SUMMARY EXPLANATION
Wellington Estates Phase 5 consists of 12 lots and is part of a five -phase 159 lot subdivision
located at the southwest corner of the intersection of West Washington Avenue and Wellington
Drive This subdivision received preliminary plat approval from Yakima County on March 20,
2007 and consequently this subdivision is vested under Yakima County's rural development
regulations, which are not consistent with the City of Yakima's standards for street widths,
sidewalks on both sides of the street and building setbacks. This final plat has been reviewed
by both County and City staff for compliance with the conditions of approval, as well as, the
subdivision regulations for both jurisdictions.
The City Engineer's office has received a letter from Yakima County indicating that all
III improvements made under their jurisdiction are final and inspected Equally, City Engineering
has completed its final inspection of this plat and all items being completed, the City Engineer
has signed the plat.
The Code Administration and Planning Division has likewise reviewed the final plat for Phase 5
and finds it Ito be in substantial conformance with the terms and conditions of the preliminary
approval and therefore the Subdivision Administrator has also signed the plat. (cont.)

STAFF RECOMMENDATION Staff recommends Council's approval of the final plat for
Wellington Estates Phase 5 together with the adoption of the accompanying resolution that will
authorize the Mayor to sign the plat.

A. Upon receipt of a proposed final plat, the City Council shall at its next public meeting set

a date for consideration of the final plat. Notice of the date, time, and location of the
public meeting shall be given to the subdivision applicant, Surveyor, City Engineer,
Office of Environmental Planning, and the Yakima County Health Officer at least four
days prior to the date of the public meeting
B The City Council shall review the final plat during the public meeting and shall approve
the final plat if the Council determines that the final plat conforms to the conditions of
preliminary plat approval and applicable state laws.
C Upon approving any final plat, the City Council shall authorize the Mayor to sign the final
plat as evidence of City Council approval (Ord 98 -65 § 2 (part), 1998)

A RESOLUTION approving the final plat of Wellington Estates Phase 5, a 12 -lot
subdivision located at the southwest corner of West Washington Avenue
and Wellington Drive, and authorizing the Mayor to sign the final plat;
Cottonwood Partners, LLC is the applicant herein
WHEREAS, on January 25, 2007, the Hearing Examiner held a public hearing to
consider the application to Yakima County for a 12 -lot subdivision submitted by Cottonwood
Partners, LLC known as Wellington Estates Phase 5, located at the southwest corner of West
Washington Avenue and Wellington Drive, (Yakima County Preliminary Plat Number PRJ05-
1389), and
WHEREAS, on February 8, 2007, the Hearing Examiner issued his Recommendation
for approval of the proposed plat subject to several conditions, and
WHEREAS, at its public hearing on March 20, 2007, the Board of Yakima County
Commissioners determined by motion that the Recommendation of the Hearing Examiner
should be affirmed and adopted, (Yakima County Resolution No 557 - 2007), and
WHEREAS, on April 8, 2007, the preliminary plat of Wellington Estates Phase 5 was
annexed into the City of Yakima as part of the Occidental Annexation, and
WHEREAS, the preliminary plat was fully vested in the County's development standards
as a result of the application having been filed with the County prior to the annexation, and
WHEREAS, the applicant has completed or bonded for construction of all public
improvements required as conditions of the County's approval of the preliminary plat, and both
Yakima County Public Services and the City Engineer have inspected, approved and accepted
all plans and designs for all such required improvements, and
WHEREAS, as this final plat comes before City Council for review, each member
declares that he or she has had no contact with either the applicant or opponents of the final
plat, Now, Therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA.
The proposed final plat for Wellington Estates Phase 5, consisting of two sheets dated
November 9, 2007, depicting a 12 -lot subdivision located at the southwest corner of West
Washington Avenue and Wellington Drive, is approved and the Mayor is hereby authorized to
sign the final plat. The applicant shall file the final plat for Wellington Estates Phase 5, together
with the necessary CCR's, for record in the Yakima County Auditor's Office immediately, or as
soon thereafter as possible, and the applicant shall be responsible for all filing fees

