HomeMy WebLinkAbout1970-1273 , O ORDINANCE NO. \al:3 AN ORDINANCE relating to municipal finance; creating and designating purposes of a Contingency Fund and specifying sources of funds for and the manner of authorizing eXpenditures from such fund; creating Chapter 3.82, Contingency Fund, and Sections 3.82.010, 3.82.020 and 3.82.030 as a new chapter and new sections of the City of Yakima Municipal Code; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Chapter 3.82, Contingency Fund, is hereby created and adopted as a new chapter of the City of Yakima Municipal Code, which new chapter, consisting of Sections 3.82.010, 3.82.020 and 3.82.030, shall read as follows: CHAPTER 3.82 CONTINGENCY FUND 3.82.010 Fund created. There is hereby created a special fund to be known as the Contingency Fund. 3.82.020 Source of funds--Limitation on amount--Lapse. A. The contingency fund may be supported by a budget 111 appropriation from any tax or other revenue source not res- tricted in use by law, or also may be supported by a trans- fer from other unexpended or decreased funds made available by ordinance as set forth in R.C.W. 35.33.121. B. The total amount accumulated in such fund at any time shall not exceed the equivalent of one and one-half mills on each dollar of assessed valuation of property with- in the city at that time. C. Any moneys in the Contingency Fund at the end of the fiscal year shall not lapse except upon re-appropriation by the Council to another fund in the adoption of a sub- sequent budget. 3.82.030 Purposes--Expenditures. A. The moneys in the Contingency Fund may be used to meet any municipal expense, the necessity or extent of which could not have been foreseen or reasonably evaluated at the time of adopting the annual budget, or from which to provide moneys for those emergencies described in R.C.W. 35.33.081 and 35.33.091. B. No expenditures shall be made from such fund unless the City Council shall approve such expenditure by passing an ordinance appropriating money within the fund for the purpose for which the expenditure is to be made or by includ- ing an appropriation for such purpose in the budget. Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and welfare . . of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and effect immediately upon its passage, approval and publication as provided by law and by the City Charter. 411 PASSED BY THE CITY COUNCIL, signed and approved this 14th day of December, 1970. 11"-4/? • Mayor ATTEST: City Clerk 411 - 2 -
