such sign or barricade notifies that vehicles parked or left • unattended in violation thereof F.re subject to • being impounded by the inclusion of tie wordo "Subject to Impound", "Tow Away Zone" or words of similar import." Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and wel- fare of the people of the City of Yakima and an emergency is hereby 40 declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