BACKGROUND AND SUMMARY OF REQUEST
Wellington Estates Phase 5 is a 12 -lot subdivision located at the southwest corner of West
Washington Avenue and Wellington Dnve (South 56 Avenue) The Plat of Wellington Estates
Phase 5 was prelimmanly approved while it was still under the jurisdiction of Yakima County
and consequently it is vested under the County's rural development regulations Most notable of
the changes from current City standards are that sidewalks are provided only on one side of the
street. Wellington Dnve, the main access road to the plat, has been constructed with sidewalks
on both sides of the street.
• The City Engineer's office has reviewed and approved all necessary designs and engineering and
indicates that the required improvements are installed and inspected or that the required financial
security is in place to secure their installation. The City Chief Engineer has signed the plat in
affirmation of this fact. The Planning Division has similarly reviewed the final plat and finds it
to be in substantial conformance with the terms and conditions of the preliminary plat approval
Staff, therefore, recommends acceptance of the final plat and the adoption of the resolution that
authonzes the Mayor to sign the final plat.
CONDITIONS OF APPROVAL
The Board of Yakima County Commissioners has approved and adopted the Hearing Examiner's
findings and recommendation for conditional approval of the preliminary plat known as
"Wellington Estates Phase 5" (Yakima County assigned file numbers PRJ05 -1389, SUB06 -084
and SEP06 -030) (Yakima County Resolution No 557 -2007 dated November 13, 2007)
These conditions must be met before the final plat can be approved and consist of the following
matters
General
1 Compliance with the final Mitigated Determination of Nonsignificance dated January 2, 2007
shall be required, and the mitigation measures thereof are hereby adopted and incorporated

2 All proposed lots must be provided with adequate fire flow in accordance with the adopted
fire code pnor to final plat approval

3 Unless construction is concurrent or incorporated into approvals and dust control
requirements of Wellington Estates Phases 1 through 4, a method of dust control for the
construction phase shall be submitted to and approved by the Yakima Regional Clean Air
Authonty A copy of the approval must be submitted to the Public Services Department
Planning Division pnor to any construction activities.
STATUS Yakima County has determined compliance with this requirement.
4 Monuments must be placed at street intersections and curvature points as specified in Section
14.32 020 of the Yakima County Code The monuments must be protected by cases and
covers as approved by the County Engineer
STATUS Yakima County has determined compliance with this requirement.
Streets
5 Wellington Dnve shall be provided with barner curb and gutter, and sidewalks on both sides
of the street, and shall be constructed in conformance with mitigation measures required by
the MDNS
STATUS Yakima County has determined compliance with this requirement.
6 Adequate width of right -of -way to support a center turn lane between the intersection of West
Whatcom Avenue and Wellington Drive, north to the intersection of Wellington Drive and
West Washington Avenue shall be provided for a length and specific location to be
determined by the County Engineer and in conformance with applicable mitigation measures
required by the MDNS
STATUS Yakima County has determined compliance with this requirement.
7 At the discretion of the County Engineer, no on- street parking or limited on- street parking
signs may be required for Wellington Dnve
STATUS Yakima County has determined compliance with this requirement.
8 The plans for all public road improvements must be designed to Yakima County standards,
including applicable standards and mitigation measures of the MDNS that are prepared by a
licensed professional engineer and approved by the County Engineer pnor to construction

111) 9 Dedicated 30 -foot by 30 -foot clear sight tnangles must be provided at all intersection corners
within the plat. Equivalent alternative plans supporting a reduction in distance may be
submitted to the County Engineer for approval.

10 Street names shall be reviewed and approved by the Public Services Department pnor to
final plat approval Street signs are required for this development. The signs will be installed
by Public Services pnor to acceptance of roads and all costs associated with supplying and
installing the signs must be reimbursed to Yakima County by the developer
STATUS The City of Yakima shall install street signage and bill the developer for these
costs. The "Wellington Drive" street sign is currently in place.
Utilities
11 All public and pnvate utilities located within intenor easements or nghts -of -way must be
constructed pnor to any road construction

12 Installation of power and telephone facilities must be completed, or arranged with the

standard telephone box, transmission box and similar structures

14 Public utility easements must be provided for the 3 proposed shared intenor access
easements. If the easement is 50 feet or less, the utility easements shall be 10 feet in width or
as specified by the utility providers Minimum width for utility easements that are also
utilized for imgation is generally 15 feet.
STATUS Yakima County has determined compliance with this requirement.
15 All lots shall be served with public water from the Nob Hill Water Association system. No
new individual domestic or irrigation wells shall be permitted for any of the proposed lots
Pnor to final plat approval, wntten verification must be provided to the Public Services
Department Planning Division demonstrating the ability to provide domestic water, that any
necessary easements are provided for, and that all associated fees have been paid.

