Avenue, in the City of Yakima, Washington, from R -3, Multiple Family Zone, to B -1, Modified Business Zone. 410 WHEREAS, pursuant to due and legal notice, the City Council of the City of Yakima held a hearing on the 21st day of June, 1971, upon the recommendation of the Planning Commission that real property situated at 201, 203, 205, 207, 209, 211 and 213 South 12th Avenue, within the City of Yakima, Washington, the legal description of which is set out hereinbelow, be rezoned from R -3, Multiple Family Zone, to B -1, Modified Business Zone, and WHEREAS, the City Council finds that such recommendation of the Planning Commission for such rezoning should be approved for the reasons that such rezoning is in accord with good planning and with the General Plan of the City of Yakima; that the majority of property 0 owners in the vicinity do not oppose the change in classification; that the needs of the City and community do require such change and that the highest and best use of said property is for Modified Busi- ness Zone, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA : Section 1. The recommendation of the Planning Commission of the City of YakimA that the following described real property situated at 201, 203, 205, 207, 209, 211 and 213 South 12th Avenue in the City of Yakima, Washington, and more particularly described as follows, to wit: Beginning at the northeast corner of Lot 16, Block 412, Capital Addition to North Yakima, Washington, recorded in Volume "A" of plats, page 29, records of Yakima County, Washington, thence southerly along the easterly line of Lots 16, 15, 14, 13, 12, 11, thence southerly along the easterly line of Lot 1 of Congdon's Replat unrecorded (Lot 1 described below) to the southeast cor- ner; thence westerly along the south line of said Lot 1 to the east right of way line on 12th Avenue, thence northerly along said east right of way line to the northwest corner of Lot 16, Block 412, of said Capital Addition, thence easterly along the northerly line of said Lot 16 to the northeast corner, the point of beginning; Lot 1 of Congdon's Replat, unrecorded, is described as follows: Beginning at a .point 1089.6 feet north and 60 feet east of the southwest corner of the southeast quarter of the southwest quar- ter of Section 24, Township 13 North, Range 18, E.W.M., thence north 71 ° 36' east 233.3 feet, thence south 18 ° 20' east 129.29 feet, thence west 263.45 feet, thence north 50 feet to the point of beginning; III be rezoned from R-3, Multiple Family Zone, to B -1 Modified Business � P Y > > Zone, be, and the same is hereby, approved and said real property is hereby rezoned to Modified Business Zone. Section 2. The above change in zoning shall be included and depicted on the next regularly amended Use District Map prepared by and for the City. Section The City Clerk is hereby authorized and directed to file with the Yakima County Auditor a certified copy of this ordinance. Section 4.
