AN ORDINANCE providing for the vacation of portions of Marilane
Avenue cul de sac.
WHEREAS, petitions have been filed with the City Council of the
0 City of Yakima requesting the vacation of the hereinafter described
street right -of -way, and
WHEREAS, a hearing by the City Council was duly held on said
petitions, and as a result of such hearing the City Council finds it
to be in the best interests of the City of Yakima that said petitions
be granted and that said street right -of -way be vacated, now,
therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The following described street right -of -way in the
City of Yakima, Washington, to -wit:
A cul de sac on Marilane Avenue according to plat of Scenic -
view Terrace, Volume "R ", page 28, records of Yakima County,
Washington, lying southerly of a line which extends from the
most northerly corner of Lot 19 to the most northerly corner
of Lot 18, said property to be proportioned to Lots 19 and 18
by the extension of the common property line northerly to its
410 intersection with above described line; and
A cul de sac on Marilane Avenue according to the plat of Scenic -
view Terrace, Volume "R ", page 28, records of Yakima County,
Washington, lying northerly of a line which extends from the
middle corner on the southerly line of Lot 16, to a point on the
arc of a curve on Lot 17; said point being an intersection of
the arc of the 50 foot radius curve as shown on said plat and
a line parallel to and 35 feet northerly when measured at right
angles to the southerly line of Lot 17, said property to be
proportioned to Lot 16 and 17 by the extension of the common
property line southerly to its intersection with above described
line.

Section 2. The City of Yakima hereby reserves public utility
easements over and along portions of the vacated street right -of -way,
which easements are described as follows:
A public utility easement 16 feet wide, being 8 feet wide on
each side of the common property line of lots 16 and 17 of the
vacated part of the Marilane cul de sac as described below:

ington, lying southerly of a line which extends from the most
northerly corner of Lot 19 to the most northerly corner of Lot
18, said property to be proportioned to Lots 19 and 18 by the
extension of the common property line northerly to its inter-
section with above described line;
for the installation,: maintenance and continued existence of all
public utilities of any and all kinds which may now exist in said
right-of-way or which it may hereafter desire to constructthereon,
and no buildings shall be constructed on any portion of said ease-

ment without the prior approval of the City.
Section 3. This ordinance shall be in full force and effect 30
days after its passage, approval and publication as provided by law
and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 3rd day
of May, 1971.
