AN ORDINANCE appropriating the amount of $95,000 in 382 - Cumulative
Reserve Fund For Capital Improvements for transfer to
143 -Urban Arterial Fund; transferring that amount to,
and appropriating it in, Account 542.10.42, Miscellaneous,
of the 1971 appropriation for 143 -Urban Arterial Fund.
WHEREAS, 382-Cumulative Reserve Fund For Capital Improvements
has or will have unappropriated money in the amount of $95,000 avail-
able for appropriation and transfer as provided by this ordinance, and
WHEREAS, the amount of $95,000 is required to be appropriated
within that fund for transfer to and appropriation in 143 -Urban
Arterial Fund to be there segregated and held by the Director of
Finance in lieu of filing a supersedes bond to assure payment of any
judgments for attorneys' fees in the amount ultimately determined by
pending legal action in the case of City of Yakima vs. Haddix and
Lovering concerning railroad overcrossings, and
WHEREAS, at the time of the adoption of the 1971 budget it
could not have reasonably been foreseen that such additional appropria-
tion would be required; and the City Council finds that an emergency
exists of the type contemplated by R.C.W. 35.33.091 and that it is in
the best interests of the City to make the appropriation herein pro-
vided, now, therefore,
BE IT ORDAINED BY THE CITY OF YAKIMA:
Section 1. The amount of $95,000 is hereby appropriated from un-
appropriated money in 382 - Cumulative Reserve Fund For Capital Improve-
ments to Account 382.585.00.63, Transfers, of that fund for transfer to
and appropriation in 143 -Urban Arterial Fund as provided hereinbelow.
Section 2. The amount of $95,000, appropriated by Section 1 of
this ordinance, is hereby transferred from 382-Cumulative Reserve Fund
411 For Capital Improvements to 143 -Urban Arterial Fund.
Section 3. As the transfer authorized by Section 2 of this ordi-
nance is made, the $95,000 so transferred is hereby appropriated to
Account 143.542.10.42, Miscellaneous, of the 1971 appropriation for
143 -Urban Arterial Fund, to be there segregated and held by the
Director of Finance for the purposes aforesaid.
Section 4. This ordinance is one making an appropriation and
shall take effect immediately upon its passage, approval and publica-
tion as provided by law and by the City Charter.
