AN ORDINANCE,relating to the multiple dwelling unit transit subsidy tax levied by the City of Yakima; specifying the manner of computing such tax; amending Section 4 of City of Yakima Ordinance No. 1336, passed September 13, 1971, • entitled "AN ORDINANCE relating to the operation of the public transportation system of the City of Yakima; 411 levying and providing for the collection of a multiple dwelling housing unit transit subsidy tax; specifying a method of computing such tax; limiting the use of pro- ceeds from such tax; and declaring it to be unlawful to refuse to pay said tax and providing for punishment on conviction thereof"; and declaring an emergency. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. Section 4 of City of Yakima Ordinance' No. 1336, passed September 13, 1971, entitled "AN ORDINANCE relating to the operation of the public transportation system of the City of Yakima; levying and providing for the collection of a multiple dwelling housing unit transit subsidy tax; spedifying a method of computing such tax; limiting the use of proceeds from such tax; and declaring it to be unlawful to refuse to pay said tax and providing for punish- 411 ment on conviction thereof", is hereby amended to read as follows: "Section 4 Computation of Tax. The amount billed and collected as the tax based on multiple dwelling housing units shall be an amount computed on the basis that the average occupancy rate during the billing period of housing units in each multiple dwelling is 907; provided, the owner or manager of any such multiple dwelling, or other person billed for ser- vice thereto, may state in writing, signed by the person making the statement, on forms furnished by the City, that the average occupancy rate was a specified rate less than 90% for any parti- cular billing period, and may file such statement at the office !II of utility accounting of the City at the time of payment of the tax for that period, in which event the amount of tax to be paid shall be accordingly reduced subject to verification by the City that,the specified occupancy rate is accurately stated." Section 2. This ordinance is one to provide for the immediate preservation of the public peace, property, health, safety and wel- fare of the people of the City of Yakima and an emergency is hereby declared to exist and this ordinance shall be in full force and 410 effect immediately upon its passage, approval and publication as provided by law and by the City Charter.