16 All lots shall be provided with public sewer service from the Yakima Regional Wastewater

system. Prior to final plat approval, wntten verification from the City of Yakima must be
submitted to the Public Services Department Planning Division demonstrating that the
system will serve all lots within the subdivision, any necessary easements have been
established, and any required fees have been paid.
STATUS The City of Yakima Engineering Division has determined compliance with
this requirement.
Restrictive Covenant
17 Pnor to accepting lot reservations or purchase offers, the owner(s) of the lots within the plat
shall record, and take reasonable steps to advise prospective purchasers of, a restrictive
covenant against the lots indicating that the adjoining property to the west of the plat is
approved and utilized for outdoor receptions, concerts and other events involving music and
other noise at various times during daytime and evening hours The covenant may be
removed or terminated if that use of the adjacent property is ever permanently abandoned.
STATUS This restrictive covenant is included in the Covenants, Conditions and Restrictions
(CCR's) for this plat and shall be recorded concurrently with the filing of the final
plat. A copy of the final recorded Plat of Wellington Estates Phase 5 and the
aforementioned CCR's shall be provided to the Code Administration and Planning
Division as a condition of approval.
Plat Notes
18 Yakima County has in place an urban and rural addressing system. Street names and
numbers for lots within this plat are issued by the Yakima County Public Services
Department upon issuance of an approved Building Permit.
STATUS The assigned addressing for each lot appears on the face of the final plat.
19 The owners shown hereon, their grantees and assignees in interest hereby covenant and agree
to retain all surface water generated within the plat on -site
STATUS The required note appears on the face of the plat.
20 All lots of this subdivision have been provided with public sewer All lots have been
provided with public water connections.

Timing
21 All property taxes and special assessments for the entire tax year must be paid, together with
any required pre - payment amount, pnor to final plat approval
STATUS The Yakima County Treasurer must sign the face of the final plat prior to recording
Without all taxes paid the Treasurer will not sign the plat.
22 Pnor to recording the final plat or issuance of building permits, either
a) All required plat improvements, 1 e streets, sidewalks, utilities and drainage facilities,
must be in place, or,
b) An escrow account must be established or a bond provided in an amount and with
conditions acceptable to the Yakima County Engineer to assure installation of all
remaining required improvements
If the developer elects to escrow or bond for the required roadway improvements, and
fails to complete these improvements in the time specified in the escrow or bond
agreement, the County Engineer shall have the authonty to suspend issuance of
building or occupancy permits until the required road and drainage improvements are
• accepted as satisfactorily completed. The County Engineer may issue building permits
on a lot -by -lot basis when it is determined that building construction will not interfere
with utility and roadway construction.
STATUS The required plat improvements are installed, except for the provision of a
second access road by improving South 60 Avenue to meet County standards.
The City Chief Engineer has signed a Subdivision Improvement Fund Escrow
Agreement with the Applicant to secure construction of said second access road
improvements according to the plans
23 The total project must be completed and the final plat submitted within the maximum five -
year time period prescnbed by Section 58 17 140 of the Revised Code of Washington. Any
extension beyond the five -year time penod is subject to the provisions of Chapter 14 24 of
the Yakima County Code
STATUS The final plat for Phase 5 has been submitted within the required five -year time
limitation.
FINDINGS
1 The final plat is consistent with the goals, objectives and intent of the Yakima County
Comprehensive Plan and the standards of the Yakima County Zoning Ordinance
2 The final plat meets the standards of the Yakima County Subdivision Ordinance

RECOMMENDATION

final plat for Wellington Estates Phase 5 and the passage of the resolution that authorizes the
Mayor to sign the final plat.

