City , of Yakima, Washington, providing for the" submission to the qualified electors of the city at a special election to be held therein on November 2, 1971, of a proposi- tion of whether or not the city should • issue its unlimited tax levy general obli- gation bonds in the principal amount of $1,900,000 for the purpose of providing part of the funds to pay the cost of acquiring, constructing, equipping and making certain capital improvements to the park and recreation facilities of the city, and declaring an emergency. WHEREAS, the existing public park and recreation facili- ties of the City of Yakima (hereinafter called the "City"), are not adequate for the present and future needs of the residents of the City; and WHEREAS, the Department of Parks and Recreation of the 111 City has prepared a plan for the acquisition, construction and • installation of capital improvements to the public park and recre- ation facilities of the City which, when developed, together with existing facilities, will provide a public park and recreation system available to and for the general benefit of all of the resi- dents of the City; and •— WHEREAS, it is anticipated that certain United States of America and State of Washington grants of money will be available to pay part of the cost of such plan of capital improvements, and to provide the funds necessary to pay the balance of carrying out such plan; it is deemed necessary and advisable that the City issue and sell its unlimited tax levy general obligation bonds in the principal amount of $1,900,000; and WHEREAS, the Constitution and laws of the State of Wash- ington provide that the question of whether or not such bonds may be issued and sold for such purposes must be submitted to the qualified r. electors of the City for, their ratification or rejection; and 41k WHEREAS, it is further deemed necessary and advisable that said'proposition be submitted'to such qualified electors at a special election to be held at the time of the general election to be held on November 2, 1971; NOW, THEREFORE, BE IT ORDAINED by the City of Yakima, Washington, as follows: Section 1. It is hereby found and declared that it is necessary fa-the public health, welfare and benefit of the residents of the City that it carry out the plans hereinafter provided. Section 2. The City shall: A. Acquire, construct, install and make necessary capital improvements to the Franklin, Washington, Miller, Lions, Larson, Milroy, Cahalan, Gardner, Gilbert, Kiwanis, Ilk Eisenhower High School, Senior Center, and Randall parks and recreation facilities as found necessary and desirable by the City Council. B. Construct and equip a year-round aquatic center at Lions Park, consisting of but not limited to a covered pool, dressing rooms, heating equipment and other related facilities. C. Acquire all real and personal property for park and recreation purposes necessary to carry out the above-described plan of capital improveMents and for new and additional park and recreation facility sites as found necessary and desirable by the City. Section 3. For the purpose of providing part of the money necessary to acquire, construct, equip and make the improve-: ments described in Section 2 hereof, the City shall issue and sell its unlimited tax levy general obligation bonds in the principal amount of $1,900,000. PROPOSITION NO. 1 PARK AND RECREATION FACILITIES BONDS, $1,900,000 Shall the City of Yakima, Washington, acquire property for park and recreation purposes, acquire, construct, install and make necessary capital im- provements to the same and existing park and recre- ation facilities, and construct and equip a year- round aquatic center at Lions Park, and to provide part of the money therefor issue its general obliga- tion bonds in the principal amount of $1,900,000, such bonds to bear interest at a rate or rates to be fixed upon the sale or sales thereof, to mature serially in from two to twenty years from 'date of issue and to be paid, both principal and interest, out of annual tax levies to be made upon all the taxable property within the city without limitation as to rate or amount, all as more specifically provided in Ordinance No. /3 _33 of the city, passed and approved September 13, 1971? 110 BONDS, YES / / BONDS, NO / / Section 6. For the reason that the laws of the State of Washington require that this ordinance be certified to the Yakima County Auditor at least forty -five days prior to said November 2, 1971, election date, an emergency is hereby declared to exist, and for the immediate preservation of the public peace, property, health and safety this ordinance shall become effective immedi- ately upon its passage, approval and publication as provided by law.
