HomeMy WebLinkAbout1971-1353 ORDINANCE NO . / .K AN ORDINANCE relating to zoning; providing that no property use shall become nonconforming by reason of conveyance or appropri- ation of a portion of such property for street right of way; repealing a definition of "front yards "; adding a new section 12.64.100 and repealing Section 12.60.090, both of the City of Yakima Municipal Code; and declaring an emergency. WHEREAS, public hearings have been held by both the Planning Com- 411 mission and the City Council of the City of Yakima pursuant to a Resolution of Intention of the Planning Commission to add new Section 12.64.100 and to repeal Section 12.60.090 of the City of Yakima Muni- cipal Code as provided by this ordinance, as a result of which hearings the Planning Commission has recommended to the City Council that this ordinance be passed and the City. Council finds it to be in the best interests of the City that this ordinance be passed, now, therefore, BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 12.64.100 is hereby added as a new section to the City of Yakima Municipal Code to read as follows: "12.64.100 Street Dedication. No use of land, building or other improvement maintained upon a lot at the time of con- veyance to, or appropriation by, the City of Yakima of a portion of such lot for street purposes shall be or become nonconforming by reason of such conveyance or appropriation." Section 2. Section 12.60.090 of the City of Yakima Municipal Code is hereby repealed in. its entirety. • Section 3. This ordinance is one to provide for the immediate preservation of the. public peace, property, health, safety and welfat-e of the people of the City of Yakima and'an emergency is hereby declared to exist and this ordinance shall be in full force and effect immedi- ately upon its passage, approval and publication.as provided by law • 411 and by the City Charter.
