AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated at 106 and 108
North 5th Avenue in the City of Yakima, Washington,
from R -3, Multiple Family Zone, to B -2, Local Business
Zone.

WHEREAS, pursuant to due and legal notice, the City Council of
the City of Yakima held a hearing on the 24th day of May, 1971, upon
the recommendation of the Planning Commission that real property
situated at 106 and 108 North 5th Avenue within the City of Yakima,
Washington, the legal description of which is set out hereinbelow,
be rezoned from R -3, Multiple Family Zone, to B -2, Local Business
Zone, and
WHEREAS, the City Council finds that such recommendation of the
Planning Commission for such rezoning should be approved for the
reasons that such rezoning is in accord with good planning and with
the General Plan of the City of Yakima; that the majority of property
41O owners in the vicinit y oppose not o ose the change in classification;
that the needs of the City and community do require such change and
that the highest and best use of said property is for B -2, Local
Business Zone, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The recommendation of the Planning Commission of the
City of Yakima that the following described real property situated
at 106 and 108 North 5th Avenue in the City of Yakima, Washington, and
r...+ore particularly described as follows, to wit:
Lot 3, Block 289, Ker's addition to North Yakima recorded in
Volume "A" of Plats, page 17, and Lot 3, Block 289, Ker's Second
Addition to North Yakima, W.T. as recorded in Volume "A" of
Plats, page 32, records of Yakima County, Washington; Lot 4,
Block 289 Ker's Second Addition to North Yakima as recorded
in Volume "A" of Plats, page 32, records of Yakima County,
Washington;
be rezoned from R -3, Multiple Family Zone, to B -2, Local Business
Zone, be, and the same is hereby, approved and said real property is
hereby rezoned to B -2, Local Business Zone.
Section 2. The above change in zoning shall be included and
depicted on the next regularly amended Use District Map prepared by
and for the City.
Section 3. The City Clerk is hereby authorized and directed to
file with the Yakima COUnty Auditor a certified copy of this ordinance.
Section 4. This ordinance shall be in full force and effect
thirty days after its passage, approval and publication as provided by
law and by the City Charter.
PASSED BY THE CITY COUNCIL, signed and approved this 24th day of
May, 1971.