Location. The proposed preliminary plat is located on the south side of est
Washington Avenue about 1 400 feet west of South 52n Avenue and about 2,000 eet

Proposal. The proposed preliminary plat would divide a 2 85 -acre parcel into 12 ots
ranging in size from 9,450 square feet to 12,243 square feet. The lots are intended for

Access would be from West Washington Avenue onto Wellington Drive where three
shared driveways would provide access to all twelve lots Wellington Dnve (currently
South 56 Avenue) is also the proposed access for the four phases of the prelunmary plat
of Wellington Estates that has been previously approved. Since this phase 5 was not
included as a phase of the uutial Wellington Estates plat, it must be reviewed as an
individual project with careful attention to the conditions of that plat.
Property Description. The project site contains a single - family dwelling, a shop and
small accessory buildings that will all be demolished. The properties unmediately north
of the site are used for agncultural and residential purposes on parcels ranging m size
from 1 8 to 117 acres m size Property to the east and south are portions of the previously
approved Wellington Estates subdivision currently consisting of a few single- family
residences and large areas of open land. To the west are
a nuxture of service businesses 4111
and single - family residences on parcels averaging 2 to 5 acres m size, including Mr
MGSharry's business at the Cascade Garden Event Center The project site is relatively
flat with a slope of 0 to 2 %. The property is located within a flood -prone area that may
be subject to high seasonal groundwater levels, but there are no designated cntical areas
on or immediately adjacent to the site
Jurisdiction. A preliminary plat is classified and processed as a Type IV review The
Hearing Examiner conducted an open record public hearing regarding this prehmmary
plat application pursuant to Title 16B of the Yakima County Code and has formulated
this recommendation to be considered by the Board of Yakima County Commissioners at

Appropriate Subdivision Provisions for Public Health, Safety and General
Welfare Through Zoning and Land Use Requirements for the Site and
Adyacent Properties. The proposed preliminary plat makes appropnate provisions for
the public health, safety and general welfare insofar as it satisfies the mtent of the
Comprehensive Plan Low Density Residential designation. Low Density Residential is
pnmanly planned for single - family, detached residences Net residential density before
considering roads and nghts -of -way is less than 7 dwelling units per acre, which is
considered the lowest residential density to efficiently support pubhc services The Low
Density Residential comprehensive plan designation is implemented by the UAZO which
designates the subject area as the Suburban Residential (SR) zone The proposed
preliminary plat also satisfies the intent of the SR zoning distract which is to provide a
variety of residential lifestyles with densities generally ranging from 2 units per net
residential acre to 7 uruts per net residential acre The higher densities are permitted
where, as here, public water and sewer systems are used.

Appropriate Subdivision Provisions for Public Health, Safety and General,
Welfare Through Development Standards and Requirements. The lot
configuration of the proposed prelumnary plat allows for development consistent with the
followmg development standards and requirements that have been established to promote
the ;public health, safety and general welfare
(a) Density/Lot Size. The proposed lots are larger than the minimum size
allowed m the SR zoning distract where public water and sewer services are
utilized as proposed here The smallest proposed lot is 9,450 square feet in size
which is considerably larger than the mu mum 7,000 - square -foot size prescribed
by Table 5 -2 for the SR zone Calculations based on parcel information and
dimensions shown on the prehmmary plat mdicate an overall density of 4 2 units
per acre which is considerably less than the maximum density of 7 units per acre

III (b) Setbacks. Table 5 -1 in Chapter 15A.05 of the UAZO () p requires a ont
yard structural setback of 60 feet from the right -of -way centerline for Vest
Washington Avenue, a front yard structural setback of 45 feet from the nght -of-
way centerline for mtenor roads, a side yard structural setback of 5 feet from the
property line not bordering a street nght -of -way; a side yard structural setback of
10 feet for side yards bordenng a street nght -of -way; a rear yard structural setback
of 15 feet from the property line not bordering a street; and a rear yard structural
setback bordering a street nght -of -way that is the same setback requirement as the
front yard. The proposed preliminary plat will have large enough lots, to
accommodate all front, rear and side structural setbacks Because adjustments to
standards are sometimes granted and because the standards themselves c 'uld
always change, none of these standards should be shown on the final plat.
(c) Lot Coverage. Maximum lot coverage within the SR zone is 45 %. he
lots are of such a size that normal -sized residential structures with acces ory
buildings can be constructed on the lots without exceedmg the 45% maxim lot
coverage m the SR zoning distract. The estimated maximum lot coverage
proposed as part of the SEPA environmental review for this project is 40 to 45°0.
(d) Lot Dimensions The muumum lot width m the SR zone is 60 fe i t if
the lots are served by a pubhc or community water system. Each lot must ha e a
• muumum of 20 feet of lot frontage on a pubhc road or be served by an ac ess
easement that is at least 20 feet wide The preliminary plat shows all proposed ots
to have a width exceeding 60 feet. Seven of the proposed lots will have from ge
on Wellington Dnve and/or West Washington Avenue Access to the five mte or
lots and the one northernmost mtenor lot fronting West Washington Avenue kill
be by 30- foot -wide shared easements which will each serve four lots he
easements will provide for utilities as well as access Therefore, the prop sed
dimensions of the lots comply with Chapter 15 05 of the UAZO required m the SR
zoning district.
(e) Site Screemng. Table 7 -1 m Chapter 15A.07 of the UAZO requires ite
screening for certain types of development or situations Site screening is not
required for this type of proposal under the circumstances

