HomeMy WebLinkAbout1971-1314 ORDINANCE NO. /3/1 AN ORDINANCE providing for the improvement of certain property by con- structing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection; and by constructing a pipe sewer with the necessary pump station and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA : Section 1. The following described property situate in Yakima County, Washington, shall be improved by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection; and by con- , structing a pipe sewer with the necessary pump station and manholes: That part of Lots 25, 26, 31, 32, 33, 34 and 39, Goodwin's Five Acre Tracts, according to the Plat thereof recorded in Volume "A" of plats, page 18, records of Yakima County, Washington, bounded as follows: Commencing at the east quarter corner of Section 29, Township 13 North, Range 19, E.W.M., thence north 89 west, reference 4111 bearing along the north line of the southeast quarter of said section 570.90 feet; thence south 25 east 91.14 feet to a point on the southerly margin of Primary State. Highway No. a, as shown on that certain map of definite location recorded in Volume "A" of Highway Maps, page 86, under File No. 1894647, records of Yakima County, Washington, and the point of beginning; thence south 87 east along the southerly margin of said P.S.H. No.. 3 a distance of 280.33 feet to a point which is 250.57 feet west of the east line of said Goodwin's Five Acre Tracts; thence south 0 west parallel with the east line of said plat 722.77 feet to the south line of the north half of said Lot 33; thence north 89 west along the south line of the north half of said Lot 33 to the east line of Lot 34, thence southerly along the east line of Lots 34 and 39 of said plat to the south line of Lot 39, thence westerly along the south line of Lot 39 to the easter- ly margin of the "F G" line of P.S.H. No. 3, thence northerly along the easterly margin of said "F G" line to the south line of the north half of Lot 34 of said plat, thence north 0 east along the easterly margin of said "F G" line 545.31 feet; thence south 89 east 20.00 feet; thence following the southerly margin of said "F G" line, along the arc of a curve to the right in an easterly direction having a radius of 141.00 feet an arc dis- tance of 221.48 feet to the P C on said southerly margin opposite Highway Engineers Station F G 4 + 28.9, thence south 89 east along said southerly margin 78.70 feet; thence along said southerly margin along the arc of a curve to the right, having a radius of 523.00 feet, through a central angle of 13 an arc distance of 119.88 feet; thence along said southerly margin south 76 east 57.70 feet; thence along said southerly margin along the arc of a curve to the left having a radius of 126.40 feet through a central angle of 80 an arc distance of 178.38 feet to the point of beginning. Section 2. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 983," which said district shall include all of the above described property. Section 3. The assessments shall be made according to special 411 benefits derived from the improvements without regard to the zone and termini method. Section 4. All costs and expenses in connection with the con- struction of said improvement, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by law and as above described. Section 5. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed 4110 with the City Clerk, and which are hereby approved and adopted. Section 6. The work necessary to be done in connection with the making of said improvement shall be done partially by contract upon competitive bids and partially by the City itself, with City employees, according to specifications and plans as prepared by the Engineering Division of the Department of Public Works, and the City shall have the power to reject any and all bids. Section 7. There is hereby created a special fund, to be called "Local Improvement Fund, District No. 983 ", into which shall be placed all sums paid on account of the aforesaid special assessments, includ- ing all interest and penalties thereon, and in the event of the sale 0 of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds bearing interest at a rate not to exceed 87 per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the costs and expense of said improvement, - 2 - which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at a rate not to exceed 83% per annum, interest payable annually under the mode of payment "payment by bonds ", as defined by the statutes of the State of Washington and the ordinances of the City of Yakima, provided that, this improvement may be financed by the issuance of promissory notes, under the authority of R.C.W. 35.45.150 and Section 8.12.100 of the City of Yakima Municipal Code. Section 9. This ordinance is one relating to local improvements or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter.