open space, as may be required by Section 14 28 070 of the Yakima County Code (Y C)
or Section 15A.09 030 of the UAZO, are not typically invoked by the County unless
there is a significant lack of open space witlun a development or unless a .park or

recreational area is lost due to the development. Here the project density is proposed to
be 4 lots per acre which is well below the 7 lots per acre allowed m the SR zone The
proposed subdivision will have a maximum lot coverage of 45% and will not displace
any existing recreational land or use Therefore, additional land for parks or recreational
area will not be necessary m order to retain an acceptable or required amount of open
space
Appropriate Subdivision Provisions for Drainage Ways. Section 14 48 100 of the
YCC requires an acceptable dramage plan. The County has determined that potentially
significant adverse impacts could be caused by the development unless storm and ground
water is properly managed. Mitigation measures Al and A2 of the MDNS have been
required m order to ensure the proposed plat adequately provides for suitable drainage
without causing undue adverse impacts They are smular to the mitigation measures •
required by the MDNS issued for the first four phases of Wellington Estates The
mitigation measures for phase 5 must be coordinated with the mitigation measures for the
first four phases Erosion control measures, a stormwater construction permit and a
Stormwater Pollution Prevention Plan are Department of Ecology requirements Details
of the stormwater requirements that will ensure appropnate provisions are made for
drainage include the following

(a) Since the property is located within the Ahtanum Creek Watershed which
the County Engineer has determined to be a flood -prone basin, impacts to surface
water will likely result unless existing drainage facilities, ground and surface water
levels and soil types are properly identified and managed. Excavation, site
development, and subsequent lot use needs to be done m a manner that dramage
facilities and adjacent property owners are not negatively impacted by stormwater
runoff. On -site stormwater retention is required.
(b) Depth to seasonal groundwater and soil type, soil character and soil depth
all have a direct influence on stormwater system design and potentially the

pre plat layout. Given the observed variability m local subsurf.ce
geology, depths to groundwater and infiltration capacities of Yakima County soils,
the type and depth of geological matrix, the depth to groundwater and he
infiltration capacity should be determined pnor to final lot layout and design m
order to ensure that adequate space (above ground or below ground) is provided
for stormwater facilities, including allowances and easements for proper long -term
inspection and maintenance by private or public entities The Stormwater
Management Manual for Eastern Washington (Ecology, September 2004), the
recently revised Underground Injection Control (UIC) Program rule (Chapter 173-
218 WAC), and Ecology's draft document entitled Determination of Treatment
and Source Control for UIC Well m Washington State (Ecology, July 2005) Will
aid the designer m choosing the appropnate stormwater facilities and/or treatment
facilities for this particular project. Underground disposal will have to comply
with the requirements of the referenced UIC rule and draft document.
(c) Operators of the following construction activities are required to be cove ed
under the National Pollutant Discharge Elimination System (NPDES) and Sate
Waste Discharge General Permit for Stormwater Discharge Associated with
Construction Activity (Ecology, November 2005) Clearing, grading and /or
0 excavation which results m disturbance of one or more acres, and discharges
stormwater to surface waters of the state, and clearing, grading and/or excavation
on sites smaller than one acre which are part of a larger common plan! of
development or sale, if the common plan of development or sale will ultimal'ely
disturb one acre or more, and discharges stormwater to surface waters of the st4e
(d) Mitigation Al A stormwater management plan meeting the folio g
design standards must be submitted for review and approval by Yakima Co ty
Public Services pnor to grading of the property or any road or acJess
development.
(1) Stormwater retention shall be provided. A Professional Engineer
registered m the State of Washington shall design all drainage facilities lind
components Drainage plans using Best Management Practices and design
requirements of the Yakima County Surface Water Division must be subnutted
to and approved by the Yakima County Public Services Department pno to
grading or plat development.

(2) Post - development stormwater flow rates and volumes shall not exceed
pre - development conditions for up to the 100 -year storm event, since the plat is
located wrthm a flood -prone basin. The standard of full retention of the 25-
year storm event generally meets this goal.
(3) A road dramage system may be enlarged to accommodate not only the
runoff flows and volumes from the road surfaces but also 50% of the flows and
volumes from the impervious areas including roofs, driveways, and sidewalks
that have the potential to release runoff into the road drainage systems The
assumption is that 22 5% (half of the 45% lot coverage standard) of the
stormwater generated from any lot will find its way into the road stormwater
drainage systems Use of this assumption requires the developer's engineer to
venfy that lot grading will provide adequate storage to retain runoff from the
other half of the impervious surface on each lot, or that other off -lot retention
is provided outside the road system.
(e) Mitigation Measure A2 Geotechmcal information (geologic matrix and
depth to groundwater) and infiltration rates pertinent to conceptual design need to
be obtained prior to design of the preliminary plat.
(1) The depth to the seasonal high groundwater must be determined pnor
to planning the layout of stormwater facilities In some areas, the seasonal
high groundwater depth occurs during the summer months when nmgatnon
water is used.
(2) If a stormwater infiltration facility will be used for the disposal of
runoff, an in - situ permeability test shall be conducted uutially at the site to
determine existing infiltration rates pnor to the design stage
Appropriate Subdivision Provisions for Potable Water Supplies. Section
14-52 130 of the YCC requires a plat to be connected to an existing municipal pubhc
water system or a large Group A water purveyor when available Section 15 20 032 of
the YCC requires that development within an urban growth area connect to pubhc water
service where available The proposal is to utilize the Nob Hill Water System. No

the YCC requires on -site sewage disposal systems for all new lots unless municipal or

available The proposed and required source of sewer service for the plat is the Yakima
Wastewater System m accordance with City of Yakima standards As proposed,
connection to the system will comply with the Yakima County Code and the Yakma
0 urban area development standards Venfication of the availability of service to this phase
of the Wellmgton Estates subdivision has not been confirmed.
Appropriate Subdivision Provisions for Public Ways. Title 10 and Title 14 of the
YCC provide miimum street standards and requirements for subdivision development
including those for project site and fire access, mtenor and frontage improvements, n,ht-
of -way standards and other necessary transportation elements Sidewalks will I be
required on both sides of the street in this plat. Other details relative to appropri

for all phases of the previously approved Wellington Estates Phase 1 through 4 are
also applicable to Phase 5 The previous mitigation measures required for the
preliminary plat approval of Phases 1 through 4 also apply to Wellington Phase 5

and are substantively incorporated as Mitigation Measure B1, B2 and B3,
including actions to address additional, direct impacts of Phase 5 on the previously
approved mitigation measures Compliance with the conditions of approval and
the mitigation measures descnbed m the final MDNS will satisfy required cntena
for transportation and public safety standards applicable to this project. The
applicant has submitted a traffic delay analysis as required by Mitigation Measure
B1 Wellington Dnve was constructed pnor to the submission of the traffic delay
analysis which was not consistent with the study / construction sequence required
under the MDNS Concludmg a review of the recently submitted traffic delay
analysis, the Transportation Division determined it will not require mitigation
measures in addition to those required under the final MDNS issued for this
project. Besides Mitigation Measure B1 requiring the traffic delay analysis that
has been submitted, the MDNS transportation mitigation measures m B2 and B3
are required.
(b) Mitigation Measure B2 The plat shall have a minimum of two full service
access roads as follows

(c) DUST CONTROL The Yakima Regional Clean Air Authority has subntted
comments indicating that the developer must file and gain approval for a dust control
plan pnor to commencing any construction or grading activities
(d) TOXIC SUBSTANCES The Department of Ecology has submitted comments
recommending that soils be analyzed for lead, arsenic and organochlorme pesticides and
that potential buyers be notified if they are found in concentrations exceeding MTCA
clean up levels
(e) ELECTRICAL, TELEPHONE AND GARBAGE SERVICE Electrical service,
